Mayor Michael called the meeting to order at 5:00 p.m. Present were Council Members: Ryan Hutchison, Kristine Scott, Sam Spagnolo, Mayor Pro Tern Lynne Kennedy and Mayor L. Dennis Michael. Also present were: John Gillison, City Manager; James L. Markman, City Attorney; Lori Sassoon, Deputy City Manager/Administrative Services; Elisa Cox, Deputy City Manager/Cultural & Civic Services; Matt Burris, Deputy City Manager/Economic and Community Development. No public communications were made. No discussion or actions were taken. D.1. CONFERENCE WITH REAL PROPERTY NEGOTIATORS PER GOVERNMENT CODE SECTION 54956.8 FOR PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF HAVEN AVENUE AND JERSEY BOULEVARD IDENTIFIED AS PARCEL NUMBERS 0209-131-01; NEGOTIATING PARTIES JOHN GILLISON, CITY MANAGER, REPRESENTING THE CITY OF RANCHO CUCAMONGA, AND POWER MEDIC TECHNOLOGIES, INC., THE PROPERTY OWNER; REGARDING PRICE AND TERMS OF PAYMENT. — CITY The closed session recessed at 6:15 p.m. February 20, 20191 Fire Protection District, Housing Successor Agency, Successor Agency, Public Finance Authority and City Council Regular Meetings Minutes City of Rancho Cucamonga I Page 1 of 8 The regular meetings of the Rancho Cucamonga Fire Protection District, Housing Successor Agency, Successor Agency, Public Finance Authority and the City of Rancho Cucamonga City Council were held on February 20, 2019 in the Council Chambers at City Hall, located at 10500 Civic Center Drive, Rancho Cucamonga, California. Mayor Michael called the meeting to order at 7:00 p.m. Present were Council Members: Ryan Hutchison, Kristine Scott, Sam Spagnolo, Mayor Pro Tern Lynne Kennedy and Mayor L. Dennis Michael. Also present were: John Gillison, City Manager; James L. Markman, City Attorney; and Linda A. Troyan, City Clerk Services Director. Boy Scouts Troop 634 led the Pledge of Allegiance. Mayor Michael announced Public Hearing item No. 12 will not be heard and has been cancelled. Mayor Pro Tern Kennedy announced that at the conclusion of the City Council meeting, there will be a moment of silence and the meeting will be adjourned in memory of Marian Michael, the Mayor's Mother. Mayor Pro Tem Kennedy and Members of the City Council presented a Certificate of Sympathy to Mayor Michael and his wife and expressed heartfelt condolences to the Michael family. Frank Atry spoke about excessive city employee salaries Janet Walton offered a prayer. Sean Lopez, Center for Contract Compliance, informed Council that through his investigation he found a prevailing wage violation by the city's tree maintenance contractor and asked Council to remove item G10 from the agenda and explore other options. Mr. Lopez displayed a document and provided correspondence to the City Clerk. Gus Franklin commented that United Pacific does pay prevailing wage and has provided documents to the City and has submitted certified reports to the state on a monthly basis; he also commented that the union is trying to put private contractors out of business; and spoke on not being in violation of payroll requirements and on the City's ten year contract. Consideration to Approve Bi-Weekly Payroll in the Amount of $593,706.28 and Weekly Check Registers (Excluding Checks Issued to Southern California Gas Company) in the Amount of $155,360.06 Dated January 29, 2019 Through February 11, 2019. C.3. Consideration to Approve Weekly Check Registers for Checks Issued to Southern California Gas Company in the Amount of $3,408.24 Dated January 29, 2019 Through February 11, 2019. CA Consideration to Receive and File Current Investment Schedule as of January 31, 2019. C.S. Approval to Adopt Annual Statement of Investment Policy. MOTION: Moved by Board Member Spagnolo, seconded by Board Member Hutchison, to approve Consent Calendar Item C1 through C5. Motion carried unanimously, 5-0, with Council Member Scott abstaining from item C3. D.1. Consideration of Meeting Minutes: Regular Meetings of September 5, 2018, September 19, 2018 and February 6, 2019. MOTION: Moved by Agency Member Scott, seconded by Agency Member Spagnolo, to approve Consent Calendar D1. Motion carried unanimously, 5-0. E.1. Consideration of Meeting Minutes: Regular Meetings of September 5, 2018, September 19, 2018 and February 6, 2019. MOTION: Moved by Agency Member Hutchison, seconded by Agency Member Council Member Scott, to approve Consent Calendar E1. Motion carried unanimously, 5-0. F.1. February 20, 20191 Fire Protection District, Housing Successor Agency, Successor Agency, Public Finance Authority and City Council Regular Meetings Minutes City of Rancho Cucamonga I Page 3 of 8 In response to the comments received on item G10, City Manager Gillison advised that he did not have the opportunity to review the documentation received and will it review with the City Attorney; and recommended Council approve the item subject to his review with the City Attorney based on the need to continue having tree services in the City and the City's ability to have a new bid process in place. Consideration to Adopt a Resolution Updating the Rancho Cucamonga City Employees Association and Teamsters Local 1932 Salary Schedules for Fiscal Year 2018-19. RESOLUTION NO. 19-010 A RESOLUTION UPDATING THE RANCHO CUCAMONGA CITY EMPLOYEES ASSOCIATION AND TEAMSTERS LOCAL 1932 SALARY SCHEDULES FOR FISCAL YEAR 2018-19 MOTION: Moved by Council Member Hutchison, seconded by Mayor Pro Tern Kennedy, to approve Consent Calendar Item G1 through G15. Motion carried unanimously, 5-0, with Council Member Scoff abstaining from item C3. No Items. 