PROJECT AND SITE DESCRIPTION: A. Site CharacteristiCS: The "Haven Village" shopping center was originally approved by the Planning Commission in 1984. The majority of the center has been developed, the most recent building being the McDonald's fast food restaurant. The applicant is proposing to construct the day care facility on an existing building pad at the southeast comer of the site. The main access to the shopping center is obtained from the signalized intersection along Haven Avenue between the Unocal and McDonald's pads. A secondary drive aisle is located to the south of the proposed building. The drive aisle provides direct access to Highland Avenue and is used frequently by customers traveling between the shopping center and points east. The access will be eliminated upon construction of the freeway. Access to the site will then be obtained only from Haven Avenue. General: The applicant is proposing to construct an 8,166 square foot day care facility at the southeast comer of the "Haven Village" shopping center. The building will be flee-standing, running in a north-south direction along the building pad. The main entry to the building will be from the southwest comer of the building. The majority of the parking is proposed along the front (west side) of the building. The playground area is proposed at the rear of the building and is enclosed with a 6-foot vinyl clad chain link fence. The operation is anticipated to provide service for 160 children between the ages of 5 and 12. The facility will employ 18 people for teaching, supervision, administration, etc. The facility will be open from 6:00 a.m. until 6:30 p.m. Drop-offand pick-up procedures require parents to sign in and sign out their children. Also, vans are available to pick up children di~ctly fi'om school and uanspon them to the day care facility. Parents would then sign out the children at the end of the day. B. Design Review Committee: The Design Review Committee (Lumpp, McNiel, Bullet) reviewed the application on April 4, 1995 and recommended approval of the plans subject to the following: 1. The Committee felt the land use was appropriate for the location. 2. The site plan should be revised to relocate all the parking spaces from the west side of the building to the south side. The building should then be shifted to the west. 3. In shifting the building to the west, an additional 2-3 feet of landscaping should be provided along the west side of the building. PLANNING COMMISSION STAFF REPORT CUP 95-01 - KENT April 26, 1995 Page 3 4. Two or three dormers should be provided on the east and west elevations to break up the roof line. 5. The gable ends on the north and south elevations should be designed with a 6-12-inch overhang to provide a shadow line. 6. A trellis/heavy beam element should be provided at the northwest comer of the building pad to visually tie the existing structure to the new facility. 7. Traffic control measures should be provided along the main north-south drive aisle to reduce vehicle speeds. 8. The screen wall on the west elevation should receive rock veneer. 9. A 7-foot tubular steel fence should be provided around the facility to provide greater security. C. Technical Review Committee: The main concem of the Technical Review Committee centered around public safety. The Committee recommended that the following conditions be placed on the application: 1. Lighting should be provided, as needed, to ensure a minimum 1-foot candle illumination within the parking area. 2. The rclocation of the parking stalls to the south side of the building would minimize conflicts between the day care users and others accessing the site from the Highland Avenue drive aisle. 3. The building exit system should comply with the State Fire Marshal's office requirement for safe dispersal per the 1991 Uniform Building Code. 4. The applicant should be directed to review requirements mandated in Assembly Bill 3205 which could prohibit public or private schools within 1,000 feet of a baTardons materials user or generator (the gas station) unless a risk management and prevention plan is in place. The plan would establish emergency response procedures to a release or threatened release of baTardous materials. If a plan is not currently in place for the gas station, one may be required by San Bemardino County Department of Environmental Health prior to occupancy of the structure by Kindercare. The school is approximately 250 feet away from the Unocal gas station. 5. A 2-foot wide by 2-foot high shrub hedge should be provided around the perimeter of the play area, The shrub placement is intended to discourage outsiders from jumping over the fence. Environmental Assessment: In completing the Environmental Assessment, staff identified noise as a potential impact to the project because of the proximity to the proposed freeway. An acoustical analysis was prepared to determine potential impacts to the site. The acoustical analysis examined both an elevated and depressed freeway profile. The analyses indicate that the elevated freeway design will allow the higher noise levels to enter the site. Because the elevated freeway will still be 11 feet below the building pad, the noise levels are within the parameters outlined by the City. The 65 CNEL contour projects into the site at the southeast comer but does not extend m the building pad. As a result, no additional mitigation is required to meet the noise standards. Therefore, staff recommends approval of aNegative Declaration for the project. ~: Staff recommends that the Planning Commission approve Conditional Use Permit 95-01 through adoption of the attached Resolution. