HomeMy WebLinkAbout2011/06/08 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting June 8, 2011 Chairman Munoz called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:06 p.m. The meeting was held in the Council Chambers at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. ROLL CALL COMMISSIONERS: PRESENT: Richard Fletcher, Frances Howdyshell, Lou Munoz, Francisco Oaxaca, Ray Wimberly ABSENT: None STAFF PRESENT: Steven Flower, Assistant City Attorney; Steve Fowler, Assistant Planner; Larry Henderson, Principal Planner; Dan James, Senior Civil Engineer; Lois Schrader, Planning Commission Secretary; James Troyer, Planning Director; Tabe Van der Zwaag, Associate Planner ANNOUNCEMENTS APPROVAL OF MINUTES Motion: Moved by Howdyshell, seconded by Fletcher, carried 5-0, to approve the minutes of May 25, 2011. CONSENT CALENDAR A. REQUEST TO QUITCLAIM ALL RIGHTS OF VEHICULAR ACCESS TO AND EGRESS FROM THE SOUTHERLY LINE OF LOT 1 OF TRACT 18710 ABUTTING CHURCH STREET, LOCATED EAST OF MILLIKEN AVENUE, SUBMITTED BY HOMECOMING I AT TERRA VISTA, LLC (APN 227-532-16) Motion: Moved by Oaxaca, seconded by Wimberly,to adopt the Consent Calendar as presented by minute action. The Motion carried by the following vote: AYES: FLETCHER, HOWDYSHELL, MUNOZ, OAXACA, WIMBERLY NOES: NONE ABSENT: NONE - carried PUBLIC HEARINGS B. DEVELOPMENT AND DESIGN REVIEW DRC2011-00028-K. HOVNANIAN COMMUNITIES INC. - Architectural and site review for 63 single-family residences on 45.23 acres within the Very Low Residential District(1-2 dwelling units per acre) of the Etiwanda Specific Plan (ESP), located on south side of Banyan Street, approximately 1,220 feet east of East Avenue-APNs: 225-191-12 and 0226-102-02. Related File - Tentative Tract Map SUBTT17651 AND SUBTT18708. On August 9, 2006, a Mitigated Negative Declaration of environmental impacts was adopted by the Planning Commission for Tentative Tract Map SUBTT17651 and on April 15, 2010 for Tentative Tract Map SUBTT18708. The California Environmental Quality Act provides that no further environmental review or Negative Declaration is required for subsequent projects or minor revisions to projects within the scope of the previous Mitigated Negative Declaration. Tabe van der Zwaag, Associate Planner, presented the staff report. • Vice Chairman Howdyshell asked if Banyan Street is currently only two lanes and what the future plans are for that street. Dan James, Senior Engineer confirmed that Banyan Street is a Collector Street but because of the rural character of the area it is reduced to 36 feet curb to curb and therefore is a narrow street. He said they plan to install a signal with a left turn pocket into this subdivision at their westerly access off Banyan Street. Vice Chairman Howdyshell asked what would happen regarding the lanes on Banyan Street. She commented on the heavy traffic because of homes, a school and a park in the immediate area. Mr. James said Engineering is currently reviewing designs for some improvements on Wardman Bullock/Wilson Avenue. Chairman Munoz invited the applicant to speak. Chris Courtney of K. Hovnanian Homes, 2525 Campus Drive, Irvine, said he believes the DRC is very satisfied with their product, and he is confident in their project development and that it should be an enhancement to the area. Commissioner Fletcher said it is highly unusual to see all single-story plans in one development. He asked if it is because of changes in the market. He asked Mr. Courtney to comment. Mr. Courtney said they wanted their development to be unique and many of their developments are two-story product. He said they wanted to take advantage of the 'A acre lots and maximize the living space along with providing great yards. He said it is good for the community to provide this product and Rancho Cucamonga has mentioned their desire for single-story product because of the aging demographic of the community. • Vice Chairman Howdyshell said she is familiar with their desert communities and she is pleased to see this project with larger single-story homes. She commented on the largest floor plan (4049) shown on Page B-28 of the agenda packet and noted that if the home buyer opts for the casita then there would be 3 bedrooms remaining and if the 4-car option is worked in as well then it would have only 2 bedrooms remaining. She wondered if that had been thought out. Mr. Courtney said it would be extremely unlikely that could happen; perhaps only with a very small family or empty nesters. Planning Commission Minutes -2- June 8, 2011 • Vice Chairman Howdyshell noted that some have elderly parents living with them. She said she referred to the City's 2od dwelling unit guidelines. She asked if the homebuyer could add a separate free-standing casita dwelling after the fact. Mr. Courtney said there could be some set back issues because of the corral requirements. He said it may not be feasible and it did not seem likely that K. Hovnanian would be able to offer them that option. James Troyer, Planning Director said staff could explore the feasibility of a free-standing casita or granny flat if the homebuyer brought a plan/proposal to staff. Chairman Munoz closed the public hearing. Vice Chairman Howdyshell said she is excited that the homes are single-story with an open concept. She said she is looking forward to seeing a successful project. • Commissioner Oaxaca said he is impressed that the product is all single-story and that the applicants worked with the DRC to bring this positive development to the community. Commissioner