A, CALL TO ORDKR
A regular meeting of the City Council of the City of Rancho Cucamonga met on
Wednesday, July 6, 1988, in the Lion's Park Cormnunity Center, 9161 Base Line
Road, Rancho Cucamonga, California. The meeting was called to order at ?:30
p.m. by Mayor Dennis L. Stout.
Present were Councilmembers: Deborah N. Brown, Charles J. Buquet II, Jeffrey
King, Pamela J. Wright, and Mayor Dennis L. Stout.
Also present were: Assistant City Manager, Robert A. Rizzo; City Clerk, Beverly

Discussion of Item C28. Approval to execute contract (CO 88-095) for the
Construction of Maintenance Facility Improvement Project at Red Hill Community
Park awarded to Bopark Enterprises, Incorporated, for the amount of $152,900
($139,000 plus 10% contingency) to be funded from Capital Improvement
Facilities, FY 87/88 - Account No. 01-4647-7043 (FY 87/88).
Councilwoman Wright inquired into what was actually being proposed to be done,
and if it was an original part of the park.
Russell Maguire, City Engineer, responded that this was part of the master plan
for the park; the purpose was for the operational maintenance of the park.
MOTION: Moved by Wright, seconded by King to approve Item Number C28.

E. ADVERTISED PUBLIC HEARINGS
El. RESIDENTIAL AND COMMERCIAL/INDUSTRIAL REFUSE RATE REVIEW - City Council
will consider a potential rate adjustment for refuse rates for the City of
Rancho Cucamonga. Staff report presented by Robert Rizzo, Assistant City
Manager.
Councilman Buquet stated the Citizens Advisory Commission was currently looking
at mandatory refuse collection and asked if that was enacted, would it have an
effect on the refuse rates.
Robert Rizzo, Assistant City Manager, stated it could have an effect on the
residential rates. He stated that between 2-5% of the residences are not on
service at this time. He stated it would take time to see how that affected the
rates but it might help to hold them down. He stated the biggest problem they
are having now is with the County on the dump fees.
Councilman Buquet asked what cities other than Rancho Cucamonga have mandatory
collection.
Robert Rizzo, Assistant City Manager, stated every city in San Bernardino County
except for Fontana and Adelanto.
Mayor Stout opened the meeting for public hearing. Addressing Council was:
A gentleman from the audience who stated that the representatives from
Yukon Disposal who worked during the last Clean Sweep Week did an
excellent job.
There being no further response, the public hearing was closed.
Councilwoman Wright felt that along with the increase she would like a
notification for the rationale for the increase, educational information
regarding the landfill problem for the state and nation, as well as recycling
information provided for the residents. She felt this would help them to
understand the long range situations instead of just accepting another increase
as a matter of course.
Robert Rizzo, Assistant City Manager, stated staff could work with the refuse
companies to provide some type of educational information in the bills.

Councilwoman Brown stated her concern with the educational brochure to be sent
out is who is going to review it for accuracy, because if you talk to three
different agencies you'll get three different answers because each agency has
its own opinion on what is going to be happening in the future. Her concern is
that what is said, and how it is said, to the people, because that is what the
Council has endorsed to be sent out and felt they needed to be careful.

O. CITY MANAGER'S STAFF REPORTS
G1. CONSIDERATION OF MATTERS FOR THE NOVEMBER 8, 1988 ELECTION. Staff report
presented by Beverly Authelet, City Clerk.
Councilman Buquet asked if the filing fee was based on incurred expenses.
City Clerk Authelet stated yes.
Councilman King felt that even though the filing fee might perhaps cover City
costs, it may be an impediment to some individuals and prevent them from filing
for office.

Councilwoman Brown concurred with Councilman King.
Andrew Arczynski, Deputy City Attorney, stated that any funds not collected
would come from the General Fund to make up the difference.
Mayor Stout stated sometimes there is an in-lieu filing fee on petitions, in
cases where fees can be large.
Councilwoman Wright stated that without a fee someone who was not seriously
running for office could put in their name, and felt it would be best to have
either the $200 fee or a collection of in-lieu signatures.
Andrew Arczynski, Deputy City Attorney, stated he understood the Election Code
provides for an alternative by submitting election papers executed by a specific
number of electors, but cautioned the Council that with recently adopted
legislation, it might be that the public financing of campaigns is invalid, a
provision authorizing the General Fund to cover the nomination papers may be
invalid due to Propositions 73 and 68.
Councilman Buquet stated he did not feel the General Fund should be picking up
any costs related to the election. He felt if a candidate chose to run for
office, they should have the incentive to either come up with the filing fees
or the in-lieu signatures.

resident request to provide for access to private property from Hillside Road.

Mayor Stout opened the meeting for public hearing. Addressing Council was:
Mrs. Cheryl Ramirez, 8362 Hillside Road, expressed she wanted only what
her neighbors had been permitted, and some had been permitted additional
accesses.
MOTION: Moved by Wright, seconded by Brown to grant the request. Motion failed
by the following vote:
AYES: Brown, Wright
NOES: Buquet, Stout, King
ABSENT: None
Councilman King expressed that he could vote on this only if he could see more
details of what they were proposing for that area, especially how they were
going to handle the grade differences.
Mayor Stout stated he had never voted for an access onto a secondary street like
Hillside.
Andrew Arczynski, Deputy City Attorney, pointed out that some of the pictures
the applicant had submitted had not been investigated by staff and perhaps had
not received permits to do the changes.
ACTION: Have Mrs. Ramirez present new plans, and for the item to come back to
the City Council for reconsideration.

the Citizens Advisory Commission since Bob Thomas had resigned.
ACTION: Council concurred that the subcommittees should look at the
applications already on file. Public Safety Subcommittee, Councilwomen Wright
and Brown; and the Advisory Commission Subcommittee, Councilwoman Brown and
Councilman Buquet.
H2. DISCUSSION OF APPOINTMENT TO THE SOIL EROSION AND DUST PREVENTION
