HomeMy WebLinkAbout18-47 - Resolution - Approval of Tree Removal Permit for 58 Trees RESOLUTION NO.18-47 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING TREE REMOVAL PERMIT DRC2018-00460, A REQUEST TO REMOVE 58 TREES FROM AN EXISTING VACANT SITE TOTALING 1.21 ACRES OF LAND RELATED TO THE PROPOSED DEVELOPMENT OF A 10,763-SQUARE FOOT CHILD CARE FACILITY WITH OUTDOOR PLAY AREAS, LOCATED IN THE VILLAGE COMMERCIAL (VC) DISTRICT, VICTORIA PLANNED COMMUNITY, AT THE SOUTHWEST CORNER OF ATWOOD STREET AND VICTORIA PARK LANE; APN: 1089-581-09. A. Recitals. 1. The applicant, Kiddie Academy, filed an application for Tree Removal Permit DRC2018-00460, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tree Removal Permit is referred to as "the application." 2. On July 25, 2018, the Planning Commission of the City of Rancho Cucamonga conducted a noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to the Planning Commission during the above-referenced public hearing on July 25, 2018, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: a. The application applies to property located within the City; and b. The application applies to approximately 1.21 acres of land located south of Atwood Street and west of Victoria Park Lane and is currently designated Village Commercial (VC) of the Victoria Planned Community; and c. The property to the south contains a shopping center and is located in the Village Commercial (VC) District, and the property to the west contains an apartment complex located in the Village Commercial (VC) District, and the property to the north contains a condominium complex located in the Medium-High (MH) Residential District, and the property to the east contains single-family homes and an undeveloped lot located in the Low-Medium (LM) Residential District; and d. The proposed onsite improvements consist of a 10,763-square foot child care facility and accompanying outdoor play and entertainment areas. The project will also make PLANNING COMMISSION RESOLUTION NO.18-47 TREE REMOVAL PERMIT DRC2018-00460 - CITY OF RANCHO CUCAMONGA July 25, 2018 Page 2 modifications to an existing 70-stall parking lot to improve circulation and to allow it to achieve compliance with ADA requirements; and e. The proposed removal of 58 trees is to accommodate development onsite, including upgrading of the parking lot to be in compliance with ADA requirements. A total of 33 trees will be planted to meet the required parking lot and site tree requirements. Overall, the site will have 25 fewer trees than existing. f. The proposed project meets or exceeds all Development Code standards. The site also meets all applicable Village Commercial (VC) standards for commercial development as established per the Victoria Community Plan. 3. Based upon the substantial evidence presented to this Commission during the above referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, and the findings outlined from Section 17.16.080, this Commission hereby finds and concludes as follows: a. For a development project, every effort has been made to incorporate the tree(s) into the design of the project and the only appropriate alternative is the removal of the tree. The proposed development will retain 30 trees onsite, including a eucalyptus windrow consisting of 15 trees along the north property line. Per the Arborist Report, removal of the remaining 58 trees is necessary to accommodate development and to configure the site to meet ADA standards. b. For requests not associated with a development project, the tree presents a threat to public health and safety and must be removed. The trees are currently associated with a Design Review application (Design Review DRC2017-00889), and the trees are not currently a threat to public health and/or safety. However, the Tree Removal Permit request is part of the proposed development of the site, which includes a Design Review application (DRC2017-00889) and a Conditional Use Permit application (DRC2017-00890). Per the Arborist Report, removal of the remaining 58 trees is necessary to accommodate development and to configure the site to meet ADA standards. c. The removal of the trees will not have a negative impact on the health, safety, or viability of surrounding trees, nor will it negatively impact the aesthetics or general welfare of the surrounding area. An Arborist Report prepared for the site determined that none of the trees were ecologically dependent on one another. The proposed project will also retain 30 trees onsite, including a eucalyptus windrow consisting of 15 trees along the north property line. An additional 33 trees will be planted to meet the required parking lot and site tree requirements. The combination of existing and proposed trees will maintain adequate landscaping onsite. The additional trees will mitigate any potential impacts that may occur with the proposed Tree Removal Permit request and preserve the aesthetics and general welfare of the surrounding area. 4. The project is exempt from the requirements of the California Environmental Quality Act(CEQA) and the City's CEQA Guidelines. The project qualifies as a Class 32 exemption under State CEQA Guidelines Section 15332, which covers in-fill development. The proposed Design Review is for a 10,763-square foot child care facility on a project site of no more than 5 acres and substantially surrounded by urban uses. A Biological Habitat Assessment Report (Golden State Land & Tree Assessment, March 2018) concluded that the project site has no value as a habitat for endangered, rare or threatened species. An Air Quality and Greenhouse Gas Study(Birdseye PLANNING COMMISSION RESOLUTION NO.18-47 TREE REMOVAL PERMIT DRC2018-00460 - CITY OF RANCHO CUCAMONGA July 25, 2018 Page 3 Planning Group, February 2018) concluded that the project would not exceed the applicable Southern California Air Quality Management District's threshold for air quality and greenhouse gas emissions during construction or operational activity. A Trip Generation Memorandum (Mizuta Traffic Consulting, December 201*7) forecasted that traffic volumes will result in lower traffic volumes than projections based on standard ITE trip generation rates. City Engineering staff reviewed the memorandum and concluded that the project would likely not significantly impact nearby intersections and roadways. An Acoustical Evaluation (Noise Engineers, April 2018) concluded that the project's noise contribution to adjacent roadways would be less than significant and that the on-site operation noises levels will not exceed 65 dBA during the hours of 10:00 p.m. to 7:00 a.m. and 70 dBA during the hours of 7:00 a.m. to 10:00 p.m. when measured at the adjacent property line. A Conceptual Water Quality Management Plan was submitted and reviewed by the City's grading engineer. The City's grading engineer approved the conceptual design and will review the final design when grading plans are submitted. Therefore, it can be seen that the proposed facility will have no potential for resulting in significant effect or physical change to the environment. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth in the Conditions of Approval, attached hereto and incorporated herein by this reference. 6. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 25TH DAY OF JULY 2018.
