HomeMy WebLinkAbout2005/07/27 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting July 27, 2005 Chairman Macias called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was held in the Council Chambers at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman Macias then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: Richard Fletcher, Rich Macias, Cristine McPhail, , ABSENT: Larry McNiel; Pam Stewart STAFF PRESENT: Brad Buller, City Planner; Emily Cameron,Associate Planner,Dan Coleman, Principal Planner; Kevin Ennis, Assistant City Attorney; Douglas Fenn, Associate Planner; Donald Granger,Associate Planner; Dan James,Senior Civil Engineer; Lois Schrader, Planning Commission Secretary ANNOUNCEMENTS Brad Buller,City Planner,announced that Lois Schrader, Planning Department Secretary,has been promoted to Planning Commission Secretary and would be taking the place of Gail Sanchez who recently retired. Mr. Buller also suggested that item B be heard with C, D, and I,and that Item H be heard in conjunction with Item J. It was noted that Commissioner McNiel arrived at 7:10 p.m. . APPROVAL OF MINUTES Motion: Moved by Fletcher, seconded by McNiel, carried 4-0-1,(Stewart absent) to approve the Joint City Council/Planning Commission Workshop minutes of June 8, 2005. Motion: Moved by McPhail,seconded by McNiel,carried 3-0-1-1 (Stewart absent, Macias abstain), to approve the minutes of June 22, 2005. CONSENT CALENDAR A. DESIGN REVIEW DRC2004-00928-KB HOME-The review of site plan and elevations for 64 single-family detached residences on 28.7 acres of land in recorded Tract 15982, in the Low Density Residential (2-4 dwelling units per acre, located at the northeast corner of Day Creek Boulevard and Wilson Avenue-APN: 0225-071-69. Related File: Tract 15982.This project is based on the Environmental Impact Report (EIR) previously certified by the County of San Bernardino Board of Supervisors in 1991 and the Supplemental EIR(SEIR)previously certified by the City of Rancho Cucamonga in 2001. This project is within the scope of these prior environmental documents and does not raise or create new environmental impacts not already considered in the Certified EIR and SEIR. Commissioner McPhail recused herself because the company that employs her received remuneration for services performed on the project. VARIANCE DRC2005-00321 - HILLSIDE COMMUNITY CHURCH -A request to allow a building height of 45 feet where a maximum building height of 30 feet is allowed for the development of a 76,019 square foot worship center on 8.86 acres of land in the Very Low Residential District (.1-2 dwelling units per acre), located at the southwest comer of Haven Avenue and Vista Grove Street -APN: 1074-271-01. Donald Granger,Associate Planner, presented the staff report noting that one letter of support was received. Commissioner McNiel complimented Mr. Granger for his thorough review of the project and for his excellent report. Chairman Macias opened the public hearing. Larry Wolfe, W LC Architects, 10470 Foothill Boulevard,Tower Suite,reported that he has read the staff report and the conditions and that he takes exception to the condition restricting multi-tier bleachers and the requirement for 24 additional parking spaces. He asked the Commission to consider allowing multi-tier bleachers as long as the church agrees to monitor their use so as to lessen the noise impact on the neighbors directly behind the bleachers and to allow the applicant to be excused from providing the 24 on- site spaces required in the conditions of approval. He concluded by thanking the neighbors for their input, Donald Granger for his incredible level of participation and involvement,and the congregation fortheirfaith, time and loyalty. Commissioner McPhail asked what would be in place of the 24 spaces should they be eliminated. Mr.Wolfe said the slope landscaping would remain in place. Commissioner Fletcher asked what benefit would occur if the spaces were put in as requested. Mr.Wolfe suggested it might show the neighbors their intent to cooperate,but that the applicants believed the spaces are not needed. Tom Smits, 10438 Vivienda Street voiced concern about noise stemming from multi-level bleachers every Saturday. He mentioned that he believes parking is still a problem and that the congregation will not want to use the ball field for parking. He reported a drainage problem; a culvert with standing water,weeds,and mosquitoes. Terri Smits, a resident on Vivienda Street, thanked Larry Wolfe and Donald Granger for listening to the