HomeMy WebLinkAbout2005/04/27 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting April 27, 2005 Chairman Macias called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was'held in the Council Chambers at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman Macias then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: Richard Fletcher, Rich Macias, Cristine McPhail, Pam Stewart ABSENT: Larry McNiel STAFF PRESENT: Brad Buller, City Planner; Dan Coleman, Principal Planner; Kevin Ennis, Assistant City Attomey; Dan James, Senior Civil Engineer; Gail Sanchez, Planning Commission Secretary; Lois Schrader, Planning Department Secretary; Mike Smith, Assistant Planner ANNOUNCEMENTS Brad Buller, City Planner, gave a brief overview of the meeting format and public hearing process. APPROVAL OF MINUTES Motion: Moved by Fletcher, seconded by Stewart, carried 3-0-0-1, to approve the minutes of April 13, 2005. CONSENT CALENDAR A. DEVELOPMENT REVIEW - DRC2004-01117 - STONEFIELD DEVELOPMENT - The design review of site plan and elevations for seven lots (previously approved with Tentative Tract SUBTT16648)on 1.89 acre of land in the Low Residential District(2-4 dwelling units per acre), located on Heather Street, east of Haven Avenue-APN: 1076-341-01. On April 28, 2004, the Planning Commission adopted a Mitigated Negative Declaration for the related Tentative Tract Map SUBTT16648. The California Environmental Quality Act provides that no further environmental review or Negative Declaration is required for subsequent projects or minor . revisions to projects within the scope of a previous Negative Declaration. Motion: Moved by Stewart, seconded by McPhail,to adopt the Consent Calendar. Motion carried by the following vote: AYES: FLETCHER, MACIAS, McPHAIL, STEWART NOES: NONE ABSENT: McNIEL - carried . * • * * PUBLIC HEARINGS Chairman McNiel commented that Item E on the agenda, Conditional Use Permit 88-45 and Entertainment Permit 91-03- Margarita Beach, was to be continued to May 11, 2005. He asked if anyone was present who would like to speak because they could not be at the meeting on May 11. There were no public comments. B. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP SUBTPM16445- MARK CAPELLINO-A request to subdivide a 7.27 acre parcel into 11 parcels in the General Industrial District (Subarea 5), located at 9850 6th Street - APN: 0209-211-19. Related Files: Development Review DRC2003-01185 and Tree Removal Permit DRC2004-00804. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. (Continued from March 23, 2005) Motion: Moved by Fletcher, seconded by Stewart, to continue Tentative Parcel Map SUBTPM16445, with the item to be re-advertised for the May 25, 2005, meeting. Motion carried by the following vote: AYES: FLETCHER, MACIAS, McPHAIL, STEWART NOES: NONE ABSENT: McNIEL - carried C. ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT MAP SUBTT17096 - CECIL R. CARNEY ARCHITECTS - A request to subdivide a parcel of 4.77 acres for condominium purposes in conjunction with a proposal to construct 7 buildings with a combined floor area of about 56,000 square feet, which will be comprised of retail and professional office uses in the Office Park(OP) District of the Etiwanda Specific Plan, including 1.15 acre within the Etiwanda Avenue Overlay District, located near the southeast comer of Etiwanda Avenue and Candlewood Street-APN: 1100-031-07. Related files: Development Review DRC2004-00716, Conditional Use Permit DRC2004-01094, and Pre-Application Review DRC2003-01047. D. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT DRC2004-01094 - CECIL R. CARNEY ARCHITECTS - A request to construct 7 buildings with a combined floor area of about 56,000 square feet,which will be comprised of retail and professional office uses, and the demolition of the existing post office and relocation of postal services to temporary office trailers on-site on 4.77 acres of land in the Office Park (OP) District of the Etiwanda Specific Plan, including 1.15 acre within the Etiwanda Avenue Overlay District, located near the southeast comer of Etiwanda Avenue and Candlewood Street-APN: 1100-031-07. Related files: Tentative Tract Map SUBTT17096, Development Review DRC2004-00716, and Pre- Application Review DRC2003-01047. NEW BUSINESS F. