B. PUBLIC COMMUNICATIONS This is the time and place for the general public to address the Historic Preservation Commission or Planning Commission on any item listed or not listed on the agenda. State law prohibits the Commission from addressing any issue not previously included on the Agenda. The Commission may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Chair, depending upon the number of individual members of the audience. This is a professional business meeting and courtesy and decorum are expected. Please refrain from any debate between audience and speaker, making loud noises or engaging in any activity which might be disruptive to the decorum of the meeting. CONSENT CALENDAR/HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION JUNE 26, 2019 HISTORIC PRESERVATION COMMISSION AND PLANNING COMMISSION AGENDA MINUTES RANCHO CUCAMONGA CIVIC CENTER COUNCIL CHAMBERS 10500 CIVIC CENTER DRIVE RANCHO CUCAMONGA, CALIFORNIA Page 2 of 8 The following Consent Calendar items are expected to be routine and non-controversial. They will be acted upon by the Commission at one time without discussion. Any item may be removed for discussion. C1 & C2 Consideration to adopt the Regular Meeting Minutes of June 12, 2019. Consideration to adopt the Adjourned Workshop Meeting Minutes of June 12, 2019. Moved by Munoz, seconded by Dopp; carried 3-0-1, Oaxaca abstain, Wimberly absent. D. PUBLIC HEARINGS/PLANNING COMMISSION The following items have been advertised and/or posted as public hearings as required by law. The Chairman will open the public hearing to receive testimony. All such opinions shall be limited to 5 minutes per individual or less as determined by the Chairman. Please sign in after speaking. D1. and D2. DESIGN REVIEW DRC2018-00023 – CHRIST’S CHURCH OF THE VALLEY - A request for site plan and design review of a proposed expansion of an existing church facility including adding a new 36,000 square foot church auditorium and a new 11,400 square foot children's classroom building on a 9.7 acre project site located at the northwest corner of Etiwanda Avenue and Candlewood Street in the Office Professional (OP) District of the Etiwanda Specific Plan at 7576 Etiwanda Avenue; APN: 1090-411-01. Related Files: Conditional Use Permit DRC2018-00001 and Tree Removal Permit DRC2018-00843. The applicant has prepared a Mitigated Negative Declaration of environmental impacts for consideration. CONDITIONAL USE PERMIT DRC2018-00001 – CHRIST’S CHURCH OF THE VALLEY - A request to modify Conditional Use Permit DRC2017-00787 related to the expansion of an existing church facility including adding a new 36,000 square foot church auditorium and a new 11,400 square foot children's classroom building on a 9.7 acre project site located at the northwest corner of Etiwanda Avenue and Candlewood Street in the Office Professional (OP) District of the Etiwanda Specific Plan at 7576 Etiwanda Avenue; APN: 1090-411-01. Mike Smith, Principal Planner, gave the Staff Report and Power Point presentation (copy on file). Mr. Ghirelli stated that the tree removal permit was not included in the agenda description and will be reviewed by the Planning Director for approval. Mr. Smith stated that the tree removal permit will be a required condition and does not affect the review of the project at this time. Applicant Jim DiCamillo with WLC Architects stated that the seat count of the auditorium should read that they will have a maximum of 1100 seats with 765 fixed seats. Additional applicant Marco Eacrett, with Christ’s Church of the Valley, asked for clarification of the hours of operation stating that office staff, custodial staff and landscaping services are on site before 8:00am and after 10:00pm that is stated in the Staff Report. Mr. Smith stated that the hours of operation are relative to the church assembly hours. Additionally, the seat counts were noted for the fixed seats, but not for the amount of people present. Mr. Ghirelli noted that we would amend Condition 1 to state that the hours stated are limited to services and events. Mr. Eacrett asked if the condition could be amended to show that church services could be closer than 45 minutes apart. Mr. Smith recommended that the condition be kept in place and then reevaluated in approximately 6 months at the staff level. Mr. DiCamillo stated that the Staff Report notes that there will be tax income, but no property taxes are paid by churches. Mr. Burris stated that the language in the Staff Report is incorrect and there should be no fiscal impact. Mr. DiCamillo noted that was only for outside weddings in the front grassy area, but that they would hold more weddings inside the church. Chairman Guglielmo opened