Chairman Munoz then led in the pledge of allegiance. DIRECTOR'S REPORTS A. UPDATE TO THE HISTORIC PRESERVATION COMMISSION REGARDING MAINTENANCE INSPECTIONS OF ALL CITY HISTORIC LANDMARKS Daniel Correa,Assistant Planner gave the report. He reported that the majority of the properties are in compliance with the current HPC ordinance. Vice Chairman Howdyshell asked what three properties are not in compliance and what are the issues and how long does the property owner get to respond to a notice. Mr. Correa stated that because of high vegetation and deep setbacks, no inspection of the interior of the Palmer Ranch, the Emory Alan House, and the Beverly Hills House could take place. He said some responses came in over the holidays; overall a positive response has occurred. Vice Chairman Howdyshell referred to Page A-3 Item B. She asked what happens if an owner does not have funds to maintain their property. Candyce Burnett, Senior Planner stated that this is handled on a case by case basis and that there • is some understanding that some may have this because of the economy. She said the City attempts to work with the property owner and the City tries to avoid a code enforcement action. She said many residential historic property owners have a Mills Act Contract and so they are responsible to follow through with the maintenance items listed on their contract. Steven Flower, Assistant City Attorney, commented that the maintenance standards are not • extraordinary; it is basic maintenance to keep the structure standing to avoid a "demolition by neglect"situation. He said it would include keeping the vegetation cut back and to keep the building water proofed. He said these are things most owners should be doing anyway. Larry Henderson, Principal Planner said the City helps as resources become available with CDBG funds, and sometimes the Boy Scouts or churches will volunteer for clean up projects. Ms. Burnett said that also built into the new Historic Preservation Ordinance is a provision to establish a Historic Preservation fund, so when that can be funded, more resources may become available. Commissioner Fletcher asked if the City has a volunteer organization that can help. Mr. Henderson said the Church of Latter Day Saints does community projects and sometimes we ask the property owner if they have a church that they attend to see if they can help. He said Northtown Housing also gets people out to help. Ms. Burnett said the City also funds through CDBG some recipients like the Oldtimers'to help with minor repairs that the property owner is unable to do themselves. Chairman Munoz opened the floor for public comment. Gwynn Frost said that for various reasons, some may not qualify for the Mills Act and those families don't have these benefits. She said a separate historic commission or group or another avenue such as CLG to open doors for more available funds is needed. • Luana Hernandez, 6797 Hellman Avenue asked if there a City mandate for all property owners to keep up their property. She said it is a shame that CVWD is not taking care of the China House as it is being neglected. Chairman Munoz closed the public comment period. He asked staff to respond to the comments regarding the requirement to keep a structure sound. Ms. Burnett said that all properties by the Municipal Code have a minimum standard of maintenance and code enforcement is complaint driven; all complaints are reviewed. She said the new ordinance has these standards included and there is some strength built in to get property owners to comply. She said basically they must do enough to support and keep the structure standing, and to secure the roof and walls from water penetration. She said these were the inspection elements that were reviewed for each property as described in staffs report. Commissioner Oaxaca noted there are some pending properties such as the China House. He asked if there will be a follow up report on those. Mr. Henderson said staff will update the Commission when that information is available. Troyer, AICP, Planning Director Subject: UPDATE TO THE HISTORIC PRESERVATION COMMISSION REGARDING THE RED-TAGGED CONDITION OF THE WINE CONVEYER BELT ARTIFACT LOCATED WITHIN THE THOMAS WINERY BUILDING. BACKGROUND: The Thomas Winery building, located at 8916 Foothill Boulevard, was designated a Historic Landmark by the City on December 19, 1979. It is also designated as California State Historic Landmark #490. As part of the adaptive re-use of the project site and building in 1990 (Landmark Alteration Permit 90-03), conditions were placed to retain interior and exterior artifacts (the artifact plan) throughout the project site and building. The artifact plan specified that the wine case conveyor, the adobe wall on the southwest corner of the structure, wine cask seating, upper half of the staircase, and beam scale were to remain intact, decorating the interior of the building as part of the adaptive reuse project to preserve