B. PUBLIC COMMUNICATIONS This is the time and place for the general public to address the Historic Preservation Commission or Planning Commission on any item listed or not listed on the agenda. State law prohibits the Commission from addressing any issue not previously included on the Agenda. The Commission may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Chair, depending upon the number of individual members of the audience. This is a professional business meeting and courtesy and decorum are expected. Please refrain from any debate between audience and speaker, making loud noises or engaging in any activity which might be disruptive to the decorum of the meeting. Gwyn Frost and Luana Hernandez spoke to the Historical Preservation Commission to note all of the historical landmarks within each of the Council Districts. District 2 this evening included the Cucamonga Service Station, and Route 66, the Alta Loma Fire House, and the Virginia Dare Winery. They are interested in a brochure to be published that would be put in hotels in the area to show off Rancho Cucamonga. MARCH 27, 2019 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 2 of 7 Cherry Dobbs, resident, spoke regarding the Museum of Arts in Ontario with an invitation to their fundraiser on April 25, 2019. The funds will be used with other museums in the region to partner with. A small museum with not a lot of room for educational programs. The Maloof Foundation, Randall Lewis and family and Tony Sheets will be honored. Closed public communications. C. CONSENT CALENDAR/HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION The following Consent Calendar items are expected to be routine and non-controversial. They will be acted upon by the Commission at one time without discussion. Any item may be removed for discussion. C1. Consideration to adopt the Regular Meeting Minutes of March 13, 2019. Moved by Oaxaca, seconded by Dopp; carried 4-1-0 (Wimberly abstain) to adopt the minutes. C2. Consideration to adopt the Meeting (Workshop) Minutes of March 13, 2019. Moved by Munoz, seconded by Oaxaca; carried 4-1-0 (Wimberly abstain) to adopt the Workshop minutes. D. PUBLIC HEARINGS/PLANNING COMMISSION The following items have been advertised and/or posted as public hearings as required by law. The Chairman will open the public hearing to receive testimony. All such opinions shall be limited to 5 minutes per individual or less as determined by the Chairman. Please sign in after speaking. MARCH 27, 2019 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 3 of 7 D1. ENVIRONMENTAL ASSESSMENT AND DESIGN REVIEW DRC2018-00119 – OVERTON MOORE PROPERTIES – The proposed development of a 174,745 square foot industrial warehouse building on 8.09 acres in the General Industrial (GI) District, at the southwest corner of Hellman Avenue and Eighth Street, located at 9000 Hellman Avenue; APN: 0209- 151-36. Staff is reviewing a Mitigated Negative Declaration prepared per State CEQA Guidelines for consideration of environmental impacts. Tom Grahn, Associate Planner, stated that this project was originally scheduled for March 13, 2019 but he received additional comments on March 11, 2019 from Golden State Environmental Justice Alliance. To allow for time for staff to review and forward the comments to the Commission, the item was recommended to be continued to the Planning Commission meeting on March 27, 2019. South Coast Air Quality and Golden State Environmental Justice Alliance were the only responses to the Initial Study received. Only Golden State Environmental Justice Alliance had additional comments and concerns. Due to an additional mitigation measure on the project staff requested not to act on the project at this time and will recirculate the project and continue to a date unspecific. Public hearing opened. Patrick Haniger with Golden State Public Alliance spoke regarding several items that they noted in their comment letter. They request a full EIR to be prepared for this project. Closed the public hearing. Continued to a date unspecified. Items D2, D3, D4 and D5 will be taken simultaneously. D2. ENVIRONMENTAL ASSESSMENT AND DESIGN REVIEW DRC2018-00326 – CHARLES JOSEPH ASSOCIATES – A request to demolish an existing metal industrial building of approximately 13,000 square feet in conjunction with a request for site plan and architectural review to construct a 58,130 square foot industrial office, manufacturing and warehouse building on 2.76 acres of land within the Industrial Park (IP) District located at 10234 4th Street; APN: 0210-371-01. Related Files: Variance DRC2018-00760, Minor Exception DRC2018-00761 and Minor Exception DRC2018-00762. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. MARCH 27, 2019 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 4 of 7 D3. ENVIRONMENTAL ASSESSMENT AND VARIANCE DRC2018-00760 – CHARLES JOSEPH ASSOCIATES – A request to reduce the required amount of truck trailer stall parking from 4 stalls to 1 stall related to a proposed project consisting a 58,130 square foot industrial office, manufacturing and warehouse building on 2.76 acres of land within the Industrial Park (IP) District located at 10234 4th Street; APN: 0210-371-01. Related Files: Design Review DRC2018-00326, Minor Exception DRC2018-00761 and Minor Exception DRC2018-00762. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. D4. ENVIRONMENTAL ASSESSMENT AND MINOR EXCEPTION DRC2018-00761 – CHARLES JOSEPH ASSOCIATES – A request to reduce the required amount of vehicle parking from 96 parking stalls to 74 parking stalls related to a proposed project consisting a 58,130 square foot industrial office, manufacturing and warehouse building on 2.76 acres of land within the Industrial Park (IP) District at 10234 4th Street; APN: 0210-371-01. Related Files: Design Review DRC2018-00326, Variance DRC2018-00760 and Minor Exception DRC2018-00762. