HomeMy WebLinkAbout2000/06/28 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES ' Regular Meeting June 28, 2000 Chairman McNiel called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was held in the Council Chamber at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman McNiel then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: Rich Macias (arrived at 7:22 p.m.), John Mannerino, Larry McNiel, Pam Stewart, Peter Tolstoy ABSENT: None STAFF PRESENT: Dan Coleman, Acting City Planner; Bill Curly, Deputy City Attorney; Dan James, Senior Civil Engineer; Brent Le Count, Associate Planner; Warren Morelion,Assistant Planner; Gail Sanchez, Planning Commission Secretary; Michael Smith, Planning Aide; Emily Wimer, Assistant Planner ANNOUNCEMENTS Dan Coleman, Acting City Planner, announced that the Design Review Committee would not be meeting on Tuesday, July 4, because of the holiday, but would instead meet at 7:00 p.m. on Thursday, July 6. CONSENT CALENDAR A. MITIGATION MONITORING PROGRAM FOR DEVELOPMENT REVIEW 99-11 -CATELLUS—A 140-acre master plan known as the Rancho Cucamonga Corporate Park, consisting of a mix of commercial and industrial development in the Industrial Park(Subarea 7)and General Industrial Districts (Subarea 8) of the Industrial Area Specific Plan, located on Milliken Avenue between Foothill Boulevard and Arrow Route - APN: 229-011-25, 31, and 32. Related file: Tentative Parcel Map 15295. A Mitigated Negative Declaration was adopted on April 28, 1999. Motion: Moved by Mannerino, seconded by Stewart, carried 4-0-1 (Macias absent) to adopt the Consent Calendar. PUBLIC HEARINGS B. MODIFICATION TO CONDITIONAL USE PERMIT- 00-03- MCALAN'S PUB AND GRILLE—A request to modify a previously approved restaurant and bar to permit serving of alcoholic beverages in the outdoor patio area in the Neighborhood Commercial District of the Haven Village Center, located at 6321 Haven Avenue(formerly Willie&Pies Pizza)—APN: 201-271-69. Emily Wimer, Assistant Planner, presented the staff report and indicated that staff received a letter signed by the property manager and both tenants indicating that the concerns raised by the neighboring tenant had been resolved. Commissioner Stewart asked if staff was satisfied with the conditions noted in the letter. Ms. Wimer responded affirmatively. Chairman McNiel commented the item had been continued from June 14 and the public hearing remained open. There were no public comments and he closed the hearing. Motion: Moved by Tolstoy, seconded by Mannerino, to adopt the resolution approving Modification to Conditional Use Permit 00-03. Motion carried by the following vote: AYES: MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: MACIAS - caned Commissioner Mannerino commended everyone for working out the problem. C. ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT 15955 — LEE - A residential subdivision and design review of the detailed site plan and elevations for 22 single family lots on 4.39 acres of land in the Low-Medium Residential District (4-8 dwelling units per acre), located on the north side of San Bernardino Road, east of Vineyard Avenue -APN: 208-091-08. D. VARIANCE 00-03 — LEE —A request to reduce the minimum lot depth for Lots 3, 11, and 15 111 within Tentative Tract 15955 on 4.39 acres of land in the Low Medium Residential District (4-8 dwelling units per acre), located on the north side of San Bernardino Road, east of Vineyard Avenue—APN: 208-091-08. Brent Le Count, Associate Planner, presented the staff report and indicated staff had received a letter from an adjacent homeowner expressing concerns regarding the location of the proposed house on Lot 13. He said staff looked at the possibility of re-plotting the house to bring it forward on the lot and that could be done within the setbacks. He indicated he had not had time to review the proposed change with the applicant. Commissioner Mannerino asked for clarification that the variance request was not for the lot in question. Mr. Le Count confirmed that it was not and said the re-plotted house would also meet the required setbacks. Chairman McNiel opened the public hearing. Jeff Lee, 2208 North Edward Avenue, South El Monte, said he would not object to moving the house on Lot 13 forward as it would merely make the front yard smaller and the back yard larger. Chairman McNiel noted that Lot 