residents'concerns. She reported that noise is still a concern and asked that a restriction be added that would not allow the ministry to use loudspeakers and microphones. She said he wants all amplified sound to be restricted to inside the buildings. Terry Douglas, 10313 Vista Grove,said she hears joyful sounds on Saturdays. Deanna Grace, 10418 Vivienda Street, mentioned her concem about noise, her backyard is unusable because of all the screaming. She asked that the bleachers be moved or kept to a single tier. Doug Wamer,5291 Ozark Mountain,expressed concern about the size of the church operation and noise amplification. He favored the idea of the church hosting their activities indoors. Planning Commission Minutes -3- July 27, 2005 Pete Smits, 10458 Vivenda Street said parking is the biggest issue and that they will need all the parking they can get, considering their plans for church growth. Henry Klein, 10427 Vivienda Street thanked everyone and said there was good cooperation. He favored the 24-space requirement and the restriction for single tier bleachers. Ron Nottingham, 13947 Claremont Lane,said he has been a member of the church for 5 years and is a coach in their sports program. He said he has never had to ask a parent or child to sit down on the bleachers. He said the parking situation has improved since February, and he believes the ballfield will be used for parking. He commented that he does not believe the noise levels should be a deterrent from the neighbors using their backyards. Jim Grace, 10418 Vivienda Street, said it is like a party every day and night because of the noise and that it is an invasion of his privacy. Hugh Hewitt, 19900 MacArthur Boulevard, Irvine, stated he represents the applicant along with Mr. Wolfe. He thanked staff for their help and input. He commented that typically, churches face restrictions in land use actions. He asked that three tier bleachers be allowed provided the church is self-monitoring and signs are posted advising people not to stand on them. He noted that there is a Master Plan in place and that the property was designed with this purpose in mind. He stated that he believes the project is actually over-parked by the standards and that they could save$90,000 if they are not required to add the 24 on-site spaces in question. Chairman Macias closed the public hearing and asked staff for any comment regarding the issues brought forward. Dan Coleman, Principal Planner, said the Commission has the authority to determine how many tiers the bleachers may be. He commented that the acoustical analysis indicates that the higher the bleachers,the less effective the sound wall would be. He noted that voluntary compliance and signs could be required if the Commission prefers. He said the specific condition is No. 9 and is found on Page 110 of the agenda packet. He commented that this is the first he has heard of the standing water in the drainage culvert. He said that Condition No. 1 for the Building and Safety Department indicates a Final Drainage study be prepared and that a clean out and maintenance could be added to that requirement of the applicant. He also noted that Condition No. 4 on Page 109 refers to outside amplification and noise levels from 7-10 p.m. Commissioner McNiel asked if adding something to the top of the sound wall had been considered. Mr. Coleman said that a Lexan barrier could be added to the top of the wall and that would help with some noise attenuation. Commissioner Fletcher asked how high a 3 tier bleacher is. Mr. Coleman reported about 4-4 1/2 feet high. Commissioner McNiel remarked that the neighbors concems are valid. He noted that the church has been blessed with growth and Larry Wolfe is doing what he can to mitigate the impacts. He said the drainage issue can be resolved in that possibly the church could be asked to maintain the drainage culvert. He suggested the sound wall be augmented with plexiglass/Lexan. He added that amplified sound could be directed toward the church buildings rather than towards the fields as well as lowering the decibels. He said that with the expected growth of the church, the additional 24 spaces need to be provided. He asked if there are any no parking signs on the residential streets. Mr. Coleman reported there are none. Planning Commission Minutes -4- July 27, 2005 Commissioner McNiel remarked that signs in the neighborhood would also limit the residents' parking on the street. He added that as churches get bigger,they often get better at controlling their parking situations. Commissioner