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. D5. ENVIRONMENTAL ASSESSMENT AND MINOR EXCEPTION DRC2018-00762 – CHARLES JOSEPH ASSOCIATES – A request to reduce the required minimum 5 foot side yard building setback to 4 feet 6 inches related to a proposed project consisting a 58,130 square foot industrial office, manufacturing and warehouse building on 2.76 acres of land within the Industrial Park (IP) District at 10234 4th Street; APN: 0210-371-01. Related Files: Design Review DRC2018-00326, Variance DRC2018-00760 and Minor Exception DRC2018-00761. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. Mike Smith, Senior Planner, presented the Staff Report. Associated with these applications, while in circulation, agencies received blank CD’s through a technical error. To comply with CEQA, new CD’s were prepared and remailed. Due to these issues the project was postponed and staff is requesting a continuance to April 10, 2019. Chairman Guglielmo opened the Public Hearing and hearing no public comments, the item was continued until April 10, 2019. MUNICIPAL CODE AMENDMENT DRC2019-00120 – CITY OF RANCHO CUCAMONGA – A request to amend Title 17 of the Municipal Code pertaining to standards and land use regulations for car wash uses. This item is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section 15061(b)(3). This item will be forwarded to the City Council for final action. Perry Banner, Contract Planner with Jennifer Nakamura, Associate Planner, gave the staff report and PowerPoint presentation (copy on file). Mr. Banner noted that existing operators went through the CUP process that addressed their hours of operation. All current hours of operation will continue as in their CUP. Commissioner Dopp asked about the focus groups and what the feedback was from the community. Letters were sent out to all 15 City car wash owners with two car wash owners attending. An informal conversation provided excellent feedback to staff. Chairman Guglielmo enquired about the enforcement of the mobile operators. Ms. Nakamura stated that a flyer would be given to operators with their business license. The Community Improvement Department would take the lead to investigate and determine whether any complaints are founded and for compliance. Chairman Guglielmo opened the public hearing and hearing none closed. Commissioner Munoz stated that this ordinance is proactive and consistent with Council Goals and timely. He noted that it is excellent regarding protecting our residents especially regarding vacuuming and noise. Commissioner Wimberly concurred. Commissioner Oaxaca supports this ordinance especially the zoning for acceptable locations. Commissioner Dopp concurred and appreciated the staff’s diligence. He appreciated our being proactive with water recycling and our resources. Chairman Guglielmo concurred and noted that he appreciated staff reaching out to the community. Moved by Munoz, second by Wimberly; carried 5-0-0. to recommend item be forwarded to City Council for action. E. COMMISSION BUSINESS/HISTORIC PRESERVATION AND PLANNING COMMISSION INTER-AGENCY UPDATES: Commissioner Munoz thanked the City Council for the joint meeting last week and the great exchange of ideas regarding the General Plan update. COMMISSION ANNOUNCEMENTS: None. F. To allow all persons to speak, given the length of the agenda, please keep your remarks brief. If others have already expressed your position, you may simply indicate that you agree with a previous speaker. If appropriate, a spokesperson may present the views of your entire group. To encourage all views and promote courtesy to others, the audience should refrain from clapping, booing or shouts of approval or disagreement from the audience. The public may address the Planning Commission on any agenda item. To address the Planning Commission, please come forward to the podium located at the center of the staff table. It is important to list your name, address and the agenda item letter your comments refer to. Comments are generally limited to 5 minutes per individual. If you wish to speak concerning an item not on the agenda, you may do so under “Public Comments.” There is opportunity to speak under this section prior to the end of the agenda. Any handouts for the Planning Commission should be given to the Planning Commission Secretary for distribution to the Commissioners. A copy of any such materials should also be provided to the Secretary to be used for the official public record. All requests for items to be placed on a Planning Commission agenda must be in writing. Requests for scheduling agenda items will be at the discretion of the Commission and the Planning Director. AVAILABILITY OF STAFF REPORTS Copies of the staff reports or other documentation to each agenda item are on file in the offices of the Planning Department, City Hall, located at 10500 Civic Center Drive, Rancho Cucamonga, California 91730. These documents are available for public inspections during regular business hours, Monday through Thursday, 7:00 a.m. to 6:00 p.m., except for legal City holidays. APPEALS Any interested party who disagrees with the City Planning Commission decision may appeal the Commission’s decision to the City Council within 10 calendar days. Any appeal filed must be directed to the City Clerk’s Office and must be accompanied by a fee of $3,037 for all decisions of the Commission. (Fees are established and governed by the City Council).