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW DRC2004-00716-CECIL R. CARNEY ARCHITECTS: A request to construct 7 buildings with a combined floor area of about 56;000 square feet,which will be comprised of retail and professional office uses,on 4:77 - acres of land in the Office Park(OP)District of the Etiwanda Specific Plan, including 1.15 acres within the Etiwanda Avenue Overlay District, located near the southeast corner of Etiwanda Avenue and Candlewood Street - APN: 1100-031-07. Related files: Tentative Tract Map SUBTT17096, Conditional Use Permit DRC2004-01094, and Pre-Application Review DRC2003-01047. • Commissioner McPhail recused herself because her company receives remuneration from the applicant's company. Planning Commission Minutes -2- April 27, 2005 Mike Smith, Assistant Planner, presented the staff report. Chairman Macias opened the public hearing. Cecil Camey, Architect, 1285112841 Newport Avenue, Tustin, stated he read and agreed with the conditions of approval. He indicated the owner and a Post Office representative were available to answer questions. Commissioner Fletcher asked if Mr. Camey had submitted roofing material samples to staff. Mr. Camey replied that he had not submitted samples. He said he hoped to use 5-shingle composition roof to be compatible with the Cour house. Laureen Yamakido, 395 Oyster Point Boulevard, Suite 225, South San Francisco, presented a letter indicating the Postal Service has a contract until 2010 but that the landlord has the right the relocate the facility. She stated the Post Office was supportive of the project. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner Stewart complimented the applicant and architect. She felt the project would bring a refreshing element to the area and provide needed services. Commissioner Fletcher remarked it is a different type of development. He believed it is good architecture for along Etiwanda Avenue and imparts a historic feel. Chairman Macias thought it is a good project. Motion: Moved by Stewart, seconded by Fletcher,to issue a Negative Declaration and adopt the resolutions approving Tentative Tract Map SUBTT17096, Conditional Use Permit DRC2004-01094, and Development Review DRC2004-00716. Motion carried by the following vote: AYES: FLETCHER, MACIAS, STEWART NOES: NONE ABSENT: MCNIEL ABSTAIN: McFHAIL -carried E. CONDITIONAL USE PERMIT 88-45 AND ENTERTAINMENT PERMIT 91-03 - MARGARITA BEACH-A public hearing to examine the business operation to ensure that it is being operated in a manner consistent with conditions of approval or in a manner, which is not detrimental to the public health, safety, or welfare or materially injurious to properties in the vicinity. The Planning Commission will consider modification or revocation of the approved Conditional Use Permit and Entertainment Permit. Brad Buller, City Planner, asked the Commission to continue the item to May 11,2005. He observed a neighborhood meeting was held with the applicant and the neighbors and the Police Department also held a Neighborhood Watch meeting with the residents and staff was trying to get the business -- -. - owner involved in a Business Watch meeting. He indicated the neighbors have submitted some suggested conditions they would like applied to the Conditional Use Permit and Entertainment Permit and staff will review those suggestions along with the Police Department. He said there seems to be cooperation between the neighbors and the business owner to talk the matter through, so he said staff may again ask for another continuance on'May 11. He said staff would like to mach a general agreement between the neighbors and the residents and that was also the goal of the business owner. He reported the Police Department reported at the Neighborhood Meeting and the Planning Commission Minutes -3- April 27, 2005 Neighborhood Watch Meeting that the business is being managed well in the interim, so there is not an urgent need to bring the matter back. Commissioner Macias said it was encouraging to hear about the positive things going on. He opened the public hearing. David Mosher, 8026 Cambridge Avenue, Rancho Cucamonga, stated he lives nearby. He said he and his wife hear people leaving at around 2:00 - 3:00 a.m. on a nightly basis. He stated they scream and yell and peel out of the back alleyway. He asked if there was some way to get that to cease. Mr. Buller commented that complaint has been mentioned as a discussion issue. Motion: Moved by McPhail, seconded by Stewart, to continue Conditional Use Permit 88-45 and Entertainment Permit 91-03 to May 11, 2005. Motion carried by the following vote: AYES: FLETCHER, MACIAS, McPHAIL, STEWART NOES: NONE ABSENT: McNIEL - carried PUBLIC COMMENTS There were no public comments at this time. COMMISSION BUSINESS Brad Buller, City Planner, observed a Joint Meeting with the Planning Commission and City Council in the near future. Dan Coleman, Principal Planner, asked the Commissioners to review the Design Awards nominee listing and advise their choices at the next Planning Commission meeting. Mr. Buller announced that Central Park will have a Grand Opening on Saturday, May 21, 2005. ADJOURNMENT Motion: Moved by McPhail, seconded by Fletcher, carried 4-0-1 (McNiel absent), to adjoum.