1.1. Summary of Public Safety Response to 2018 Holiday Lights Display and Recommendations for 2019 Holiday Season. City Manager Gillison introduced RCPD Corporal Brett Haynes, who gave the staff report. Mayor Michael opened the Administrative Hearing item. Lynn Witney, asked the Council to remove no walking restrictions from December 6-8th, 2019 to allow residents to enjoy the holiday display area. Gary Witney, asked to have a compromise and allow pedestrians the ability to walk the streets the first week in December and enjoy the holiday lights. Kathleen Sager, spoke in support of having pedestrians in the area and not lose the holiday spirit. Brent Stoddard, asked the Council to remove the pedestrian restriction on the first weekend after thanksgiving, December 6-81h for families to experience the holiday light displays. Jada Teran, recommended the first weekend in December be open to pedestrians. Leo Padilla, spoke on walking the streets in the past and maintaining that tradition. Staff received an email from Herbert and Cindy Siegmund thanking the Police Department and City for implementing a change and resolving a hazardous situation on Thoroughbred Streets and recommended no walking on the streets. Staff also received an email from Kim Earl recommending removing no walking restrictions during the first two weekends in December, having the third weekend as Drive-Thru only and for February 20, 20191 Fire Protection District, Housing Successor Agency, Successor Agency, Public Finance Authority and City Council Regular Meetings Minutes City of Rancho Cucamonga I Page 5 of 8 the City to decide on weekdays. Ms. Earl also recommended leaving the No Parking signs up all year round. Mayor Michael closed the Administrative Hearing item. Discussion ensued on hearing more information from staff on requests received; concerns addressed by neighboring residents due to pedestrians walking the neighborhoods; no parking signs all year round; public safety costs and timeframe of police enforcement in neighborhood. After discussion, Mayor Michael recommended having the same plan this year unless staff has a compelling reason for a new recommendation. Council Member Hutchison asked if the City can look at having one day for pedestrian walking. City Manager Gillison shared that staff has received a sense of direction and will go over requests with the Police Department for any potential possibilities. City Council received and filed report. J.1. Public Hearing to Consider Certain Fees in the Police Department Relating to Towing Services. RESOLUTION NO. 19-008 A RESOLUTION OF THE CITY COUNCIL OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING A FEE SCHEDULE APPLICABLE TO CERTAIN POLICE DEPARTMENT FEES RELATING TO TOWING SERVICES, AND REPEALING RESOLUTION 17-037 City Manager Gillison introduced RCPD Sergeant, James Snow, who gave the Staff Report. Mayor Michael opened the Public Hearing. Frank Atry spoke in regards to excessive police department salaries. Max Cherubil commented that he has witnessed towing companies leave accident debris on roadways after traffic collisions. Mayor Michael closed the Public Hearing. Discussion ensued on how other cities charge tow companies to recover costs. MOTION: Moved by Mayor Pro Tern Kennedy, seconded by Council Member Spagnolo, to adopt Resolution No. 19- 008. Motion carried unanimously, 5-0. Consideration of a Resolution of Necessity Declaring Certain City -Owned Real Property Interests, Previously Acquired as a Portion of San Bernardino County Assessor's Parcel Number 0209-131-01, Necessary for Public Purposes in Connection with and to Allow for the Establishment and Maintenance of a Public Utility Facility Located on the Northwest Corner of Haven Avenue at Jersey Boulevard. PUBLIC HEARING WAS CANCELLED K.1. Consideration to Receive and File Midyear Financial Update for the Six Month Period Ended December 31, 2018 and to Approve Midyear Additional Appropriations. City Manager introduced Finance Director, Tamara Layne, who gave the staff report. MOTION: Moved by Council Member Spagnolo, seconded by Council Member Scott, to receive and file report and approve Midyear Additional Appropriations. K.2. Consideration of the 2019 Legislative Platform. City Manager Gillison introduced Principal Management Analyst, Fabian Villenas, who gave the staff report. Mayor Michael and Council Members Scott and Hutchison thanked staff for putting the report together. MOTION: Moved by Council Member Scott, seconded by Mayor Pro Tern Kennedy, to approve the 2019 Legislative Platform. Motion carried unanimously, 5-0. L.I. Consideration to Approve the Appointments of Two Members to the Public Art Committee. MOTION: Moved by Mayor Pro Tern Kennedy, seconded by Council Member Scott, to approve the appointment of Planning Commissioner Lou Munoz and re -appointment of Community and Arts Foundation Board Member Linda Bryan to the Public Art Committee. Motion carried unanimously, 5-0. L.2. COUNCIL ANNOUCEMENTS Mayor Pro Tern Kennedy thanked Public Works staff for their work during the rainy season and announced an Open House, Science Technology Engineering Math (STEM) event at Chaffey College, March 2nd from 11 am to 1 pm for anyone that is interested. Council Member Scott reported that she met the day before in Sacramento with the Governor and other Central Valley and Inland Empire leaders through a new coalition called, Inland California Rising, to help address issues in the Inland Empire and shared that there will be three summits in the year ahead.
