Background
• SB 731 (2008): Preempted most local land use, zoning and operational
regulations provided that massage establishments and practitioners
were certified by the California Massage Therapy Council.
• Development Code Update (2012): Massage establishments were
permitted "by -right" in all commercial zones, as well as the Industrial
Park and General Industrial zoning districts.
• AB 1147 (September 18, 2014): Amended the State's current massage
therapy laws to expand local authority to adopt zoning regulations, and
other reasonable health and safety requirements for massage
establishments and practitioners.
• Ordinance 872-A (January 1, 2015): The City Council enacted an
interim ordinance that now requires a City -issued Conditional Use
Permit for new establishments.
Approving Authority
• Per Chapter 17.16 of the Development Code, the
Planning Director is authorized to administratively
review and decide all Conditional Use Permits.
• Pursuant to Section 17.14.060.0 of the Development
Code, the Planning Director may at any point in the
application review process, transfer decision making
authority to the Planning Commission at her discretion.
• At this time the Planning Director is referring
Conditional Use Permit applications for massage
establishments to the Planning Commission for review
and action.

Environmental Review
• Staff prepared the Initial Study for the project.
o Findings in the IS determined that with the imposition of
mitigation measures related to aesthetics, agricultural
resources, air quality, biological resources, cultural
resources, geology and soils, greenhouse gas emissions,
hydrology and water quality, and noise, that there would
be no substantial evidence that the project would have a
significant effect on the environment.
o Mitigated Negative Declaration was prepared.
Conclusion
• Staff recommends the following:
o Recommend that the City Council adopt the Mitigated
Negative Declaration for the project; and
o Adopt the attached Resolution recommending that the
City Council approve Development Code Amendment
DRC2015-00555;and
o Adopt the attached Resolutions approving Design Review
DRC2015-00165, Conditional Use Permit DRC2015-
00166, Parcel Map SUBTPM19619, and Tree Removal
Permit TRP DRC2015-00174 contingent upon City Council
adoption of the Mitigated Negative Declaration of
environmental impacts and approval of the DCA.