McPhail remarked that it is a pleasure to see staff working well with the neighborhood. She noted that the concerns regarding hours, maintenance of the drainage,and the need for all possible parking on site have been addressed. She commented that she favors single- tier bleachers with the 6-foot sound wall unless the acoustical engineer could come up with a better suggestion. Commissioner McPhail remarked that the engineer could come back with a 3-tier bleacher with the addition of a Lexan barrier at a later time if they can substantiate that it would improve the noise situation. Commissioner Fletcher quipped that he is happy to see this type of issue as opposed to the impacts of a bar that backs up to a residential area. He complimented Mr. Granger for his excellent staff report. He added that he believes the requirement for the 24 on-site parking spaces remain as they will be needed. He complimented the parking ministry for their efforts and a good job. He noted that the residents have the right to a peaceful enjoyment of their property. He said the responsibility of the drainage may depend upon if the culvert lies on private property. Chairman Macias commented that all the points have been covered and if the project is approved as presented,the church will have to be a good neighbor because there is a Conditional Use Permit in place that can be brought back to the Commission for review. Commissioner Fletcher asked if the conditions place the responsibility to improve the drainage on the applicants. Kevin Ennis, Assistant City Attorney, commented that if the condition creates a standing water condition on the property,Code Enforcement could impose a subsequent condition for the owner to correct. Motion: Moved by McPhail, seconded by Fletcher, to adopt the Resolutions of approval as presented by staff for Variance DRC2005-00321, Variance DRC2005-00323, Variance DRC2005-00322, and Development Review DRC2004-01019 with the adoption of a Mitigated Negative Declaration of environmental impacts. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP SUBTPM16981 - STEVEN SPIES, PETER BRYAN, LINDA BRYAN-A subdivision of 2.43 acres of land into four lots in the Very Low Residential District(.1-2 dwelling units per acre), located 100 feet south of Wilson Avenue, between Hellman Avenue and Cousins Place - APN: 1062-061-03. VARIANCE DRC2004-01169-STEVEN SPIES,PETER BRYAN, LINDA BRYAN-A request to reduce the lot width on four lots on 2.43 acres of land in the Very Low Residential District(.1-2 dwelling units per acre), located 100 feet south of Wilson Avenue between Hellman Avenue Planning Commission Minutes -5- July 27, 2005 and Cousins Place-APN: 1062-061-03. Related files: Tentative Parcel Map SUBTPM16981 and Development Review DRC2004-01170. Tabe Van der Zwaag, Assistant Planner, presented the staff report. He noted that a letter was received from Mr. and Mrs. West objecting to the project because they believe the density is too high and because they do not like the width reduction of the lots. Chairman Macias opened the public hearing. Peter Bryan,6919 Onyx Avenue,stated he is the applicant and gave a brief overview of his project. He asked that the Commission reconsider the wording of the condition requiring an archeologist. He asked if it could be changed because a condition for a paleontologist is already included in the mitigations found on Page G114 and G115. Chairman Macias closed the public hearing. Commissioner McNiel commented that although there was an objection about the width of the lots, the actual size of the lots meets the intent of the Code. He noted that the owner made some good comments regarding his project. Chairman Macias agreed with Commissioner McNiel and that the four-lot subdivision is appropriate and that the applicant has worked towards a good solution. Commissioner Fletcher noted that the seven foot difference requested in the variance should not make a big difference, and that there is adequate property for the project. He commented that he was part of the Design Review and Trails Committee meetings. Brad Buller, City Planner, asked the Commissioners for consideration of the language of the mitigation regarding the archeologist and paleontologist. He noted that staff would support such a change. Commissioner Fletcher agreed that the change would be appropriate and the remaining Commissioners concurred. Motion: Moved by Fletcher, seconded by McNiel, (Stewart absent)to adopt the Resolutions of approval as modified by staff for Tentative Parcel Map SUBTPM16981 and Variance DRC2004-01169 and to adopt a Mitigated Negative Declaration of environmental impacts. