Chairman McNiel then led in the pledge of allegiance. Commissioner Tolstoy added that Mrs. Bonaccorsi is known for her innovative planning and that much of her work involved planning much of the drought tolerant landscaping we see around the City. He remarked that she will be missed. ENVIRONMENTAL ASSESSMENT AND GENERAL PLAN AMENDMENT GPA2002-00001-FRAZIER GROUP-A request to change the General Plan land use designation within Subarea 1 of the Foothill Districts from Office to Mixed Use to allow for Office and Medium-High Residential 24 dwelling units per acre)for 7.24 acres of land located on the north side of Foothill Boulevard, west of the Cucamonga Channel. The City will also consider Mixed Use to allow for Office and Medium Residential (8-14 dwelling units per acre) as an alternative for the entire site - APN: 207-101-32, 33, and 50. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT CODE AMENDMENT DCA2002-00001 - FRAZIER GROUP - A request to add a Mixed Use zoning designation description to Sections 17.08.030.F and 17.32 of the Development Code to allow for Office and Medium-High Residential (14-24 dwelling units per acre) for 7.24 acres of land located on the north side of Foothill Boulevard, west of the Cucamonga Channel. The City will also consider Mixed Use to allow for Office and Medium Residential (8-14 dwelling units per acre) as an alternative for the entire site - APN: 207-101-32, 33, and 50. Related Files: Pre-Application Review DRC2002-00450, Preliminary Review DRC2002-00589, General Plan Amendment GPA2002-000011, and Development District Amendment DDA2002-00001. Staff has prepared a Negative Declaration of environmental impacts for consideration. (Continued from January 22, 2003) Warren Morelion, Assistant Planner, gave the staff report, noting that a letter dated February 12, 2003, was received from the Department of the Interior/Fish and Wildlife Service. He commented that the letter recommends"the site be evaluated by a qualified biologist to more accurately assess whether any potential habitat for Federally-listed species exists on-site." Brad Buller, City Planner explained that in 1990, following a citywide analysis, the City Council arrived at a City policy for our density ratio of multi-family units versus single-family units. He noted that we are moving toward achieving a reduction of multi-family units to single-family units. He added that we are at about 65 percent-35 percent and that the goal we are seeking is about a 75 percent-25 percent ratio of homes to multi-family units. He said this is a policy issue and the Planning Commission needs to address this aspect of the project. He commented that this is why staff does not support the request from the applicant for Medium-High density. Chairman McNiel opened the public hearing. Khosrow Omidur, K& S Property, 26401 Highwood Circle, Laguna Beach, stated he has about 7 acres of property to develop. He commented that he did not purchase the property for speculation and that he plans to develop it and he hopes the General Plan Amendment goes through. He said they are doing a marketing study on the property and lining up their financing in order to see what direction to go and they would like to keep their options open and move forward with a project. Planning Commission Minutes -2- February 12, 2003 Chairman McNiel noted that they held a neighborhood meeting in October when they presented their original idea for a senior housing project. He then asked if another meeting had taken place since they have a new proposal. Mr. Omidur confirmed that they originally planned a senior housing project but that they are not sure now what they will do. He said it depends upon the financing. He added that if the General Plan Amendment is approved, they would host another neighborhood meeting when they know what to build. Chairman McNiel asked if he had discussed with staff their recommendations for Medium Residential and no more than 8-14 units per acre. Mr. Omidur stated he had. Commissioner Stewart asked if they are open to the Medium zoning. Mr. Omidur replied that their application is based upon their request for Medium-High density at 14- 24 dwelling units per acre. He said that they would like the Medium-High density but that it would depend upon what the Commission recommends. Chuck Buquet, 8725 Predera Court, Rancho Cucamonga, expressed concern about no specific project being presented with the application for the land use amendment. He stated he has concems about no specifics about the intended use and that some people are still under the impression that a senior housing project is being proposed. He commented that by changing the zoning to allow Medium-High density, the land value increases ten fold. He added that the site is unique in that it is hillside property, it has trails, grading/elevation issues and the possibility of future traffic, glare, and noise impacts to the neighboring residential area. He said that if 14-24 dwelling