its historic character. GENERAL: On January 17, 2012 a Conditional Use Permit and Entertainment Permit were filed by Sartay Signh who currently owns and operates Antonino's restaurant in the same center and is proposing to use the space at 8916, #K Foothill Boulevard for a new restaurant use that proposes to • occupy the former Bobby Baja's restaurant. The space has been vacant for over three years. The applicant would like to operate a restaurant with a full bar and entertainment. The Planning Department and Building and Safety staff met with the applicant on site on January 10, 2012, regarding the wine conveyor belt and interior artifacts inside the structure. The wine conveyor belt artifact has missing support pieces and it was deemed by the Building and Safety Official as "unsafe" and red-tagged. The red-tagged condition enables the property owner to remove the artifact without first obtaining a Certificate of Appropriateness and averts any California Environmental Quality Act review. The tenant would like to remove the conveyor belt structure and is proposing to store the artifact in the attic of the Thomas Winery Building and has also agreed to have professional photographs taken of the conveyer belt and have a picture or pictures of it displayed in the restaurant. However, per the Historic Preservation Ordinance adopted June 15, 2011, Section 2.24.190 B., this item must be forwarded to the Historic Preservation Commission prior to its removal. The Historic Preservation Ordinance allows the City to remediate any "unsafe or dangerous" resource as deemed by the Building Official or for the Historic Preservation Commission to "recommend a reasonable period of postponement for the purpose of arranging for rehabilitation, relocation, or salvage of the Historic Resource." The improvement that the new tenant intends to make is to construct a bar in the area immediately adjacent to the conveyor belt artifact. According to the Building and Safety Director, in order to structurally shore up the artifact it would have to be "entombed" with essentially walls being constructed on each side which would likely impede patron circulation around the proposed bar area and restrooms. The Building and Safety Director also recommended that a fence could be constructed around it to • protect patrons from the structure if it falls. To stabilize the structure a structural engineer would have to be retained to recommend structural improvements to the belt artifact. Likely structural mitigation may require losing floor space of up to five feet on each side of the belt artifact making the floor area of the tenant space less viable. From staff's standpoint to leave the belt artifact in place would require the Item A UPDATE ON ARTIFACTS AT THE THOMAS WINERY January 25, 2012 Page 2 applicant to accrue design, construction and environmental expenses and delayed tenant improvements. • A cultural assessment could result in a recommendation of allowing it to be removed subject to what the applicant is already proposing to do which is place the belt artifact in the attic and have the artifact professionally photographed and displayed in the tenant space. RECOMMENDATION: Staff recommends that the Historic Preservation Commission either 1) invoke Subsection C of the Historic Preservation Ordinance and delay the removal of the artifact and require the project applicant to look for alternatives or 2) allow the artifact to be removed subject to appropriate mitigation measures that will be reviewed by the Planning Director prior to the removal. A. None of the provisions of this Chapter shall be construed to prevent any construction, alteration, removal, demolition or relocation of a Historic Landmark or Contributing Resource necessary to correct the unsafe or dangerous conditions of any structure, or feature, or part thereof, where the Building & Safety Official has declared such condition unsafe or dangerous and the proposed construction, alteration, removal, demolition or relocation necessary to correct the unsafe or dangerous condition. Only such work as is necessary to correct the unsafe or dangerous condition'may be performed pursuant to this Section. B. The Building & Safety Official shall inform the Commission prior to authorizing any work pursuant to this Section unless he or she determines that such work is immediately necessary to correct the unsafe or dangerous condition; in which case, the Building and Safety Official shall report his or her actions to the Commission at its next regular meeting. C. If work authorized by the Building & Safety official pursuant to his Section is not immediately necessary to correct the unsafe or dangerous condition, the Commission may advise the Building & Safety Official of the historic significance of the building and recommend a reasonable period of postponement for the purpose of arranging for rehabilitation, relocation, or salvage of the Historic Resource or Contributing Resource.