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT DRC2004-01244 - ABUNDANT LIVING FAMILY CHURCH - A request to develop a new 200,000 square foot worship center including offices, meeting rooms,classrooms,and retail shops on 33.50 acres in the Industrial Park District(Subarea 7), located on the north side of Civic Center Drive,between Red Oak Street and White Oak Avenue - APN: 0208-354-01 and 04. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. Emily Cameron, Associate Planner, presented the staff report Commissioner McNiel asked for a tally of parking spaces provided. Planning Commission Minutes -6- July 27, 2005 • • Ms. Cameron said 876 spaces are required and a total of 1,141spaces are provided on site. Jim Dicamillo, WLC Architects, 10470 Foothill Boulevard, complimented Ms. Cameron for her assistance and for a fine job on the project. He asked for clarification regarding the building of the block wall, the requirement for a paleontologist on the site and regarding a contribution fee for the construction of the Foothill Boulevard Median. Diego Mesa, Pastor of Abundant Living Church said the church is now 5,000 members strong,that they plan to sell the business park in which the church is currently located and that the church offers various business related opportunities such as community health fairs and educational fairs. Chairman Macias opened the public hearing. Paul Batey, representing Angel's Hospital adjacent to the project site commented that Engineering required an access agreement off of Spruce with the church and that the applicants have not submitted a revised plan. He did not express opposition to the project, but he is not for or against the project until an agreement has been reached. Brad Buller, City Planner, referred to Engineering Condition No. 7 on Page G-112 of the agenda packet which indicates a shared driveway with the alternative of building two separate driveways. He remarked that if an agreement cannot be reached, the issue can be brought back to the Commission. He noted that the new owners of the hospital do not have a typical hospital operation.. Chairman Macias asked for clarification and why is there concern about the shared access. Mr. Batey stated that everyone will arrive at once for a church event and possibly block the path of incoming ambulances as well as a large Oxygen tank near the driveway that could be a possible hazard. He said no trauma care is provided at this facility. He said the new facility will be in full operation by the end of 2005. Tenice Johnson, 10135 Marion Avenue, Montclair, said she is a member of the church and that the church will also act as a community center. She said the church runs a diligent parking ministry. Chairman Macias closed the public hearing. Commissioner Fletcher asked counsel to comment regarding the Oxygen tank and what that would mean to the owners of the adjacent church property. Kevin Ennis,Assistant City Attomey, noted that the owner of the hospital property is under obligation to place the tank in a place that is safe. He said if it is placed too close to the driveway then it would be their problem to correct that. Commissioner McNiel commented that the tank is not a real problem, nor is the shared access since the hospital is not a trauma center. He congratulated Pastor Mesa in submitting a project that will be a great contribution to the community. Commissioner McPhail agreed that it is a great project. She asked that Engineering clarify the issue of the Engineering fees. Joe Stofa, Associate Engineer, reported that all the parcels in that area are required to pay a fair share of the improvement fees and that the property has been assessed. Commissioner Fletcher asked if the Commission has the authority to waive the fees. Planning Commission Minutes -7- July 27, 2005 Kevin Ennis stated the fees cannot be waived at this level; it would require City Council action. Commissioner Fletcher said it is a nice project and that he does not see the shared driveway as a problem. Chairman Macias stated he supports the project, it is compatible with the surrounding uses and the church will be a good neighbor. Mr. Buller asked Mr. Coleman, Principal Planner, if the condition regarding the paleontologist could be modified. Dan Coleman, Principal Planner commented that although the language is standard, it could be modified since the entire site was previously disturbed by grading activities. He suggested the wording of Condition No. 2 found on Page G-115 be re-worded to resemble Condition No. 1 on Page G-114. Motion: Moved by McNiel, seconded by McPhail, (Stewart absent) to adopt the Resolution of approval as modified by staff for Conditional Use Permit DRC2004-01244 and to adopt a Mitigated Negative Declaration of environmental impacts. