PUBLIC COMMUNICATIONS This is the time and place for the general public to address the Historic Preservation Commission or Planning Commission on any item listed or not listed on the agenda. State law prohibits the Commission from addressing any issue not previously included on the Agenda. The Commission may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Chair, depending upon the number of individual members of the audience. This is a professional business meeting and courtesy and decorum are expected. Please refrain from any debate between audience and speaker, making loud noises or engaging in any activity which might be disruptive to the decorum of the meeting. Ernest Valencia resident, spoke in opposition to items E4-E5 under both the Public Communications and Public Hearing sections, because of concerns with traffic, loss of park views, reduction of property values, and safety caused by the increase in enrollment from the expansion. He also suggested changing the configuration of the expansion by moving the existing parking lot into the empty space and building the new building in the existing parking lot. C. CONSENT CALENDAR/HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION The following Consent Calendar items are expected to be routine and non-controversial. They will be acted upon by the Commission at one time without discussion. Any item may be removed for discussion. C1. Consideration to adopt Regular Meeting Minutes of August 22, 2018 Moved by Munoz, seconded by Oaxaca, carried 4-0-1 (Wimberly absent) to adopt the Consent Calendar. D. ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT MAP SUBTT20140 – PARKVIEW FINANCIAL - A proposal to subdivide a vacant 9.11 acre parcel into 14 residential lots for future single-family development within the Very Low (VL) Residential District of the SEPTEMBER 26, 2018 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 3 of 12 Etiwanda Specific Plan located at 6527 Etiwanda Avenue; APN 0227-051-03. Related Files: Tree Removal Permit DRC2017-00823 and Sign Permit Notice of Filing DRC2017-00824. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. E2. ENVIRONMENTAL ASSESSMENT AND TREE REMOVAL PERMIT DRC2017-00823 – PARKVIEW FINANCIAL - A request to remove 13 Blue Gum Eucalyptus Heritage Trees within the Very Low (VL) Residential district, Etiwanda Specific Plan located at 6527 Etiwanda Avenue – APN: 0227-051-03. Related Files: Tentative Tract Map SUBTT20140 and Sign Permit Notice of Filing DRC2017-00824. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. Vincent Acuna, Assistant Planner gave the staff report and PowerPoint presentation (copy on file). He noted correspondence received from South Coast Air Quality Management District requiring a health risk assessment be provided on-site because the subdivision will be located within 500 feet of the 210 freeway. In response, staff has added a condition of approval to require a health risk assessment addressing air quality be done upon development of the subdivision. He noted the updated conditions of approval were on the dais. Applicant Andrew Benton from Parkview Financial asked if there was anything specific he should address about the project No questions were raised by the Commissioners. Chairman Macias opened the public hearing. Linda Dalton and unnamed resident spoke against the project citing concerns with traffic and the removal of the trees. Karen (no last name) said the City has an obligation to remove the unhealthy trees but she would like to see the healthy tree stay where it is. She also said the project will cause the loss of a corridor for coyotes to come through the field. Mr. Benton responded to the public comments stating an arborist was hired to analyze the trees and the report determined that out of 13 trees, 12 were dead or almost dead and the one remaining living tree be relocated. It was also recommended that each removed Eucalyptus tree be replaced with a healthy Eucalyptus tree on a one to one basis. Additionally, two new trees will be planted in every lot. SEPTEMBER 26, 2018 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 4 of 12 Vince Acuna said staff has reviewed the arborist report and confirms that each removed Eucalyptus tree will be replanted with a healthy one and there will be two trees planted in every front yard. Chairman Macias closed the public hearing. Commissioner Munoz, Vice-Chairman Guglielmo, and Commissioner Macias all agreed they were in favor of the applications because there was plan for re-planting trees after removal. Commissioner Oaxaca was also in agreement and stated the life span of existing trees are coming to an end, but the City’s requirements to replace the dead trees with healthy trees in multiples, puts the City on a path to continue to focus on healthy trees for Rancho Cucamonga to beautify the neighborhoods. Moved by Munoz, seconded by Guglielmo, carried, 4-0-1 (Wimberly absent) to adopt the proposed Mitigated Negative Declaration of environmental impacts and the Resolutions approving the Tentative Tract Map SUBTT20140 and Tree Removal Permit DRC2017-00823 as presented by staff. E3. ENVIRONMENTAL ASSESSMENT AND DESIGN REVIEW DRC2018-00104 – SC RANCHO DEVELOPMENT CORP. – A request for site plan and architectural review of a proposed 10,243 square foot recreational building, two ancillary support buildings totaling 1,541 square feet, and an outdoor recreation area on a vacant site totaling 1.93 acres of land within the Empire Lakes Specific Plan, Planning Area 1, located north of 4th Street, south of 6th Street, west of Milliken Avenue, and east of Utica/Cleveland Avenues. The specific location of the project site is at the southeast corner of 6th Street and the future alignment of the Resort Parkway; APN: 0210-102-01, -02 and -03. Related file: Pre-Application Review DRC2017- 00885. Pursuant to the California Environmental