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF 'RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 95-01, A REQUEST TO CONSTRUCT AN 8,166 SQUARE FOOT DAY CARE FACILITY WITHIN AN EXISTING SHOPPING CENTER IN THE NEIGHBORHOOD COMMERCIAL DESIGNATION, LOCATED ON THE EAST SIDE OF HAVEN AVENUE, NORTH OF HIGHLAND AVENUE AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 201-271-92. A. ~. 1. Jamas Kent has filed an application for the issuance of Conditional Use Permit No. 95-01, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 26th day of April 1995, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. Bo ~. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on April 26, 1995, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: a. The application applies to property located within an existing shopping center on the east side of Haven Avenue, north of Highland Avenue with a street frontage of 29.11 feet and lot depth of 446.52 feet and is presently improved with a parking lot and building pad; and b. The properties to the north and west of the subject site are zoned for commercial uses and are developed with retail buildings and a gas station. The property to the south is designated as a future freeway and is vacant. The property to the east is designated for multi-family residential use and is developed with an apartment complex; and c. The day care facility is consistent with the Neighborhood Commercial designations of the Development Code and the General Plan; and d. The application, with the attached conditions of approval, will comply will all applicable requirements of the Development Code. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs I and 2 above, this Commission hereby finds and concludes as PLANNING COMMISSION Pa~SOLUTION NO. That the proposed use is in accord with the General Plan, the objectives of the Develol~nent Code, and the purposes of the district in which the site is located. b. That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. c. That the proposed use complies with each of the applicable provisions of the Development Code. 4. Based upon the facts and information contained in the proposed Negative Declaration, together with all written and oral reports included for the environmental assessment for the application, the Planning Com~ission finds that there is no substantial evidence that the project will have a significant effect upon the environment and adopts a Negative Declaration based upon the findings as follows: a. That the Negative Declaration has been prepared in compliance with the California Environmental Quality Act of 1970, as amended, and the State CEQA ~uidelines prnmulgated thereunderS that said Negative Declaration and the Initial Study prepared therefore reflect the independent judgment of the Planning Commissions and, further, this Commission has reviewed and considered the information contained in said Negative Declaration with regard to the application. b. That, based upon the changes and alterations which have been incorporated into the proposed project, no significant adverse environmental effects will occur. c. Pursuant to the provisions of Section 753.5(c) of Title 14 of the california code of Regulations, the Planning Commission finds as follows: In considering the record as a whole, the Initial Study and Negative Declaration for the project, there is no evidence that the proposed project will have potential for an adverse impact upon wildlife resources or the habitat upon which wildlife depends. Further, based upon substantial evidence contained in the Negative Declaration, the staff reports and exhibits, and the information provided to the Planning commission during the public hearing, the Planning Commission hereby rebuts the presumption of adverse effect as set forth in Section 753.5(c-l-d) of Title 14 of the california Code of Regulations. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Co~nission hereby approves the application subject to each and eveE7 condition set forth below and in the Standard conditions, attached hereto and incorporated herein by this reference. 