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW DRC2003-01062 - WILLIAMS CHIAO ARCHITECTS -A.request to develop 8 residential condominium units on 1.08 acre of land in the Medium Residential District(8-14 dwelling units per acre), located at 8565 Madrone Avenue -APN: 0207-262-02. Related File: Tentative Tract 17009. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. Emily Cameron, Associate Planner, presented the staff report. Max Williams,276 North 2nd Avenue, Upland,stated he concurs with the staff report and conditions of approval. He said he would like to provide entry leve/affordable housing. Chairman Macias opened the public hearing and hearing no comment, closed the public hearing. Commissioner McNiel asked if the units are duplexes. Mr. Williams said that they are. Commissioner McNiel said that there are some duplexes existing in the area and they have done well. He remarked that the project looks good. Motion: Moved by McPhail, seconded by McNiel, (Stewart absent) to adopt the Resolutions of approval as presented by staff for Tentative Tract Map SUBTT17009 and for Development Review Planning Commission Minutes -8- July 27, 2005 DRC2003-01062 and to adopt a Mitigated Negative Declaration of environmental impacts. Motion carried by the following vote: AYES: FLETCHER, MACIAS, McNIEL, McPHAIL NOES: NONE ABSENT: STEWART carried COMMISSION BUSINESS K. ELECTION OF PLANNING COMMISSION OFFICERS Brad Buller, City Planner, briefly explained that the Commission elects new officers on a yearly basis. Chairman Macias nominated Pam Stewart as Chairman. Mr. Buller commented that Commissioner Stewart is aware she would be nominated and has expressed her desire and willingness to serve as Chairman. Commissioner McNiel nominated Chairman Macias as Vice Chairman. Motion: Moved by McNiel, seconded by McPhail, (Stewart absent) to name Pam Stewart as Chairman of the Commission and Rich Macias as Vice Chairman. Motion carried by the following vote: AYES: FLETCHER, MACIAS, McNIEL, McPHAIL NOES: NONE ABSENT: STEWART carded L. DESIGN REVIEW COMMITTEE APPOINTMENTS Brad Buller, City Planner commented that in her absence, Commissioner Stewart expressed her willingness to continue on the Design Review Committee, but that she would be happy either way. Commissioner Fletcher said his schedule is flexible but that he is now the Chairman at the Chamber of Commerce and is willing to remain an alternate for the Committee. Motion: Moved by Fletcher,seconded by Macias,(Stewart absent)to maintain the current Design Review Committee appointments as Commissioners Stewart and McPhail. Commissioner Fletcher will serve as alternate. Motion carried by the following vote: AYES: FLETCHER, MACIAS, McNIEL, McPHAIL NOES: NONE ABSENT: STEWART carded M. TRAILS ADVISORY COMMITTEE APPOINTMENT Brad Buller, City Planner, explained that the Trails Committee appointments are for a 3-year term expiring in July 2008. Chairman Macias suggested they leave the appointments as is with Commissioners Fletcher and McPhail as the representatives and Commissioner Stewart as the alternate. Motion: Moved by Macias, seconded by McNiel, (Stewart absent)to maintain the current Trails Committee appointments as Commissioners Fletcher and McPhail. Commissioner Stewart will continue to serve as alternate. Motion carried by the following vote: Planning Commission Minutes -9- July 27, 2005 AYES: FLETCHER, MACIAS, McNIEL, McPHAIL NOES: NONE ABSENT: STEWART carried PUBLIC COMMENTS Mort Eriksen, 13182 Gabay Court complimented the Commission for working so well together and that the City of Rancho has"a great thing here." He said he bought a home in the Pacific Etiwanda development and at the time of purchase, was promised access to a City Park which still has not been built. He remarked there has been unlawful dumping on the property and he has notified Code Enforcement. Brad Buller, City Planner reported that the park is still scheduled to be built and that he will ask staff from Engineering to call him with the status of the park construction. He noted it is a 5-acre park and part of it is a retention basin. Commissioner Fletcher thanked Mr. Eriksen for the compliments. COMMISSION BUSINESS No additional Commission business was conducted.