units are allowed, it will result in a 3-story profile residential tucked under existing residential. He suggested they come back when they have a specific project plan to justify what they are asking for. He commented that he believes this could start a line-up of others who choose to do the same thing. Guy Roney, K&S Property, 26401 Highwood Circle, Laguna Beach, stated they are asking for the General Plan Amendment in order to see what they can build. He noted that the Design Review Committee could evaluate the building product when it is submitted. He stated that they have spent approximately $150 thousand toward the project on architects, geological analysis, market study, financing and entitlement. He added that they are not just speculating, they need the General Plan Amendment to proceed. Chairman McNiel expressed a lack of real concem for the amount of money the developer has spent because it is known that working with land use designation is gambling and risk is involved. He noted that he stated that going ahead with the project is dependent upon the amendment and that if the Commission approves the amendment "blind," then the Design Review Committee has little control over the project other than basic design elements. Mr. Roney replied that they are not trying to"pull one over on them, but that entitlement and market constraints are important. He noted that financial constraints are such that financing may be available now, but possibly not in six months. He said they realize that this is their risk. Commissioner Stewart asked if they are looking at town-house development at this point in time. Mr. Roney stated that senior housing was their original idea but because of budgetary constraints and because the City did not want to participate to the level that they needed, they have to look at other ways to develop the site and have retained architects and engineers to look at the site because the site is a challenging piece of property. Planning Commission Minutes -3- February 12, 2003 Renee Massey, 8088 Camino Predera, Rancho Cucamonga, stated she lives just north of the proposed project. She noted that she addressed the Commission several years ago in regard to the Concordia project that was proposed adjacent to this site. She noted Concordia is yet to be built and she expressed concern as to how the two projects would mesh together. She felt that 18-24 units per acre would not be a good neighbor to that project if developed. She expressed surprise and concern that the project was changed from a senior project to an unspecified project. Michael Frazier, 1130 W. Columbia Street, Brea, stated he is the architect for the proposed project. He noted the old railroad right-of-way is about 100 feet wide, and flat, and it is also about 20 feet above the grade level and 20 feet below the proposed homes. He said the roof levels of his project would not affect views because of the grade differential. He added that because the senior housing/redevelopment funding fell short of what they needed, they decided upon a land use change request to give them flexibility for the type of development that is most advantageous for the development and the neighborhood. He said the whole project has not been designed at this point. Chairman McNiel asked what guarantees they would have about what type of development is built if they approved the 14-24 density. He emphasized that the City would be at risk. Commissioner Macias said they would have to assume it would be the worst case scenario; 14-24 units per acre density. Mr. Frazier agreed there would be no guarantee and that it is the Commission's option to approve the density request or approve another one. He added that the Mixed Use for consideration could be incorporated with apartments and commercial on the same parcel. He indicated that they made the request with that option in mind. Travis Bailey, a student from Rancho Cucamonga High School and a resident at 12272 Bellflower Court, Rancho Cucamonga, expressed concern about how close together houses are in Rancho Cucamonga. He said that it is financially great for the City, but nobody enjoys it. He said only a handful of tracts have front yards or side yards. He added everything is too close together and it is getting more compact. Chairman McNiel replied that the City does not make money on people living here. He said that some homes in Rancho are quite large with large lots. He added that with the price of land, a home with a quarter acre lot would be unaffordable to many people. He noted that our Development Code limits how close the homes can be and they will not get any closer than they are now. Commissioner Tolstoy expressed his appreciation that a young person would stand and express his opinion. He said he is glad to know that he has concem for his community. Chairman McNiel closed the public hearing. Mr. Buller summarized the progress of the project proposal and staffs position by stating that the developer knew