Quality Act (CEQA), the City certified an Environmental Impact Report (EIR) (SCH No. 2015041083) on May 18, 2016 in connection with the City’s approval of General Plan Amendment DRC2015-00114, Specific Plan Amendment DRC2015-00040, and Development Code Amendment DRC2015-00115. Pursuant to CEQA Guidelines Section 15162, no subsequent or supplemental EIR is required in connection with subsequent discretionary approvals of the same project. Dat Tran, Assistant Planner gave the staff report and PowerPoint presentation (copy on file). Tim McGinnis representing the applicant, SC Rancho Development Corp. offered to answer any questions and stated the architect and landscape architect were also available to answer questions. Dat Tran answered that the recreation area is for the Empire Lakes area and the residential properties in Empire Lakes. Chairman Macias closed the public hearing. Commissioner Munoz and Commissioner Oaxaca, and Chairman Macias commented that the project was well-designed, in line with the Specific Plan, good for the City, and recommends approval. Moved by Munoz, seconded by Oaxaca, carried 4-0-1 (Wimberly absent) to adopt the Resolution approving Design Review DRC2018-00104 as presented by staff. E4. CONDITIONAL USE PERMIT DRC2018-00092 – SAINT MARY’S MONTESSORI - A request to establish a combination child care and preschool/elementary school use in an existing 6,600 square foot building and in a proposed 9,974 square foot addition on 1.85 acres of land, located in the Low-Medium (LM) Residential District, Victoria Planned Community, north of North Victoria Windrows Loop and south of Plum Way; APN: 1089-471-25. Related file: Minor Design Review DRC2018-00095. This item is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section 15301 – Existing Facilities and CEQA Section 15303 – New Construction or Conversion of Small Structures. E5. MINOR DESIGN REVIEW DRC2018-00095 – SAINT MARY’S MONTESSORI – A request for site plan and architectural review of a proposed 9,974 square foot addition and outdoor play areas to an existing 6,600 square foot child care facility on 1.85 acres of land, located in the Low-Medium (LM) Residential District, Victoria Planned Community, north of North Victoria Windrows Loop and south of Plum Way; APN: 1089-471-25. This item is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section 15303 – New Construction or Conversion of Small Structures. Chris Jayawardana, the applicant, provided background on the Montessori method and the existing St. Mary’s Montessori, as well as the success of the current drop-off and pick up procedure SEPTEMBER 26, 2018 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 6 of 12 Commissioner Oaxaca asked what the current number of students and staff is on-site daily. Mr. Jayawardana answered there are currently 139 families registered in two and three-day programs, which is approximately 100 students attending daily, and 28 staff members at the corporate office in Haven who work on a part-time and full-time shift basis at the school. Commissioner Oaxaca asked how many staff are on-site daily. Mr. Jayawardana replied there are 13-15 staff present on-site in a typical day. Chairman Macias opened the public hearing. Ernest Valencia and Misty Dodson spoke in opposition to the project under Public Communications and Public Hearing. Their comments are under the Public Communications section Kayla Nelson, David Meade, Kevin Greneke, Melissa Rojas, Susan G, Humphrey, Yurial Hada, Norma Ferrufino, Tanya Beach, Christina Larson, Josh Regalado, Tracy Lopez, Elizabeth Torres, Michael R., Carmen, Desiree Martinez, Mallory G., Elizabeth Perez, Chun Chiang, Michael Turner, John Shepard, Visant S., and Gabby Sheldon all spoke in favor of project citing the following reasons: the high quality of the education provided at St. Mary’s Montessori, the advantages of the Montessori teaching method, the commitment and dedication of the owners who run the school, the care they provide to the children, ease of drop off and pick up because of staggered start and stop times, limitation in choice of private schools in the City, the need for more schooling options due to the increase in population, and the increase in property value due to having a high-quality school in the area. Linda Dalton spoke in opposition of the project citing loss of park views. Desiree and Michael Brown, residing at 6840 Plum Way, spoke against the project because of issues relating to increased traffic, less parking, public safety, increased noise, and higher levels of pollution that could be caused by the expansion. They said they would like the expansion to go through with some modifications or see a crosswalk put in near the site. Chairman Macias closed the public hearing and re-opened it to allow the applicant to respond to the comments. SEPTEMBER 26, 2018 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 7 of 12 Mr. Jayawardana responded to comments by stating he has been working with some of the residents with their issues regarding loss of views and stated that the grading of the building will be dropped by 5 feet minimizing the loss of views for some residents. He further stated that traffic will be minimized because the maximum capacity of the school won’t be reached for another 5-7 years and he has offered the parking code to residents on Plum Way so they can use the parking lot for neighborhood events. Chairman Macias closed the public hearing. Commissioner Munoz said he appreciates everyone’s feedback, there are no automatic approvals, and he has empathy for those speaking against the project and advised them to work with the school. He sees the applicant and staff have put mitigation measures in place to address the potential impacts. Mike Smith, Senior Planner, and Albert Espinoza, Assistant City Engineer, responded to questions raised by the speakers in opposition