CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting August 28, 1996 Chairman Barker called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was held in the Council Chamber at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman Barker then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: David Barker, William Bethel, Rich Macias, Larry McNiel (arrived at 7:05 p.m.), Peter Tolstoy ABSENT: None STAFF PRESENT: Miki Bratt, Associate Planner; Brad Buller, City Planner; Dan Coleman, Principal Planner; Ralph Hanson, Deputy City Attorney; Dan James, Senior Civil Engineer; Gall Sanchez, Planning Commission Secretary; Alan Warren, Associate Planner; Bob Zetterberg, Integrated Waste Coordinator ANNOUNCEMENTS Brad Buffer, City Planner, announced that a replacement had been hired to fill the Associate Planner position created when Scott Murphy left the City. He indicated that Tom Grahn, a former employee, had been rehired. Commissioner McNiel arrived. APPROVAL OF MINUTES Motion: Moved by Bethel, seconded by McNiel, carried 5-0, to approve the minutes of August 14, 1996. CONSENT CALENDAR A. DEVELOPMENT REVIEW 95-17 - WINSTON RESIDENCE - The design review of a 6,389 square foot single family dwelling and detailed site plan for a hillside lot at 9006 Reales Street in the Very Low Residential District (less than 2 dwelling units per acre) - APN: 1061-811-23. Motion: Moved by Tolstoy, seconded by McNiel, carried 5-0, to adopt the Consent Calendar. PUBLIC HEARINGS B. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW 96-17 - MIMI'8/WOHI RANCHO PARTNERS - A request to construct a 6,455 square foot restaurant on 2.41 acres of land located on the southeast corner of Foothill Boulevard and Spruce Avenue in the Industrial Park Distdct (Subarea 7) of the Industrial Area Specific Plan - APN: 208-352-62. Related File: Preliminary Application Review 96-03. Miki Bratt, Associate Planner, presented the staff report. She presented a revised site plan which had been submitted by the applicant and stated that staff felt the revisions address the Design Review Committee comments. Chairman Barker Opened the public hearing. Peter Desforges, Wohl Investment Company, 2402 Michelson, Suite 170, Irvine, stated that Dani Mayer from Mimi's Cafe and architect Tom Bond were available to answer questions. Commissioner McNiel asked how many parking spaces were lost as a result of the revised site plan. Mr. Desforges replied that two spaces were eliminated. Commissioner McNiel asked for clarification on the decorative paving material by Mimi's. Tom Bond, Architects Pacifica, Ltd., 17711-B Mitchell North, Irvine, stated there will be colored concrete as chosen by Mimi's. He said they will coordinate colors so they will be compatible with the rest of the center. Brad Buller, City Planner, stated that staff would work with the architect and Mimi's. He commented that the Design Review Committee had requested that accent paving be extended out into the parking area by the handicapped parking area. He also noted that stamped concrete would not be acceptable based on past Commission policy. Commissioner McNiel observed that there had been discussions at the Design Review Committee Meeting regarding the different window treatments on the various sides of the building, but the Committee felt they were acceptable because they appear to be complementary when viewed from any area. Hearing no further testimony, Chairman Barker closed the public hearing. Commissioner McNiel stated he was pleased the use is in this location because he felt it will be a complementary restaurant to others in the area. Chairman Barker agreed and felt it will be also be a good complement to the hotel. Motion: Moved by McNiel, seconded by Tolstoy, to issue a Negative Declaration and adopt the resolution approving Development Review 96-17. Motion carried by the following vote: AYES: BARKER, BETHEL, MACIAS, MCNIEL, TOLSTOY NOES: NONE ABSENT: NONE - carried DIRECTOR'S REPORTS Planning Commission Minutes -2- August 28, 1996 C. UPDATE ON GRAFFITI Bob Zetterberg, Integrated Waste Coordinator, reviewed the graffiti removal program. He stated that gang related graffiti is removed as quickly as possible to discourage tagging. He discussed staffing and equipment and reported that the graffiti hotline is monitored on the weekends with a stand-by crew available to respond as necessary. He informed the Commission that abatement costs have declined since Fiscal Year 1992/93 because of more efficient and better equipment, the use of volunteers, and a decline in the amount of tagging. He commented that a graffiti task force had been formed and several City ordinances were passed as a result, including requirements for businesses to lock up spray paint cans, removal of graffiti from private property within 24 hours, and granting authority to the City to remove graffiti from private property. He reported that the City keeps