the need for senior housing and staff said that it would be feasible for this site, and therefore encouraged that type of development via a Senior Housing Overlay District. The property was zoned Office and had no residential component so they then looked at altematives as to how to get them to that point for senior housing. The Council and Commission allocated Mixed Use to several properties, one of them was next to this site near the Sycamore Inn. It also did not have a • residential component. The Council and Commission concurred that to give the residential designation to that property was a good land use decision to allow for development options. Staff felt that this property could also be similar and therefore they felt the 8-14 residential density was consistent with what has been done with other properties in the immediate area. He added that he is not too concerned that no specific project is proposed with the land use change because even if the project was approved, there is no guarantee that it would go forward. He noted that they could lock them in with a development agreement but that the Commission and Council have already said that Planning Commission Minutes -4- February 12, 2003 Mixed Use with 8-14 dwelling units is a reasonable use for this area, and not the Medium High density as the applicant has requested unless it is with a senior housing project. He noted that when the developer realized from a business standpoint that the senior project might not be feasible, he invited the developer to continue in the process with other alternatives such as Office or 8-14 dwelling units or a mix of the two, but that he(Mr. Buller)would not support the Medium-High density as requested by the applicant. Chairman McNiel asked if the Commission is legally able to vary from the applicant's specific request for Medium-High density. Mr. Buller stated that they could approve a higher density, lower density, or not do anything, and leave it the way it is. Kevin Ennis,Assistant City Attorney, said that the documents before the Commission provide for the staff recommendation of 8-14 dwelling units and not the request of the applicant of 14-24 dwelling units per acre. Commissioner Tolstoy pointed out how peculiar and unique the property is. He stated that he is against Mixed-Use, but in this case, he believes it would be acceptable as long as they held to the density range of 8-14 dwelling units per acre. He added that the architect would have to do some very creative planning because of the configuration of the lot. Commissioner Stewart stated she concurs with Commissioner Tolstoy but she was a little confused with some of the presentations and that they don't know what they want to put there but that the zoning is needed so they will know what they can do. She agreed that Mixed-Use is consistent with what they have already done and she supports only the Medium density and not the Medium-High density. She supports staff recommendation. Commissioner Macias asked for clarification regarding what the Commission's options are. Mr. Ennis confirmed that although the applicant's request is for Medium-High density,the resolutions provide only for Medium density at 8-14 dwelling units per acre. Commissioner Macias expressed concern about the perception of a senior housing project being developed on the property. He asked how that could be remedied through the remainder of the entitlement process. Mr. Buller stated that staff recommended language for the Development Code change (the zoning document) that would indicate that the property is zoned for 8-14 dwelling units per acre, but they also added language that they would support and would allow it to become a Senior Housing Overlay District property subject to the review process. He stated that they would acknowledge in the Code that it is predetermined to be a good site for that use. He added that the Commission does not have to go along with that recommendation. He stated that staff believed that with this language, it would help someone do a senior project there if they wanted to. He said it is an acknowledgement that staff has looked at it and that it is a reasonable site to pursue for senior housing. Commissioner Macias again referred to the perception and asked what the checks and balances are for the public to respond. Mr. Buller explained that if a developer came in with a project, they would have to go through another environmental review and design review and another public hearing. He added that because of the Commission's discretionary authority within that, they would not be required to approve the project at 14 units per acre for example. He noted they could approve it for 8 or less. He said the Commission would have to evaluate the project when it comes in. Planning Commission Minutes -5- February 12, 2003 Commissioner Macias confirmed that because there is no specific project presented with this request, that there will be more opportunities for public