HomeMy WebLinkAbout2002/08/14 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting • August 14, 2002 Chairman McNiel called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:02 p.m. The meeting was held in the Council Chamber at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, Califomia. Chairman McNiel then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: John Mannerino, Larry McNiel, Pam Stewart, Peter Tolstoy ABSENT: Rich Macias STAFF PRESENT: Brad Buller, City Planner; Dan Coleman, Principal Planner;Craig Fox,Deputy City Attorney; Dan James, Senior Civil Engineer; Catherine Johnson, Associate Planner; Gail Sanchez, Planning Commission Secretary; Mike Smith, Planning Technician; Alan Warren, Associate Planner; Christina Wilson, Planning Aide; Emily Wimer, Assistant Planner ANNOUNCEMENTS There were no announcements. APPROVAL OF MINUTES Motion: Moved by Mannerino, seconded by Stewart, carried 4-0-1 (Macias absent), to approve the minutes of July 24, 2002. CONSENT CALENDAR A. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW DRC2002-00223 - RICHMOND AMERICAN HOMES-The review of building elevations and detailed site plan for Tentative Tract Map SUBTT16334 consisting of 38 single family lots on 8.4 acres of land in the Low-Medium Residential District (4-8 dwelling units per acre) of the Victoria Planned Community, located on the southeast corner of the intersection of Rochester Avenue and the unused Southern Pacific Railroad right-of-way - APN: 1089-031-01 and 25. Related files: Tentative Tract Map SUBTT16334, Lot Line Adjustment LLA524, Tract Map SUBTT16051,and Development Review DR 99-48. Chairman McNiel indicated Item A would be pulled and heard in conjunction with Item B. PUBLIC HEARINGS B. ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT MAP SUBTT16334-RICHMOND AMERICAN HOMES-A residential subdivision of 38 single family lots and one lettered lot on 8.4 acres of land in the Low-Medium Residential District (4-8 dwelling units per acre) of the Victoria Planned Community, located at the southeast comer of the intersection of Rochester Avenue and the unused Southern Pacific Railroad right-of-way-APN: 1089-031-01 and 25. Related files: Development Review DRC2002-00223, Lot Line Adjustment LLA524, Tract Map SUBTT16051, and Development Review DR 99-48. Alan Warren, Associate Planner, presented the staff report. Chairman McNiel opened the public hearing. There were no comments and he closed the hearing. He observed that the development is a continuation of existing homes. He felt it is a good looking tract of homes and said the project progressed easily through the Design Review process. Motion: Moved by Tolstoy, seconded by Mannerino,to issue a Negative Declaration and adopt the resolutions approving Tentative Tract Map SUBTT16334 and Development Review DRC2002-00223. Motion carried by the following vote: AYES: MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: MACIAS - carried C. ENTERTAINMENT PERMIT DRC2002-00259 - COMPASS CREEK RESTAURANT AND BREWERY - A request to renew and intensify the existing use by adding a 144 square foot dance floor in conjunction with a restaurant and bar within an existing building in the Masi Plaza with a leased space of 8,700 square feet, located at 11837 Foothill Blvd - APN: 229-011-39. (Continued from July 24, 2002. Christina Wilson, Planning Aide, presented the staff report. Chairman McNiel asked for clarification that the lease and current Conditional Use Permit allow a dance floor of 144 square feet. Ms. Wilson responded that the dance floor was expanded to 360 square feet during the sale of the property; however, the landlord sent staff a letter indicating the maximum size of the dance floor is 144 square feet based on the tenant's lease. Chairman McNiel asked what would be done with the balance of the dance floor. Brad Buller, City Planner, stated the applicant would have to remove it or the owner would withdraw support for the entertainment permit. Commissioner Tolstoy questioned the parking situation. Mr. Buller responded that the Code requires parking at a rate of 5 spaces per 1,000 square feet with 15 percent food users. He noted that the center has added more food users over the years so that its percentage is higher than the 15 percent and there is currently a deficit of 55 spaces. He said the shopping center owner has been put on notice that the parking issue must be resolved prior to approval of tenant improvements for any new food users. He reported that staff has not seen any problems in this area of the center. Commissioner Mannerino noted that during the hours of operation of the entertainment,there should be no problems because some of the other businesses are closed. Mr. Buller indicated