CEQA Guidelines Section 15162 states that no subsequent or supplemental review is necessary if the scope of the project has not changed from that considered as part of the original CEQA review Modified Condition of Approval • If deemed necessary by the City Attorney, the applicant shall amend the related Disposition, Development, and Loan Agreement, as amended, between the City and Day Creek Senior Housing Partners, LP, prior to filing the final parcel map with the City Engineer in order to address the consequences of separate ownership interests that may be created by the proposed subdivision of air space. Staff Recommendation • Staff recommends approval of Tentative Parcel Map SUBTPM20032. • All applicable Conditions of Approval related to Design Review DRC2016-00804 shall apply to Tentative Parcel Map SUBTPM20032. • Add new Condition of Approval related to the potential modification of the Disposition, Development, and Loan Agreement that was approved between the City and the applicant with the original project. The project site is located within the General Industrial District. According to the Development Code, recreational vehicle and personal storage facilities are a permitted use within this District subject to the approval of a Conditional Use Permit. Conditional Use Permit DRC2018=00234 The 3 findings below must be supported by facts in order to approve the Conditional Use Permit: Finding #1: The proposed use is allowed within the applicable zoning district and complies with all other applicable provisions of this Development Code, General Plan, and any City regulations/standards; Conditional Use Permit DRC2018=00459 Finding ##2: The site is suited for the type and intensity of the proposed use including access, utilities, and the absence of physical constraints and can be conditioned to meet performance criteria and standards; and Finding #3: Granting the permit would not be detrimental to the public interest, health, safety, convenience, or welfare, or materially injurious to persons, property, or improvements in the vicinity. Design and Technical Review Committees • The proposed project was reviewed by the Design Review Committee and Technical Review Committee on September 4, 2018; • No significant issues with the project were identified and the conditions of approval were accepted by the applicant; • Both Committees accepted Staff recommendation to approve the project as proposed, and recommend approval to the Planning Commission.
