HomeMy WebLinkAbout378 - OrdinancesORDINANCE NO. 378 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA, CALIFORNIA, RECOMMENDING APPROVAL OF ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT DISTRICT AMENDMENT 88-07 (ANMANSON DEVELOPMENTS, INC. ), A PRE-ZONE OF APPROXIMATELY 53 ACRES OF VACANT LAND LOCATED AT THE SOUTHWEST CORNER OF ETIWANDA AVENUE AND 25TH STREET TO LOW DENSITY RESIDENTIAL (2-4 DWELLING UNITS PER ACRE), AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals. (i) Ahmanson Developments, Inc. has filed an application for Development District Amendment 88-07 as described in the title of this Ordinance. Herelnafter in this Ordinance, the subject Development District Amendment is referred to as "the Application". (ii) On October 26, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the Application concluded said hearing on that date, and recommended approval. (iii) On November 16, 1988, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the Application. (iv) All legal prerequisites to the adoption of this Ordinance have occurred. B. Ordinance. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and ordain as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. 2. In conj unction with this Development Agreement, an Environmental Assessment, in conformance with the requirements of the California Environmental Quality Act, has been prepared. The Council has determined that this project would not have a significant adverse effect on the environment, hereby adopts a finding of no significant impact on the environment and issues a Negative Declaration. 3. Based upon substantial evidence presented during the above referenced public hearings on October 26, 1988 and November 16, 1988, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: Ordinance No. 378 Page 2 (a) The subject property is suitable for the uses permitted in the proposed Development District in terms of access, size, and compatibility with existing land use in the surrounding area; and (b) The proposed Development District pre-zone would not have significant adverse impacts on the environment, nor the surrounding properties; and (c) The proposed Development District pre-zone is in conformance with the General Plan. 4. The City Council of the City of Rancho Cucamonga hereby approves the Application. 5. The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
