HomeMy WebLinkAbout1993/09/22 - Minutes - PC-HPCCITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting September 22, 1993 Chairman McNiel called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was held in the Council Chamber at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman McNiel then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: Suzanne Chitiea, Larry McNiel, John Melcher, Wendy Vallette ABSENT: Peter Tolstoy STAFF PRESENT: Brad Bullet, City Planner; Dan Coleman, Principal Planner; Nancy Fong, Senior Planner; Craig Fox, Deputy City Attorney; Steve Hayes, Associate Planner; Dan James, Senior Civil Engineer; Beverly Nissen, Associate Planner; Steve Ross, Assistant Planner; Gail Sanchez, Planning Commission Secretary , , , , , ANNOUNCEMENTS Brad Buller, City Planner, stated a workshop to review Building X at the Terra Vista Town Center had been scheduled for October 13, 1993 following the regular Planning Commission meeting. Mr. Buller commented that he and Commissioner Vallette had attended a CalTrans meeting regarding Route 30 and they would be happy to give an update under Commission business. , , · , , APPROVAL OF MINUTES Motion: Moved by Chitiea, seconded by McNiel, carried 3-0-1-1 with Tolstoy absent and Melcher abstaining, to adopt the minutes of September 8, 1993. , , · , · PUBLIC HEARINGS Ae ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 93-04 - EZE TRUCKING, INC. - A request to establish a truck terminal/storage facility on a 3.57 acre site containing a 1,560 square foot office building and a 1,056 square foot repair garage, located in the General Industrial District (Subarea 5) of the Industrial Area Specific Plan, located at the southeast corner of 5th Street and Lucas Ranch Road - APN: 210-071-37 and 41. Staff recommends issuance of a mitigated Negative Declaration. Steve Hayes, Associate Planner, presented the staff report. Chairman McNiel asked if the facility was currently in operation. Mr. Hayes confirmed that it is. Chairman McNiel opened the public hearing. Greg Vandenberg, 965 North Second Avenue, Upland, stated he represented the owner and the owner agreed with all of the conditions except No. 6, requiring trees and ground cover in landscape planter areas along the interior property lines. He said they are installing an 8-foot decorative block wall and a minimum 25-foot landscaping area along the street frontages of the property. He felt trees within the interior would interfere with the storage. He commented that two other conditional use permits had been granted on the street without the need for interior landscaping. Chairman McNiel asked if the planting along interior property lines is a standard condition. Mr. Hayes replied it is standard per the Industrial Area Specific Plan. Mr. Vandenberg thought the requirement for interior landscaping was intended for industrial parks and he stated that industrial parks would not have an 8-foot decorative wall along the exterior. He said they had already moved the wall back on 5th Street to accommodate the 25 feet of landscaping on the outside of the wall. Commissioner Chitiea noted that the landscaping plan on Page A-5 of the staff report depicts plantings directly in front of the building. She asked if the applicant was objecting to what was depicted in the plan. Mr. Vandenberg responded he was not objecting to that landscaping plan, only landscaping along the interior property lines because it would break up their storage area and also be a waste of water. Commissioner Melcher asked about the applicant's assertion that two other conditional use permits had been approved without a requirement for interior landscaping. Dan Coleman, Principal Planner, stated that he knew of a recently approved project to the south involving a change of tenancy to a building which did not have the requirement added. Commissioner Vallette asked the use at this project site before the truck terminal/storage facility. Mr. Vandenberg responded it was a roofing contractor's yard. Hearing no further testimony, Chairman McNiel closed the public hearing. Planning Commission Minutes -2- September 22, 1993 Commissioner Vallette agreed interior landscaping would infringe on the use of the property. She felt it would be acceptable to delete the requirement because it would hamper the use and is on the interior of the property and she felt City is getting a lot of extra landscaping with the 25-foot setback and the 8-foot wall. Commissioner Melcher concurred. Commissioner Chitlea stated she did not object because the 25-foot landscaping area would be on the exterior. Chairman McNiel agreed. Motion: Moved by Melcher, seconded by Vallette, to issue a Negative Declaration and adopt the resolution approving Conditional Use Permit 93-04 with modification to delete Condition No. 6, requiring landscaping along the interior property lines. Nancy Fong, Senior Planner, presented the staff report. Chairman McNiel asked if the lot had recently been split. Ms. Fong responded affirmatively. Commissioner