the public hearing. Richard Falk, a neighbor, was concerned about the noise impact including each week when the gardeners are mowing the property prior to 9:00am. Additionally, vehicle traffic was a concern, especially for a school. Mr. Eacrett is looking into the landscaper issue for him and assured the neighbor they would adjust the time. Commissioner Oaxaca asked about an additional entrance to the property. Mr. Smith noted that the church is adding an additional drive aisle at the northwest corner of the property. Mr. Eacrett noted this will not be operated as a school and will not have school related traffic issues. Commissioner Munoz noted that it is a good project. Commissioner Oaxaca agreed and noted their excellence in working with the community especially with the traffic circulation. Commissioner Dopp agreed and noted that the second entrance for the traffic management was well planned. Chairman Guglielmo concurred with the maximizing of the property usage and accommodating the neighbors. Mr. Ghirelli restated that the motion will be to adopt the Design Review and Conditional Use Permit. It will include modifications to the Resolution and Conditions of Approval that they will have 1,100 seats, with 765 fixed seats. Condition #1 will be modified to state that “hours of operation 8:00am to 10:00pm every day are limited to services and events”. Condition #5 will add “this condition will be revisited in 6 months and may be revised by the Planning Director if a shorter separation of services is sufficient time between services”. Moved by Munoz, seconded by Oaxaca; carried 4-0-1, Wimberly absent. D3. ENVIRONMENTAL ASSESSMENT AND DESIGN REVIEW DRC2018-00546 – DUKE REALTY – A review of a proposed industrial building with a floor area of 120,628 square feet on a parcel of 6.00 acres in the General Industrial (GI) and Industrial Park (IP) Districts, Haven Avenue Overlay District (HAOD), located on the west side of Haven Avenue south of 8th Street, at 8978 Haven Avenue; APNs: 0209-242-08 and 0209-251-11. A Mitigated Negative Declaration of environmental impacts has been prepared for consideration. Mike Smith, Principal Planner, gave the Staff Report and Power Point presentation (copy on file). Mr. Smith stated that the final landscaping plan will be revised to meet minimum landscape requirements prior to the issuance of building permits. Applicant Adam Schmid with Duke Realty stated that they will meet the requirements of the City. Mr. Smith also stated that this project includes the Design Review and adopting a mitigated negative declaration. Chairman Guglielmo opened the public hearing. David Jenner, who owns the property along the side at the northeast corner, asked if a wall was going in along the property. Mr. Schmid stated that there would be truck parking along the property, but would include 4-5 feet of landscaping installed on the property line and would be improved with sidewalks, curbs and gutters. Chairman Guglielmo closed the public hearing. Commissioner Munoz stated that is was a good project and noted the applicant’s willingness to work with the neighbor and retaining the rail spur. Commissioner Dopp concurred, especially with the architectural features and liked the high quality along the Haven Avenue corridor. Chairman Guglielmo noted that the project was appropriate for the area. Mr. Ghirelli stated that the motion would include the Design Review and to adopt the mitigated negative declaration. Moved by Oaxaca, seconded by Dopp; carried 4-0-1, Wimberly absent. D4. TENTATIVE PARCEL MAP SUBTPM20098 – JAIME CAMPOS – A request to subdivide an existing 27,201 square feet (0.63 acre) lot within existing residence into two lots, located in the Low (L) residential district located at 9923 Lemon Avenue; APN: 0201-902-16. This item is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section 15315. Related record: Minor Design Review DRC2016-00959. Dat Tran, Assistant Planner, gave the Staff Report and Power Point presentation (copy on file). Applicant Jaime Campos thanked the Commission and staff. Chairman Guglielmo opened the public comment. Seeing none, closed. Commissioner Munoz stated that it was a very straightforward project with no additional comments from the Commissioners. Moved by Dopp, seconded by Oaxaca; carried 4-0-1, Wimberly absent. E. APPEALS Any interested party who disagrees with the City Planning Commission decision may appeal the Commission’s decision to the City Council within 10 calendar days. Any appeal filed must be directed to the City Clerk’s Office and must be accompanied by a fee of $3,037 for all decisions of the Commission. (Fees are established and governed by the City Council).
