HomeMy WebLinkAbout1989/09/28 - Minutes - Special September 28, 1989 CITY OF RANCHO CUCAMONGA CITY COUNCIL MINUTES Special Meetinq A special meeting of the City Council of the City of Rancho Cucamonga was held on Thursday, September 28, 1989, at ~ndrows Park, 6~ ~ctor~a ~rk ~e, Rancho Cucamonga, California. The meeting was called to order at 5:15 p.m. by Mayor Dennis L. Stout. (0703-01 LITIGATION) Present were Councilmembers: William J. Alexander; Deborah N. Brown; and Mayor Dennis L. Stout. Also present were: Jack Lam, City Manager; James Markman, City Attorney; Rick Gomez, Community Development Director; Brad Buller, City Planner; and Debra Jo Adams, City Clerk. Absent were Councilmembers: Charles J. Buquet II and Pamela J. Wright. Mayor Stout stated he called this special meeting for an Executive Session to discuss possible litigation in order to stop Norm Johnson and the Rock Crusher plant, who continue to violate the "Stop Work Order" issued by the County. He further stated another reason he called this meeting is that it has been brought to his attention that they are violating their "Stop Work Order" and continuing to put in improvements and do construction work on site. He further stated it has been learned this week that the County has declined to take an injunctive action against the Rock Crusher plant, leaving the City no choice but to explore other possibilities as to what the City can do. Mayor Stout stated he has asked James Markman, City Attorney, to look into this matter. (i) Meeting adjourned at 5:20 p.m. to an Executive Session to discuss potential litigation against the Fourth Street Rock Crusher Company, in relation to the work now performed at their project site near the Day Creek Flood Control Facility, contrary to the orders of the County of San Bernardino. City Council Minutes September 28, 1989 Page 2 The meeting reconvened at 5:28 p.m. with three members of Council present (Buquet, Wright absent). MOTION: Moved by Brown, seconded by Stout to move forward with litigation against the Fourth Street Rock Crusher Company. Motion carried unanimously, 3-0- 2 (Buquet, Wright absent). Councilman Alexander stated the reason he was voting for this was because he felt that by filing the lawsuit, it would definitely make a statement. Mayor Stout stated for the record that he had talked with Councilwoman Wright the previous evening and she was in favor of moving forward with the litigation. MOTION: Moved by Brown, seconded by Alexander to adjourn. Motion carried unanimously, 3-0-2 (Buquet, Wright absent).