to the project pertaining to the project layout, parking, noise impacts, traffic, and loss of views by referencing the staff report and the noise and traffic study. Commissioner Oaxaca stated he appreciates staff clarifying some of the issues related to traffic and noise and sees that every possible issue has been addressed and noted conditional use permits have conditions and can be revisited if conditions are not being met. He advised the applicant to read the conditions of approval carefully. Vice-Chairman Guglielmo and Chairman Macias both agreed that the project is an attractive, well-thought out functional design and meets all landscape and parking requirements, and development codes. Moved by Guglielmo, seconded by Oaxaca, carried 4-0-1 (Wimberly absent) to adopt the Resolutions approving the Conditional Use Permit DRC2018-00092 and Minor Design Review DRC2018-00095 as presented by staff. Chairman Macias called a 5-minute recess. E6. A Mitigated Negative Declaration of environmental impacts was prepared for consideration. Dominick Perez, Associate Planner, stated that the applicant has requested a continuance to the October 24, 2018 Planning Commission meeting to adequately review and respond to the last-minute correspondence received opposing the project citing issues with the design of the SEPTEMBER 26, 2018 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 10 of 12 project as well as the proposed Mitigated Negative Declaration. Correspondence included a signed petition from residents, letters from Golden State Environmental Justice Alliance and a resident, and a 380-page document from Manatt, Phelps, and Phillips LLP. on behalf of Hofer Properties LLC. He noted the correspondence has been place on the dais for the Commissioner’s review. Steven Flower, Assistant City Attorney, clarified that although the applicant has requested a continuance to October 24, 2018, if there is further evaluation needed, the item could be continued to a later date and will be re-advertised and re-noticed at that time so the item will be continued to a date unspecific if the Commission passes the motion to continue the items. Chairman Macias informed the audience that no action will be taken at this time due to the request for continuance and opened the public hearing. Viral Metha, counsel for Hofer properties, said he submitted the letter of concern with exhibits and stated their objection to the project and wants the document and the objection to be part of the public record. Antonio spoke in opposition of the project due to concerns with traffic generated from the project and off-site parking. Kevin Kenley, lives on 26th Street, stated he submitted the petition opposing the project. JoAnn Hinkel spoke in opposition of the project citing issues with the application classification of parking reductions in that area and the reduction in parking resulting in less parking than what the Rancho Cucamonga code requires. Adam Salcido, who submitted the letter on behalf of Golden State Environmental Justice Alliance, spoke in opposition of the project and said he would like the Commission to review the document before making a decision recommending approval or disapproval of the project. He further stated they believe the Mitigated Negative Declaration is a flawed document and a full Environmental Impact Report should be completed. Kim Earl spoke in opposition of the project due to the large building size and other large high- density buildings throughout Ranch Cucamonga. She also objected to the reduced parking, off-site parking, traffic issues, and over-building of the City. She also stated she objects to the amendments to the General Plan for projects instead of following the General Plan as written. Christine Hebert, George Garcia, Melinda Ryan, and Lashanda Shipp all spoke in opposition to the project citing concerns with over-building, traffic, public safety issues, reduced setbacks, reduction in parking, building of high-density developments, and lack of green area. To allow all persons to speak, given the length of the agenda, please keep your remarks brief. If others have already expressed your position, you may simply indicate that you agree with a previous speaker. If appropriate, a spokesperson may present the views of your entire group. To encourage all views and promote courtesy to others, the audience should refrain from clapping, booing or shouts of approval or disagreement from the audience. The public may address the Planning Commission on any agenda item. To address the Planning Commission, please come forward to the podium located at the center of the staff table. State your name for the record and speak into the microphone. After speaking, please sign in on the clipboard located next to the speaker’s podium. It is important to list your name, address and the agenda item letter your comments refer to. Comments are generally limited to 5 minutes per individual. If you wish to speak concerning an item not on the agenda, you may do so under “Public Comments.” There is opportunity to speak under this section prior to the end of the agenda. Any handouts for the Planning Commission should be given to the Planning Commission Secretary for distribution to the Commissioners. A copy of any such materials should also be provided to the Secretary to be used for the official public record. These documents are available for public inspections during regular business hours, Monday through Thursday, 7:00 a.m. to 6:00 p.m., except for legal City holidays. APPEALS Any interested party who disagrees with the City Planning Commission decision may appeal the Commission’s decision to the City Council within 10 calendar days. Any appeal filed must be directed to the City Clerk’s Office and must be accompanied by a fee of $2,793 for all decisions of the Commission. (Fees are established and governed by the City Council).