and staff input and comment. Commissioner Tolstoy added that they would require at least one neighborhood meeting. Chairman McNiel stated that he doubts seeing senior housing for this property or Mixed-Use or condominiums. He added that if this goes forward at 8-14 then we would most likely see market rate apartments. He noted that he is still uncomfortable with the process this application has taken as well as the perception as noted by Commissioner Macias. Commissioner Tolstoy moved based upon staffs recommendation for Mixed-Use with 8-14 residential density. He added he would like to see some office use as well. Chairman McNiel commented that he had recently seen a compact site developed with a Ralph's market, commercial units forming a courtyard and dwelling units were added above the market. He said it was tight but do-able. He suggested that working with this site might require some creative planning. Mr. Buller interjected that a provision for a Senior Housing Overlay District is not currently in the resolution and therefore if the commission moves forward with it as written, this action will only include the Mixed-Use provision. Commissioner Tolstoy amended his motion to include language to provide for the SHOD and a note that the base density would be calculated from a Medium-High Residential density range (14-24 dwelling units per acre). He commented that the architect would have to use creative planning for this site. Commissioner Stewart seconded the motion as amended. Motion: Moved by Tolstoy, seconded by Stewart,to adopt the resolutions recommending approval of General Plan Amendment GPA2002-00001, Development District Amendment DDA2002-00001, and Development Code Amendment DCA2002-00001 as amended to allow Medium-High Residential with a Senior Housing Overlay District. Motion carried by the following vote: AYES: MACIAS, STEWART, TOLSTOY NOES: MCNIEL ABSENT: NONE - carried Chairman McNiel explained that he voted no because he is uncomfortable with it and that when they come forward with a project he will meet with them during their Design Review. D. TIME EXTENSION FOR CONDITIONAL USE PERMIT DRC2001-00778-LEWIS APARTMENT COMMUNITIES-A request to construct a temporary modular recreation building of 360 square feet within the Mountain View Apartments (Tract 12365) in the Medium-High Residential(14-24 dwelling units per acre) District of the Terra Vista Community Plan, located at the southeast corner of Spruce Avenue and Terra Vista Parkway- APN: 1077-651-07. Debra Meier, Associate Planner, presented the staff report. Chairman McNiel opened the public hearing. Kurt Christy, Lewis Development, 1156 North Mountain Avenue, Upland, stated the project fell behind schedule but that they anticipate moving into the building in mid-March. Planning Commission Minutes -6- February 12, 2003 Commissioner Tolstoy asked how long it would take to get the temporary structure moved off of the property. Mr. Christy stated it is a matter of a phone call and within a few days, the temporary structure can be removed. Chairman McNiel closed the public hearing. Commissioner Stewart remarked that this is straightforward and a temporary stopgap and their action is commendable. Motion: Moved by Tolstoy, seconded by Macias,to adopt the resolution approving Time Extension for Conditional Use Permit DRC2001-00778 as presented. Motion carried by the following vote: AYES: MACIAS, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried E. VARIANCE DRC2002-00958— ILSLEY-A request to construct a wall 6 to 7 feet in height and 25 feet long in the required 37-foot front yard setback (measured from the curb), along the property line that separates 9240 Archibald Avenue and 9221 Jadeite Avenue, located in the Low Residential (2-4 dwelling units per acre) District-APN: 209-321-73. Related files: Minor Exceptions DRC2002-00619 and DRC2002-00780. Mike Smith, Planning Technician gave the staff report. Commissioner Tolstoy asked if the applicant had consulted his neighbors regarding the proposal. Mr. Smith stated he has and the neighbors are working with them. Chairman McNiel opened the public hearing. Jay Isley, 9240 Archibald Avenue, Rancho Cucamonga, stated he and his wife have owned the property for the last 20 years. He pointed out that the proposal is to help control the noise that may occur when they hold events on the property for the benefit of the neighbors. He added that the neighbor is splitting the costs of the wall with him and that this wall will finish the walls around the property. Chairman McNiel closed the public hearing. Commissioner Tolstoy remarked that the variance request is a great idea. Motion: Moved by Tolstoy, seconded by Stewart, to adopt the resolution approving Variance DRC2002-00958 as requested. Motion carried by the following vote: AYES: MACIAS, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried F. ENTERTAINMENT PERMIT DRC2001-00083 — RIPTIDE - A third six-month review for compliance with the