A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA SUMMARILY ORDERING THE
VACATION OF EXCESS RIGHTS-OF-WAY INCLUDING A 10 -
FOOT WIDTH ON THE EAST SIDE OF CENTER AVENUE
BETWEEN 24TH STREET AND HUMBOLDT AVENUE, (V-233) -
AP N 209-123-05
WHEREAS, by Chapter 4, Article 1, Section 8334, of the Streets and Highway Code, the
City Council of the City of Rancho Cucamonga is authorized to summarily vacate those portions
of the City Streets hereinafter more particularly described; and
WHEREAS, the City of Rancho Cucamonga Planning Commission on September 21,
2016) by minute action found and determined that the summary vacation of the subject rights-of-
way herein contemplated conform t0 the City's General Plan; and
WHEREAS, the City Council found all the evidence submitted that the subject rights-of-
way located on the east side of Center Avenue between 24th Street and Humboldt Avenue, are
unnecessary for present or prospective public street purposes
NOW, THEREFORE BE IT RESOLVED, the City Council of Rancho Cucamonga hereby
resolves as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga hereby makes its
order vacating the excess street rights-of-way, as shown on map V-233, on file in the office of the
City Clerk of the City of Rancho Cucamonga, which have been further described in the legal
description which is attached hereto, marked Exhibit "A" and shown on Exhibit "B" and by
reference made a part thereof.
SECTION 2: That the subject vacation shall be subject to the reservations and
exceptions, if any, for existing utilities on record.
SECTION 3: That from and after the date the resolution is recorded, said excess street
rights-of-way no longer, constitute a street or public easement.
SECTION 4: That the City Clerk shall cause a certified copy of this resolution to be
recorded in the office of the County Recorder of San Bernardino County, California.
SECTION 5: That the City Clerk shall certify t0 the passage and adoption of this
resolution, and it shall thereupon take effect and be in force.

State of California, as per North Cucamonga Map filed in Book 4, Page 8, of Maps, in the office
of the County Recorder of said County, described as follows -

Beginning at the southwest corner of Lot 5 of Block 63 of said North Cucamonga Map;
Thence along the westerly prolongation of the south line of said lot, North 89" 50' 00" West
10.00 feet to, a point on a line parallel with and 10.00 feet west from the west line of said lot;
Thence northerly along said parallel line, North .0° 12' 00" West 25,00 feet to a point on the
westerly prolongation of the north line of said lot;
Thence easterly along said prolongation line, South 890 50' 00/) East 10.00 feet to the north
west corner of said lot;