Wimberly said it was a pleasure to work with the applicants and that the applicants were willing to work with us and staff to bring this forward. He said the single-story product should be a boon to that area. "Fantastic"! Commissioner Fletcher saidhe likes the design and especially because it is single-story product and will be different from anything in the City. He said the large size of the single-story homes will be unique and will provide a good product choice for homebuyers. He said they have good design and elevations. Chairman Munoz said he concurs with all the previous comments. He said he also worked with the applicants at DRC and they worked hard, met several times, and we got a great project at the end of the day. He remarked that he would say to all developers, "this is a good direction to follow". He noted that it has been a long time since we have seen this many single-story homes available in town and he appreciates their work. Motion: Moved by Howdyshell, seconded by Fletcher, to adopt the Resolution Approving Development and Design Review DRC2011-00028. Motion carried by the following vote: AYES: FLETCHER, HOWDYSHELL, MUNOZ, OAXACA, WIMBERLY NOES: NONE ABSENT: NONE - carried C. TIME EXTENSION FOR TENTATIVE TRACT MAP SUBTT14749 - TRAIGH PACIFIC — A request for a time extension for a previously approved tentative tract map to subdivide 168.77 acres into 269 residential lots and a remainder parcel in the Low (L) Residential District (2-4 dwelling units per acre)and Flood Control (FC)within the Etiwanda North Specific Plan, located north of the SCE Corridor between Etiwanda Avenue and East Avenue. APN: 0225-083-05, 06, 07, 10, 22, 23, 25, and 26, and 0225-084-02. Related Files: Annexation DRC2003-01051, DRC2003-00409, DRC2003-00410, and DRC2003-00411. Staff has found the project to be within the scope of the project covered by a prior Environmental Impact Report certified by the City Council on July 21, 2004 (State Clearing House#2003081085) by Resolution 04-240 and does not raise or create new environmental impacts not already considered in the Environmental Impact Report. Planning Commission Minutes -3- June 8, 2011 • Tabe van der Zwaag, Associate Planner, presented the staff report. Commissioner Fletcher clarified that this is first 1 year extension. Mr. van der Zwaag confirmed that if this extension is approved the applicant can get 4 more 1 year extensions (for a total of 5). Craig Page, 200 Opal Avenue, Newport Beach, said he represents Traigh Pacific. • Chairman Munoz opened the public hearing and seeing and hearing none, closed the public hearing. Vice Chairman Howdyshell said it is a straightforward request. Commissioner Oaxaca had no further comment. Commissioner Wimberly had no further comment. Commissioner Fletcher said there is not much to discuss; it was a previously approved map with a request for an extension. He said he is in favor. Motion: Moved by Wimberly, seconded by Oaxaca, to adopt the Resolution of Approval for Time Extension SUBTT14749. Motion carried by the following vote: AYES: FLETCHER, HOWDYSHELL, MUNOZ, OAXACA, WIMBERLY NOES: NONE ABSENT: NONE - carried D. DESIGN REVIEW DRC2010-01006 - NEAL T. BAKERS ENTERPRISES - A request to construct a 2,361 square foot drive-thru restaurant on a .46 acre pad within the Victoria Commons Retail Center within the General Commercial District at 12009 Foothill Boulevard APN: 0229-023-04. On January 24, 2007 a Mitigated Negative Declaration was adopted by the Planning Commission for Tentative Parcel Map SUBTPM17818. The California Environmental Quality Act provides that no further environmental review or Negative Declaration is required for subsequent projects or minor revisions to projects within the scope of a previous Mitigated Negative Declaration. Steve Fowler, Assistant Planner, presented the staff report. Vice Chairman Howdyshell complimented the applicants for using composite trellis material because she has observed that the wood ones deteriorate and become and eyesore. She said she is • pleased to see that the applicant was willing to consider that. Steve Murray, Architect, 370 West 6th Street, San Bernardino, stated he appreciated the time staff spent considering the project and the elevations. He said they think the building will fit well in the community. He said the only remaining issue is the trellis material and they are waiting for samples that will look the best. He said the applicants request is to determine the choice/use of the material with staff. Commissioner Fletcher asked if this is part of the Bakers franchise. Mr. Murray said it is. Planning Commission Minutes -4- June 8, 2011 • Chairman Munoz opened the public hearing and seeing and hearing none, closed the public hearing. Commissioner Fletcher stated that the design is an upgrade to some other Bakers restaurants. Commissioner Wimberly agreed and noted that the design/architectural elements incorporated are an upgrade. He said it was a pleasure to work with the applicant. Commissioner Oaxaca said he has the same feeling and he thanked the architect for bringing a nice acceptable design. Vice Chairman Howdyshell said ditto and that the design is beautiful. She said anything to elevate what fast food restaurants generally look like is appreciated. • Chairman Munoz offered kudos to staff and noted that Steve Fowler did a lot of Work with the applicant and said it was ready to go by the time it got to the DRC. He said this is high quality and staff did fine work. He said he believed this would be a fine addition to