conditions of approval for entertainment consisting of a DJ, dancing, and live acoustic entertainment in conjunction with an existing restaurant with bar and billiard hall in Planning Commission Minutes -7- February 12, 2003 the Neighborhood Commercial District, located at 6620 Camelian Street-APN:201-811-56,59, 60, and 61. Warren Morelion,Assistant Planner, presented the staff report and noted that no correspondence or calls had been received regarding the review of the business operation. Chairman McNiel opened the public hearing. Commissioner Macias asked if the call history from the police department indicated more or fewer calls over the last 6 months than at any other time. Mr. Morelion stated that it would be close. He reported a 50 percent decrease in calls in the last 6 months. Commissioner Macias asked if noise was the greatest complaint, or fights and assaults. He also asked if assaults had occurred there more in the last 6 months than at any other time. Mr. Morelion stated that he thought there were more fights and assaults in the last six months than other types of complaints, but that he would have to review the reports to be sure. Chairman McNiel opened the public hearing and noted that the applicant was not present. He noted the request before the Commissioners allows for a one year period before another review, but that it is both an Entertainment Permit and a Conditional Use Permit and therefore a review can occur at any time if necessary. Commissioner Stewart clarified the police history and commented that out of the 7 calls noted in the last 6 months, one was a 911, and 3 others were audible alarms,which means that only 3 calls were directly related to disturbances, fights, or assaults. Chairman McNiel closed the public hearing. Motion: Moved by Stewart, seconded by Macias,to review Entertainment Permit DRC2001-00083 in one year. Motion carried by the following vote: AYES: MACIAS, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried G. DEVELOPMENT CODE AMENDMENT DRC2003-00031 —CITY OF RANCHO CUCAMONGA- A request to amend Section 17.32 (Foothill Boulevard Districts) of the Rancho Cucamonga Development Code, permitting private school uses and modifying the public hearing requirements within each of the four subareas of the Foothill Boulevard Districts. Mike Smith, Planning Technician, gave the staff report. Chairman McNiel opened the public hearing and then clarified what types of schools would be allowed with the new amendment. Mr. Smith stated that many types of vocational/instructional schools would be permitted including, but not limited to, welding, dancing, and karate, to name a few. Chairman McNiel asked how the City could be selective with the types of schools that may choose to open in these areas. Planning Commission Minutes -8- February 12, 2003 Mr. Smith replied that the Conditional Use Permit process would apply to all of these applications. Commissioner Tolstoy asked where Section 61-Educational Services originated(reference found on Page G-15 of the agenda packet). Nancy Fong, Senior Planner, replied that Educational Services is a category from the Standard Industrial Classification that comes from the OMB. She added that it is a Federal document and the classification is nationwide and therefore we use it in our Development Code. Commissioner Tolstoy pointed out that the Federal government still terms Community Colleges as Junior Colleges, an incorrect term. Chairman McNiel closed the public hearing. Commissioner Stewart moved approval noting that this amendment might help fill some empty spaces in our malls. Motion: Moved by Stewart, seconded by Macias,to adopt the resolution recommending approval of Development Code Amendment DRC2003-00031. Motion carried by the following vote: AYES: MACIAS, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried The Planning Commission recessed from 8:25 p.m. to 8:30 p.m. DIRECTOR'S REPORTS H. A REQUEST TO REVIEW THE 1-15 FREEWAY LANDSCAPE BEAUTIFICATION MASTER PLAN—CITY OF RANCHO CUCAMONGA. Nancy Fong, Senior Planner presented the report. Commissioner Tolstoy commented that he had read that once a freeway is complete,the State does not consider landscaping for 10 years following the completion. Brad Buller, City Planner, replied that he had not heard that. He commented that people are asking why our new freeway is not yet landscaped. He noted that there is a settlement period where one contract ends before another begins. Commissioner Tolstoy asked if the City would be discussing the landscaping in a year or so. Mr. Buller stated that the new 210 Freeway landscaping would most likely begin in about a year. He added that we would see"basic"Caltrans landscaping to start with. He noted that the Joint Powers Authority has entered into an agreement for the corridor and upon a Landscape Master Plan that reflects enhancements presented here. He said that the only way these enhancements will come to fruition is with grant monies. He commented