1) The site plan shall be revised to relocate all the parking spaces from the west side of the building to the south side. The shrub placenent is intended to discourage outsiders from Jumping over the fence. The final plans shall be reviewed and approved by the city Planner prior to building permit issuance. Enulneerin~ Division 1} An in-lieu fee as contribution to the future undergrounding Of the existing overhead utilities (telecommunication and electrical) on the project side of Haven Avenue shall be paid to the city prior to the issuance of building permits. The fee shall be one-half the City adopted unit amount times the length from the center of the Route 30 Freeway right-of-way to the northernmost pole north of Highland Avenue (~ 200 feet). CUP 95-01 - KENT April 26, 1995 Page 4 2) The developer shall enter into an agreement and provide security for one-half the cost of the future undergrounding of the existing overhead utilities (telecommunication and electrical) on the project side of Highland Avenue, based on the length from the center of Haven Avenue to the east project boundary, until such time as it can be determined that caltrans will underground those lines at their own expense with the construction of the Route 30 Freeway. 3) Install additional street improvements on the east side of Haven Avenue, from the project's south boundary to Highland Avenue (Phase II of Conditional Use Permit No. 88-18), as shown on Sheet 2A of Drawing No. 1463. 4) A non-refundable deposit shall be paid to the City covering the estimated cost of operating all new street lights, during the first six months Of operation, prior to building permit issuance. 5} A signed consent and waiver form to Join and/or form the appropriate Landscape and Lighting Districts shall be filed with the City Engineer prior to building permit issuance. Buildina & Safety Divlsio~ 1} The building exit system shall comply with the State Fire Marshal's office requirement for safe dispersal per the 1991 Uniform Building Code. 2) The applicant shall review requirements mandated in Assembly Bill 3205 which could prohibit public or private schools within 1,000 feet of a hazardous materials user or generator (i.e., the gas station) unless a risk management and prevention plan is in place. Emphasis shall be placed on after-hours security measures. The final plan shall be reviewed and approved by the Police Department and city Planner prior to building permit issuance. All building numbers and individual units shall be identified in a clear and concise manner, J / including proper illumination. 13. Developer shall upgrade and construct all trails, including fencing and drainage devices, in conjunction with street improvements. 14. The Covenants, Conditions and Restrictions (CC&Rs) shall not prohibit the keeping of equine .__J / animals where zoning requirements forthe keeping of said animals have been met. Individual lot owners in subdivisions shall have the option of keeping said animals without the necessity of appealing to boards of directors or homeowners' associations for amendments to the CC&Rs. 15. The Covenants. Conditions, and Restrictions (CC&Rs) and Arlicles of Incorporation of the __/ / Homeowners' Association are subject to the approval of the Planning and Engineering Divisions and the City Atlomey. They shell be recorded concurrently with the Final Map or prior to the issuance of building permits, whichever occurs first. A recorded copy shall be provided to the City Engineer. 16. All perkways. open areas, and landscaping shall be permanently maintained by the propere/ .__./ / owner, homeowners' association, or other means acceptable to the City. Proof of this landscape maintenance shall be s4jbmitted for City Planner and City Engineer review and approval prior to issuance of building permits. 17. Solar access easements shall be dedicated for the purpose of assuming that each lot or .__/ / dwelling unit shall have the right to receive sunlight across adjacent lots or units for use of a solar energy system. The easements may be contained in a Declaration of Restrictions for !he subdivision which shall be recorded concurrently with the recordalidn of the final map or sssuance of permits, whichever comes first. The easements shall prohibit the casting of shadows by vegetation, structures, fixtures or any other object, except for utility wires and similar objects, pursuant to Development Code Section 17.08.060-G-2. 18. The project contains a designated Historical Landmark. The site shall be developed and .__/ / maintained in accordance with the HiStoriC Landmark Alteration Permit No. · Any further modifications to the site including, but not limited to. exte dor alterations and/or interior alterations which affect the extedorof the buildings or Structures, removal of landmark trees, demolition, relocation, reconstruction of buildings or structures, or changes to the site, shall require a modification to the Historic Landmark Aiferalidn Permit subject to Historic Preservation Commission review and approval. C. Building Design 1. Desitm Review Committee: The Committee (McNiel, Lumpp, Coleman) reviewed the project on March 14, 1995. The Committee did not recommend approval because the design did not meet the design criteria established in Term Vista Town Center. On April 4, 1995, the Committee (McNiel, Lumpp, Bullet) reviewed the revised plans and a perspective rendering submitted at the meeting. The Committee recommended several changes to the design and directed the applicant to submit the revised plans for their review at their April 18, 1995, Design Review Committee meeting under the Consent Calendar section. In September of 1992, the Planning