Melcher stated it was his understanding that the conditional use permit application was for the use only and an approval would not mean approval of the building and site plan. Ms. Fong replied that was correct and approval would not lock in the site plan shown in the staff report. Chairman McNiel opened the public hearing· Tim Beedle, K. B. & Associates, 9650 Business Center Drive, Rancho Cucamonga, stated the applicant is aware an approval would still require having the proposed building go through the development review process. Commissioner Melcher asked if the applicant was aware that an approval would not obligate the City to approve the site plan depicted in the staff report. Planning Commission Minutes -3- September 22, 1993 Mr. Beedle responded affirmatively. He said it was a diagrammatic exhibit. He stated it is the applicant's concept, but he understood that staff had not reviewed the site plan. Nearing no further testimony, Chairman McNiel closed the public hearing. Motion: Moved by Melcher, seconded by Chitiea, to adopt the resolution approving Conditional Use Permit 93-38. CONDITIONAL USE PERMIT 93-37 - TERRA VISTA ANIMAL HOSPITAL - A request to establish an animal hospital within a 1,500 square foot leased space in an existing shopping center in the Neighborhood Commercial District of the Tetra Vista Planned Community, located at 10598 Base Line Road, Suite F - APN: 1076-481-35. Steven Ross, Assistant 'Planner, presented the staff report. Chairman McNiel asked if any animals would be kept overnight. Mr. Ross responded negatively. Commissioner Melcher asked how the facility would dispose of animal waste. Chairman McNiel opened the public hearing. Dr. Michael Weigard, 862 Decatur Circle, Claremont, stated that animal waste is usually disposed through the normal sewer system. He said they would have a disposal company come once a week to dispose of tissue waste from surgery. Hearing no further testimony, Chairman McNiel closed the public hearing. Commissioner Chitlea felt the use would be appropriate and convenient. She supported it. Commissioner Vallette agreed. Motion: Moved by Melcher, seconded by Chitlea, to adopt the resolution approving Conditional Use Permit 93-38. SIGN ORDINANCE AMENDMENT NO. 93-01 - CITY OF RANCHO CUCAMONGA - An amendment to allow additional monument signs for shopping centers· Dan Coleman, Principal Planner, presented the staff report. Chairman McNiel asked if consideration had been given to the illumination of those street signs which may abut residences. Mr. Coleman responded that generally the signs are internally illuminated or have very concentrated external illumination. He stated that generally signs have an opaque background with illuminated letters. Chairman McNiel felt that certain signs may be appropriate for Foothill Boulevard but would not fit well in residential areas. Commissioner Melcher asked if the matter had been brought to the attention of any of the shopping center owners or the Chamber of Commerce. Mr. Coleman replied it had been discussed with Lewis Homes. He said he had not approached the Chamber of Commerce, but the Chamber had previously expressed an interest in additional monument signs. Chairman McNiel opened the public hearing. Chairman McNiel closed the hearing. There were no public comments and Commissioner Chitiea felt it would be appropriate to amend the code, rather than try to grant approvals of additional signs by exception. Motion: Moved by Chitiea, seconded by Vallette, to adopt the resolution recommending approval of Sign Ordinance Amendment No. 93-01. CONDITIONAL USE PERMIT 93-33 - MASI PARTNERS - A request to permit the sales of tea, coffee, books, magazines, and newspapers in 1,000 square feet in Building 7 (7,739 square feet) of previously approved Conditional Use Permit 91-24, located on 27 acres at the southwest corner of Foothill Boulevard and Rochester Avenue in the Industrial Park District (Subarea 7) of the Industrial Area Specific Plan - APN: 227-011-10, 19, 21, and 26 through 28. CONDITIONAL USE PERMIT 93-35 - MASI PARTNERS - A request to permit a hair and nail salon of 1,000 square feet in Building 7 (7,739 square feet) of previously approved Conditional Use Permit 91-24, located on 27 acres at the southwest corner of Foothill Boulevard and Rochester Avenue in the Industrial Park District (Subarea 7) of the Industrial Area Specific Plan - APN: 227-011-10, 19, 21, and 26 through 28. CONDITIONAL USE PERMIT 93-36 - MASI PARTNERS - A request to permit a dry cleaners of 2,000 square feet in Building 7 (7,739 square feet) of previously approved Conditional Use Permit 91-24, located on 27 acres at the southwest corner of Foothill Boulevard and Rochester Avenue in the Industrial Park District (Subarea 7) of the Industrial Area Specific Plan - APN: 227-011-10, 19, 21, and 26 through 28. Beverly Nissen, Associate Planner, presented the staff report. Chairman McNiel asked if the applications would consume the entire Building 7 of the project. Ms. Nissen responded