the community and he • wished the applicant good luck. Motion: Moved by Fletcher, seconded by Howdyshell, to adopt the Resolution of Approval for Design Review DRC2010-01006. Motion carried by the following vote: AYES: FLETCHER, HOWDYSHELL, MUNOZ, OAXACA, WIMBERLY NOES: NONE ABSENT: NONE - carried E: ENTERTAINMENT PERMIT DRC2011-00158 - CHARLES JOSEPH ASSOCIATES - RA POUR - A request for entertainment in conjunction with a restaurant/bar to be located in an existing building at 7900 Kew Avenue within the Victoria Gardens Lifestyle Center-APN;0227- 464-15. Related File: Non-Construction Conditional Use Permit DRC2011-00157 and Minor Development Review DRC2011-00182. Larry Henderson, Principal Planner, presented the staff report. He reported that a Conditional Use Permit and a Minor Development Review were also applied for and approved at the Planning Director meeting yesterday. He noted a correction Page E-1 of the agenda packet. He said the business is located "to the east across Kew Avenue" and not to the west as noted in the report. He said the provided entertainment is for those dining there. He said several conditions are put in place for this type of business. Suzanne Buquet for Charles Joseph Associates, 10681 Foothill Blvd Suite 395, thanked staff and commented that this is a distinctive supper club with a special VIP lounge and Sunday brunch with jazz. She said this is the only family owned restaurant at Victoria Gardens. She said they are in concurrence with all the conditions and security measures. Kareem Webb, 505 Los Angeles said his family owns and operates 14 McDonalds restaurants. He said he and his siblings have been in the family restaurant business since birth. He noted that his parents are active in the community and that they also area a franchisee of Buffalo Wild Wings. He said they have some experience with responsible alcohol service and table service. He said they are from this community and wanted to offer something a little different. He said it has a 'W-style' in Planning Commission Minutes -5- June 8, 2011 decor and vibe. He said they are bringing in chefs and they will offer small plates/fine dining. He said the live ambient music will be interesting but non-threatening music similar to that heard in similar restaurants found in South Orange County and Las Vegas. Commissioner Fletcher said Mr. Webb did an excellent job of his presentation. He asked if there is a meaning to the name 'RaPour'. Mr. Webb said they started with the name'Generations' as it would be a business for their children, grandchildren, etc. but could not get it trademarked. He said the name RaPour is play on words. Commissioner Wimberly asked if they provided any samples of the music to staff. Mr. Webb said they will have a CD ready on Friday but in the meantime staff could go on I-tunes on the ambient radio tab to get an idea of the music genre they are suggesting to use. Vice Chairman Howdyshell complimented the menu and said unlike many other restaurants there are lots of choices. She said she is looking forward to the grand opening. Chairman Munoz opened the public hearing and seeing none, Chairman Munoz closed the public hearing. Vice Chairman Howdyshell said she is excited to know that businesses want to invest in this community. She said this applicant has been creative in seeking this niche and it will be right here in Rancho Cucamonga. Commissioner Oaxaca said he was intrigued by the concept and said this is a market not yet served and he is pleased to see this. He noted that when he saw the name Reginald Webb on the report he recalled that he is familiar with Mr. Webb's father's reputation as a businessman and as a professional. He said that convinced him that this probably is going to work. He said he looks forward to seeing this business and he is in favor of the request. Commissioner Wimberly concurred and said he looks forward to seeing the product they bring forward and it should have an opportunity to stand out on its own. Commissioner Fletcher agreed and said he looks forward to this new concept. He said it should be a niche that fits well in Rancho Cucamonga;the upscale dining and entertainment with eating is nice to offer and this may appeal to a different age group and hopefully should be a nice place for'us old guys and gals'. Chairman Munoz said ditto to all and that our community is ready for this. He said he appreciates the applicant's investment in our community, it should be a good fit in Victoria Gardens and he thanked them for all that they are doing. James Troyer, Planning Director, assured that staff would review the CD of the music to be offered. Motion: Moved by Oaxaca, seconded by Wimberly, to adopt the Resolution of Approval for Entertainment Permit DRC2011-00158. Motion carried by the following vote: AYES: FLETCHER, HOWDYSHELL, MUNOZ, OAXACA, WIMBERLY NOES: NONE ABSENT: NONE - carried Planning Commission Minutes -6- June 8, 2011 PUBLIC COMMENTS None COMMISSION BUSINESS AND COMMENTS Vice Chairman Howdyshell thanked staff for all the hard work on the items presented tonight. Commissioner Fletcher said he heard a presentation by Steve Jobs of Apple Inc. that was made in the City of Cupertino regarding "cloud technology". James Troyer, Planning Director,thanked the Commission for initiating the Single-Story Ordinance and he noted that the City Council approved it unanimously. He said this is a great thing that will benefit the City for years to come. ADJOURNMENT - Motion: Moved by Fletcher, seconded by Wimberly, carried,to adjourn.