the largest impact is around the Family Fitness Center facility. Planning Commission Minutes -2- August 14, 2002 Commissioner Tolstoy commented that there is sometimes a shortage of parking by Dennis as well. Chairman McNiel noted the public hearing was open from the previous meeting. David Anichowski, Compass Creek Restaurant, 11837 Foothill Boulevard, Rancho Cucamonga, stated he was available to answer questions. Commissioner Tolstoy observed that the staff report indicated there is one security guard. Mr. Anichowski stated he is not required to have a security guard, but he has one on Friday and Saturday evenings. He said that on Saturday nights he also has a promoter who brings in two to three guards. Commissioner Tolstoy asked if they wear uniforms. Mr. Anichowski responded negatively. Commissioner Tolstoy asked if there are any problems. Mr. Anichowski replied that there were fights almost every week when he first took over the business. He said they changed the crowd by taking out a few pool tables, posting a security guard outside, and not allowing underage drinking. He indicated they are now doing well and appeal to a more mature crowd. He said they had to paint the bathrooms weekly to cover the graffiti when they first took over but they haven't had to paint for the last four months. Chairman McNiel asked if they would be successful with a 144 square foot dance floor. Mr.Anichowski responded affirmatively. He said they have a full food menu and do a lot of coupons in the area. He noted they have tripled their food business. Hearing no further testimony, Chairman McNiel closed the public hearing. Commissioner Mannerino observed that the Police report indicated it is quiet. Motion: Moved by Mannerino, seconded by Tolstoy, to adopt the resolution approving Entertainment Permit DRC2002-00259. Motion carried by the following vote: AYES: MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: MACIAS - carried D. CONDITIONAL USE PERMIT DRC2002-00189—DAVID NADALET-A request to construct a second dwelling unit of 720 square feet above a multi-vehicle garage of 1,560 square feet,with cut in excess of 5 feet on a property with a slope greater than 8 percent, on a 25,611 square foot lot in the Very Low Residential District(1-2 dwelling units per acre)at 8988 Mustang Road- APN: 1062-051-10. Related file: Minor Exception DRC2002-00478. Chairman McNiel indicated that Item D would be heard in conjunction with Item E. DIRECTOR'S REPORTS E. MINOR EXCEPTION DRC2002-00478 - DAVID NADALET - A request to construct a combination wall/fence composed of a 6 feet high retaining wall with a 5 feet high wrought iron fence above it (calculated height = 8 feet) in conjunction with a the construction of a second Planning Commission Minutes -3- August 14, 2002 dwelling unit on a 25,611 square foot lot in the Very Low Residential District(1-2 dwelling units per acre) at 8988 Mustang Road - APN: 1062-051-10. Related file: Conditional Use Permit DRC2002-00189. Mike Smith, Planning Technician, presented the staff report and reported that staff received two comments from residents. He said an anonymous caller was concerned about the view from the street and said he indicated the primary house will obstruct visibility from the street. He stated the second caller was a neighbor to the east who was concerned about the wall and he addressed her concerns. Commissioner Stewart asked if the integrity of the slope will be maintained by retaining walls. Mr. Smith responded that was correct. He indicated the rear wall of the new structure will also be a retaining wall. Commissioner Tolstoy hoped the area is drained well. Mr. Smith explained the project was approved by the Grading Committee. Chairman McNiel opened the public hearing. There were no comments, and he closed the hearing. Commissioner Mannerino stated he was in favor of planed granny flats, having recently been in a similar situation. Chairman McNiel agreed they are generally not intrusive. Motion: Moved by Mannerino, seconded by Stewart,to adopt the resolution approving Conditional Use Permit DRC2002-00189 and to support the granting of Minor Exception DRC2002-00478. Motion carried by the following vote: AYES: MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: MACIAS - carried PUBLIC COMMENTS There were no public comments. COMMISSION BUSINESS Commissioner Stewart indicated she would not be able to attend the Design Review Committee meeting on August 20. Chairman McNiel volunteered to cover the meeting. ADJOURNMENT Motion: Moved by Mannerino, seconded by Tolstoy, carried 4-0-1 (Macias absent),to adjoum. The Planning Commission adjourned at 7:31 p.m. to a workshop. The workshop adjourned at 8:40 p.m. and those minutes appear separately.