13 was plotted as a flag lot with fencing separating the front yard from the back yard. He questioned the type of fencing. Mr. Lee indicated it could be either block or wrought iron. Planning Commission Minutes -2- June 28, 2000 Chairman McNiel suggested that the fencing between Lots 13 and 12 and Lots 13 and 14 should be block or decorative masonry in order to allow some privacy. Mr. Lee felt it could be worked out with staff. Mr. Le Count indicated staff would work it out in plan check. Diane Mowe, 9007 Chianti Court, Rancho Cucamonga, stated that her home is surrounded by several houses and she would feel compelled to move if the house were placed on Lot 13 in its original location. She also expressed concerns about runoff and said she had spoken to City staff and been told that the runoff would be directed toward the new streets. She indicated she loves the trees which are currently on Lot 13 and she asked if trees could be planted in their place. Chairman McNiel asked that staff address the tree issue. Mr. Le Count responded that the trees in question are avocado and are not protected by the Tree Preservation Ordinance and do not need to be replaced. Ms. Mowe asked if her existing chain link fence will be removed and indicated her property is at a lower elevation from the new tract. Chairman McNiel said it may or the new fence may be placed adjacent to hers. Frank O'Farrell, 9010 Chardonnay Circle, Rancho Cucamonga, stated he lives to the south of Ms. Mowe and re-plotting the house further front on Lot 13 would move the house away from Diane and place it closer to him. He said he understood Ms. Mowe's concems but he would also have the same concerns. He asked if the house could be single story. Mr. Le Count indicated the house could not be single story without going back through the Design Review process. Dan Coleman, Acting City Planner, suggested the house might be moved closer to the northwest side of the lot,which would be away from Ms. Mowe and Mr. O'Farrell. He noted that the property to the northwest is a higher elevation than the proposed tract, so the house would have a slope behind it and could be moved to within 5 feet of the property line. Mr. O'Farrell felt that would be acceptable. He said he was glad to see the property developed because it has been an eyesore. Chairman McNiel felt staff could resolve the problem. He noted that if the house were single story, it would be larger and closer to the property lines. Mr. O'Farrell said he would not mind a single story house that was closer because it would not look into his back yard. As there were no further public comments, Chairman McNiel closed the public hearing. Motion: Moved Mannerino, seconded by Stewart, to issue a Negative Declaration and adopt the resolutions approving Tentative Tract 15955, Design Review of Tentative Tract 15955, and Variance 00-03 with modifications to relocate the house on Lot 13 to be as far as possible from the adjacent tract to the southeast, provide tree planting along the east property line of Lot 13, and provide decorative masonry walls along property lines of Lot 13 where it adjoins Lots 12 and 14. MITIGATION MONITORING PROGRAM AND TIME EXTENSION FOR TENTATIVE TRACT 15540 - FU-MAI LIMITED PARTNERSHIP - A request for a time extension of a previously approved tentative tract map for the development of 159 single family lots on 24.56 acres of land in the Medium Residential District(8-14 dwelling units per acre)of the Foothill Boulevard Specific Plan and Development Code areas located between Foothill Boulevard and Arrow Route,west of the Cucamonga Creek Control Channel — APN: 207-211-01, 18 through 21, 31, 32, and 34. Related Files: Development Review 99-27 and Variance 99-06. Warren Morelion, Assistant Planner, presented the staff report. Chairman McNiel opened the public hearing. Ron Maestas, Madole&Associates, 10601 Church Street, Suite 107, Rancho Cucamonga, stated they were the civil engineers on the project and he was available to answer questions. There were no further comments and Chairman McNiel closed the hearing. Motion: Moved by Tolstoy, seconded by Stewart,to adopt the resolution approving Time Extension and Mitigation Monitoring Program for Tentative Tract 15540. Motion carried by the following vote: AYES: MACIAS, MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried NEW BUSINESS F. CONSIDERATION