affirmatively. Chairman McNiel noted that there had been no request for interior seating at the shop selling tea and coffee. He asked if there had been any request for exterior seating. Ms. Nissen replied that there had been no such request. Commissioner Melcher noted that generally conditional use permits are submitted by the ultimate user so that the Commission has an opportunity to discuss the conditions with the user. He asked why the application was being submitted prior to identifying the users. Ms. Nissen replied that the applicant had indicated he was working with some eventual users and he would like to have the uses approved ahead of time in order to expedite the signing of leases. Commissioner Melcher preferred the usual procedure. Chairman McNiel opened the public hearing. Michael Scandiffio, Masi Con~nerce Center Partners, 1510 Riverside Drive, Burbank, stated they have tenants for the liquor/dell, cleaners, hair salon, and tea/coffee book store and have talked to three separate florists who have expressed interest in the site. He said they currently have letter agreements Planning Commission Minutes -6- September 22, 1993 and one lease. He said it was his impression that if they outlined the program, it would not be necessary for the individual retailers to attend tonight's meeting. Commissioner Chitlea felt that seating for the coffee/book store would create ambiance. She asked why it was not being requested. Mr. Scandiffio said the center is designed with an overhang to easily accommodate seating. Commissioner Melcher said it was his understanding that if the applications are approved and negotiations fall through with the prospective tenant, the space could be leased for any permitted use or a use similar to the approved use or a new conditional use permit could be applied for. Brad Buller, City Planner, stated that in most instances, when there is a change of ownership of a business with a conditional use permit, the new owner is only asked to acknowledge the conditions of the conditional use permit. Chairman McNiel wanted to be sure the people leasing the spaces would be aware of the specific conditions applied to the conditional use permits. Mr. Scandiffio said the conditions would become part of the lease. Mr. Bullet suggested adding a condition that a copy of the resolution be attached to any leases for the space. He also stated that any changes in the proposed square footage or location of the proposed uses would require a modification to the conditional use permit. Mr. Scandiffio said he understood any changes would require a modification. He said they plan to rough grade in November and start the buildings in January. Hearing no further testimony, Chairman McNiel closed the public hearing. Commissioner Vallette stated she had initially had concerns when the original project was approved that it would end up with a lot of small retail shops rather than the larger uses related to its industrial area. She was concerned about approving small shops without any of the major supporting tenants such as is typical in the Industrial Area Specific Plan. Commissioner Melcher shared Commissioner Vallette's concerns but he felt that the location of Building 7 at the activity center may benefit the project. He thought Commissioner Vallette's concerns should be considered for the balance of the project. Commissioner Chitlea shared the concerns but thought the uses at the proposed location may vitalize the center. She said she would not want to see the same types of uses in all the additional buildings. COMMISSION BUSINESS Brad Bullet, City Planner, suggested that the Commission schedule a workshop following the the Planning Commission meeting on October 13 regarding Building X at Tetra Vista Town Center. It was the consensus of the Commission that would be acceptable. Planning Commission Minutes -8- September 22, 1993 Commissioner Vallette presented her notes from the Route 30 meeting which was held on September 21, 1993. There was a brief discussion about the design elements of the project and the fact that any costs for upgrades would have to be borne by the local entities. , , , , Chairman McNiel asked if any of the Commissioners had attended the Route 66 meeting held on September 13. Commissioner Vallette gave a brief description of the meeting. She said the purpose of the meeting was to begin to formulate plans for a recommendation to Congress as to what type of recognition should be afforded to Route 66. Brad Buller, City Planner, added that Associate Planner Anthea Hartig and City Treasurer Jim Frost were also present. , , , , Commissioner Melcher asked when the next Historic Preservation Commission orientation could be scheduled. It was the consensus of the Commission to schedule an orientation workshop on October 13, 1993, following the workshop on Building X at Tetra Vista Town Center. , , , , , ADJOURNMENT Motion: Moved by Chitiea, seconded by Vallette, carried 4-0-1 with Tolstoy absent to adjourn. 8:30 p.m. - The Planning Commission adjourned.