a pictorial log of gra~ti which is used by the Police when taggers are caught as any damage of $5,000 or more is treated as a felony. He presented a chad indicating the number of square feet painted by month for Fiscal Years 1992/93 through 1995~96 and indicated that there has been an upsurge in the last few months partly because the numbers include clean-up painting on some walls which have frequently been painted over. He stated that the numbers on the chart do not include private property. He felt the City has had good success with private property. He noted that the City offers paint to the public from the recycled household waste program. Commissioner McNiel indicated he had served on the Graffiti Task Force and he asked if staff felt the Task Force should meet again. Mr. Zetterberg did not think that should be necessary. He felt the City is doing all it can and it is just a matter of continuing to fight taggers. He thought the problem is under reasonable control and stated it is not possible to totally eliminate the problem. He commented that new legislation now makes parents more responsible. Commissioner Tolstoy questioned the controls imposed by surrounding cities. Mr. Zetterberg replied that Ontario and Fontana have programs similar to Rancho Cucamonga. Commissioner Tolstoy felt that Rancho Cucamonga has less of a problem than Ontario and Fontana. Commissioner Bethel stated he worked on graffiti abatement in Los Angeles and they found that prompt removal cuts down on the amount of graffiti. He appreciated that the City does not use the same color on every wall, but instead tries to match wall colors. He felt that the City does an excellent job. Mr. Zetterberg explained that the City uses six basic colors. Commissioner Bethel suggested that staff contact major paint companies and ask for donations in return for public acknowledgment of the companies. Mr. Zetterberg indicated that the City uses Vista Paint because it has been able to provide consistency in the colors and previously there had been problems with color consistency when other compar~ies were used.. He said that beige and gray paints are obtained through the recycle program and that paint is given away for graffiti cover up. Commissioner Bethel felt the City does a great job. He again suggested that paint companies be asked to donate paint with color matching. Chairman Barker agreed with Commissioner Bethel regarding the effects of prompt removal. He said that when he was a School Administrator, he assigned a custodian to remove graffiti every morning before school started in order to discourage taggers. Planning Commission Minutes -3- August 28, 1996 D. COMMERCIAL LAND USE STUDY UPDATF Brad Buller, City Planner, gave a short history of the background which led to the current issues and discussions regarding commercial land use designations. Chairman Barker suggested placing the matter on future agendas on a regular basis. He expressed his opposition to spot zoning and said that was why the Planning Commission had requested the Commercial Land Use study. Commissioner Bethel stated he has seen some cities with spot zoning and that is exactly what it looks like. Commissioner Tolstoy felt that any applicant asking for a zone change should provide a conceptual idea for how the property would be used. Mr, Buller supported requesting conceptual site planning with any zone change requests but reminded the Commission that zone changes cannot be conditioned to a specific site plan. Commissioner Tolstoy felt the conceptual site plan provides a basis for dialogue with the applicant regarding what the area potentially will look like. He recalled that the Commission had informed Wohl that the view from Eucalyptus Street could not be the backs of buildings. Chairman Barker asked for discussion regarding a requirement for a focused retail absorption analysis with zone change applications. Mr. Buller observed that such an analysis has been required for applications in the past. Commissioner Bethel said he wished to study the matter further. It was the consensus of the Commission that the subject be placed on future agendas to allow further discussion. PUBLIC COMMENTS There were no public comments at this time. COMMISSION BUSINESS Commissioner Tolstoy requested that color boards be brought to the Planning Commission meetin~]s. Mr. Buller agreed. Mr. Buller gave each Commissioner a memorandum regarding upcoming conference dates for League of California Cities Planners' Institute and the American Planning Association National Conference. He stated that the City Manager had indicated he would try to provide funding for the Commissioners to attend and he asked that Commissioners keep the dates in mind. Planning Commission Minutes -4- August 28, 1996 Commissioner Bethel expressed appreciation for the professionalism of staff and stated that materials are well written. He thanked staff for its help.