that the enhancements save water, ad art elements and other features that make it more community friendly and livable. He added that the Caltrans landscaping is very minimal. Chairman McNiel invited public comments. Planning Commission Minutes -9- February 12, 2003 Larry Ryan, 31591 Camino Capistrano, San Juan Capistrano, gave a Power Point presentation highlighting the proposed landscape plan. Commissioner Tolstoy commented on how much money these improvements would require. Mr. Ryan reported that they are putting together the projected costs and will refine them before presenting them. He said they do not have cost estimates at this time. Commissioner Tolstoy said that he liked what Mr. Ryan envisioned with the arrows. He then remarked that we can come up with a nice plan but he did not know how we would come up with the money. • Mr. Buller reported that the City has two goals in the plan. The first being the creation of a Master Plan that captures the image of Rancho Cucamonga and a phased project that begins with the basic landscaping provided by Caltrans, and with grants, additional enhancements being added. He reported that the second goal is to let Caltrans know what we envision for the future and when it comes time to widen the freeway, they will know what we think. He added that Caltrans will not do any of this work but we will get Caltrans input and support and they will most likely watch it. We will provide all of the improvements. We are hoping they will accept the maintenance of it. Commissioner Tolstoy asked what we are doing for providing irrigation using tertiary water. Commissioner Tolstoy expressed frustration about the water being available, but that getting the water piped in always seems to be a problem. Mr. Buller stated that using tertiary water is a very important part of the plan. He cited an example of the golf course being a project where they considered using tertiary water sources in the future, but that the cost to put in double pipes to allow that future irrigation was not economically feasible, and therefore the pipes were not put in. He reported that we are working with them and they are now considering re-piping the golf course now to allow for this type of irrigation. Commissioner Tolstoy noted that Califomia is facing a major water crisis. He noted that in San Diego they have a difficult situation because they have no wells. He said the water they get from the Colorado River would be taken away from the farmers, potentially destroying their agricultural base. Chairman McNiel gave his enthusiastic approval of the concept of the Master Plan. Commissioner Tolstoy noted that Mr. Ryan implied there would be a future widening of the freeway. Chairman McNiel indicated that that is correct and the plan reflects that. Mr. Ryan confirmed that the future widening of the freeway has been incorporated into the landscape plan. Commissioner Tolstoy noted that the murals on the walls are nice, adding visual interest along the corridor. Mr. Buller noted that if Caltrans decides to widen the freeway, they would know what we have in mind and will likely include it in their project. The Commissioners agreed to the conceptual plan. CONSIDERATION TO INITIATE DEVELOPMENT CODE AMENDMENT—CITY OF RANCHO CUCAMONGA — A request to consider amending the Development Code regarding second dwelling units per Assembly Bill 1866. Ruben Warren, Planning Aide, presented the report. Chairman McNiel asked what the gains and/or losses might be with the new legislation. Mr. Warren replied that we lose the right to require a Conditional Use Permit for second dwelling units. He stated that the only real gain is that the second dwelling units can now be applied as part of our housing element. Brad Buller, City Planner, stated that we do not have many options and if we do not have criteria in place prior to the new law being enacted, we could end up with something we do not want. He reported that we plan to develop the criteria and come back to the Commission with that. Chairman McNiel asked if they could have more than one second dwelling unit on a lot. Mr. Buller confirmed that only one would be allowed. Motion: Moved by Tolstoy, seconded by Stewart, to direct staff to initiate an amendment as presented by staff. Kevin Freijlach, Planning Intern, presented the staff report. Commissioner Tolstoy asked if we could look for standards among cities that are even further out than the ones mentioned in the report. Mr. Freijlach stated that we could. Brad Buller, City Planner, mentioned that there are many cities that do not have any standards but said staff will research and seek out those cities that do and then and forward recommendations to the Commission. Commissioner Tolstoy suggested Palm Springs as a data source. Mr. Freijlach also suggested Newport Beach and Milipitas. He added that Title 25 is elaborate. Chairman McNiel recommended that we be prepared as a City and entertained the motion to initiate the amendment.