OF APPEAL OF TREE REMOVAL PERMIT 00-20-AYALA-An appeal of the City Planner's denial of a request to remove one mature tree in the front yard at 7631 Zircon Avenue -APN: 208-931-42. Michael Smith, Planning Aide, presented the staff report. Chairman McNiel invited public comment. Edward Ayala, 7631 Zircon Avenue, Rancho Cucamonga, stated they bought the house with the intent of putting in RV parking in the rear yard because the City does not allow parking in the driveway or on the street. He believed the tree needs to be removed because the tree roots are sticking up 1 foot above the surrounding area and starting to lift the sidewalk. He showed pictures of the tree and its elevation above the surrounding ground and driveway. He indicated the closest tree is 23 feet south of this tree but indicated he has another tree on the other side of his driveway to the north. He noted that staff had suggested the driveway could be widened by 4 feet without removing the tree and said he did not believe that would be sufficient to provide access to the rear yard. Chairman McNiel observed it is the official street tree. Planning Commission Minutes -4- June 28, 2000 Mr. Coleman indicated the tree is located approximately 4 feet back from the sidewalk. Mr. Ayala said he would be willing to replace the tree elsewhere on the property. He stated he is trying to save the $78 fee he is currently paying for RV storage and still comply with the City's ordinance regarding parking. Commissioner Stewart noted there is another street tree on the property and a substantial hedge adjacent to the proposed RV storage space. Mr. Ayala confirmed that was correct. There were no additional public comments. Commissioner Stewart indicated she had visited the property. She stated the tree is beautiful. She said she had looked at staffs proposal for a curvilinear driveway but she felt it may be too difficult to maneuver the RV by the tree. She did not think elimination of the tree will hurt the property. She noted that there are also a lot of trees in the back yard. Commissioner Macias agreed with Commissioner Stewart. He felt that even if the existing tree were trimmed, the RV would still wind up being parked in the driveway because it would be easier than trying to maneuver around the tree. He thought the neighborhood would not lose character by removal of the tree. He did not feel it would be necessary to replace the tree as mitigation but was not opposed to such a condition if the remainder of the Commission preferred replacement. Chairman McNiel noted that if the tree were replaced, it would not be the same size and he questioned if it would look good. Commissioner Stewart felt loss of the tree will not ruin the landscaping, but felt a smaller tree could be put in and it would look good. Commissioner Mannerino favored granting the applicant's appeal subject to putting in another tree. Mr. Coleman indicated staff could issue an approval letter on June 29 if the Commission so desired. Commissioner Tolstoy suggested a tree could be placed closer to the property line. Mr. Coleman said staff could work with the applicant on a placement. He said the canopy would probably interlace with the neighbor's tree, but it would be feasible. Chairman McNiel stated the City does not like to remove street trees but he felt that pruning the tree in order to accommodate the RV would already alter the look. He supported the appeal. Mr. Coleman did not feel the tree would necessarily need to be pruned but he acknowledged the roots would be problematic for the new driveway. Chairman McNiel stated he would prefer to see something a little more artistic than a flat slab driveway going straight back and he would like the tree replaced. Motion: Moved by Mannerino, seconded by Macias, to grant the appeal and direct staff to approve the application with provisions to replace the tree and artistically augment the driveway connection. COMMISSION BUSINESS G. GENERAL PLAN UPDATE PROGRESS Dan Coleman, Acting City Planner, indicated there was nothing new to report. Commissioner Tolstoy suggested that the Commissioners view the grading taking place on the Barrett project, Tract 13316 at the top of Archibald. He noted that the Commission had agreed to relieve the developer of the normal Hillside Development Standards and he hoped the Commissioners would look at the results.
