Committee and Neighborhood Meetings • September 15, 2015 - DRC and TRC reviewed the layout/design of the project and recommended approval to the Planning Commission. • October 26, 2015 - Neighborhood Meeting - A total of 3 people were in attendance - No issues presented. Environmental Assessment • Initial Study circulated February 18, 2016. • March 8, 2016 - San Manuel Band of Mission Indians provided revised language for 3 Cultural Resource Mitigation Measures. • March 22, 2016 - Planning Department received a letter from the California Department of Fish and Wildlife (CDFW). • The letter addressed concerns regarding: 1. San Bernardino Kangaroo Rat and Coastal California Gnatcatcher 2. Los Angeles and San Diego Pocket Mouse 3. Listed and Sensitive Plant Species 4. Nesting Bird and Migratory Bird Treaty Act 5. According to CEQA section 15073.5(c), recirculation of a Mitigated Negative Declaration is not required under the following circumstances: (1) Measures are replaced with equal or more effective measures pursuant to Section 15074.1; (2) New project revisions are added which are not new avoidable significant effects; (3) Measures or conditions of project approval are added after circulation of the negative declaration which are not required by CEQA, and do not create new significant environmental effects and are not necessary to mitigate an avoidable significant effect; and (4) New information is added to the negative declaration which merely clarifies, amplifies, or makes insignificant modifications to the negative declaration. Conclusion and Recommendation • CEQA section 15074.1 requires that prior to deleting and substituting a mitigation measure, the lead agency shall hold a public hearing on the matter, and adopt a written finding that the new measure is equivalent or more effective in mitigating or avoiding potential significant effects and that it in itself will not cause any potentially significant effects on the environment. • Based on the City's review of this application, Planning Department staff finds that the recommends approval of Tentative Tract Map SUBTT18908 and adoption of the Mitigated Negative Declaration of environmental impacts by adoption of the attached Resolution of Approval with conditions.