Commission approved a 5,000 square foot retail building for this pad, however, the approval has lapse& The applicant is proposing to build a 3,000 plus square foot restaurant on Pad N. Attached to this report are copies of the approved site plan and elevations for comparison. Staff Comments: The following comments are intended to provide an outline for Committee discussion. Major Issues: The following broad design issues will be the focus of Committee discussion regarding this project: 1. Since the main building entry is oriented toward Foothill Boulevard, the applicant proposes a walkway connection from the building to the westerly parking area. Enhance this pedestrian connection so that there is a stronger relation between the building and the parking area. 2. Move the outdoor seating area closer to the south side of the building so that it relates to the building enm] and the indoor seating, and is more visible from inside for safety and service. 3. Elevations. When compared to the original submittal, the plans have been revised to show more consistency in the design elements of Terra Vista Town Center. However, the overall building design still lacks the level of sophistication and detailing when compared to the rest of the center or the previously approved plans. Because the building (Pad ND is at the comer of Spruce Avenue and Foothill Boulevard and this comer is designated as a Type III gateway to the Tetra Vista community, the building design should have superior architectural treatment to all sides. Examples of design elements used elsewhere in the center are attached. a. The building entry that faces Foothill Boulevard is plain and appears less important than the other tower. The tower could be increased in height and pulled out further to provide a s~onger statement and articulation. More embellishments to the tower could be added to provide more interest. DRC COMMENTS DR 94-22 - BOSTON MARKET March 14 & April 4, 1995 Page 2 b. The taller tower with architectural treatment is located at the northeast comer of the building behind a trash enclosure. This tower element could be placed at a side of the building that has more visibility. This does not mean that the northeast side of the building should not be architecturally treated. c. Add articulation to the building plane of the east and west elevations, i.e., "recess and pop-out," variation in vertical height, etc. An example is a colonnade with roof overhang. Also, see attached examples of existing or approved design treatments. .~: Once all of the major issues have been addressed, and time permitting, the Committee will discuss the following secondary design issues: 1. Incorporate the trash enclosure as part of the building, similar to Chili's Restaurant, which minimizes the enclosure. 2. The pattern of the storefront windows is inconsistent with the approved ones in the center. 3. Eliminate the proposed light fixtures on the hip roof, because the center does not have this treatment. External light rixtures are allowed on columns of towers or colonnades consistent with the ones in the center. Sconce and gooseneck style light fixtures similar to the ones on Chili's restaurant are allowed on building face. 4. Wrap the tile wainscot all around the building. 5. Provide a continuous walkway (4 feet minimum) along the parking spaces at the north and west side of the building. Note that some of the proposed sidewalk connections "dead-ends" into columns. Policy Issues: The following items are a matter of Planning Commission policy and should be incorporated into the project design without discussion: 1. Awnings should be of solid colors and not internally illuminated. External lighting is allowed, e.g., gooseneck style light fixture. In the past, the Commission has discouraged the use of multi-colored striped awnings. Commission required Chili's restaurant to use solid color. This CIP is a listing of all types of public works' projects and does not consider actual or projected annual revenue streams for the funding sottrees. One consequence of the reduction of development within the City is a corresponding decline for development fees which the City takes in. Transportation, General City Drainage and Etiwanda Drainage Fees have in the past been used to fund Engineefing's capital projects. These fees have declined to a fraction of what was being received during the mid '80's. However, to help offset this reduction is an increase in gas tax revenues resulting from the passage of State Proposition 111. A second reduction to the City's capital funding sources is to the City's Transportation Development Act (TDA) Article 8 allocation. This fund has primarily been used to fund new signal installation. Over the past few years it has been cut significantly due to the Omnitrans/Cities funding agreement. This agreement allows Omnitraus to appropriate TDA Article 8 money as needed with the remainder being allocated to the Cities. Omnitrans has been replacing older buses in addition to purchasing new buses to accommodate its expansion policies. Therefore, we do not anticipate any revenue from this source this year or subsequent years.
