CITY OF RANCHO CUCAMONC Project Background • On December 10, 1997 the Planning Commission approved CUP 97-23 to establish Twins Sports Bar and Grill, a night club and sports bar, with entertainment. • CUP was revised on October 11, 2000, to expand hours of operation and on October 10, 2001, to allow service to patrons 18 and older. • Twins operated until 2008 when the club changed names to Rock the Keys Dueling Piano Bar. • Rock the Keys ceased operation on July 13, 2013, and the building has been empty since then. Project Background • On October 26, 2016, the City approved DRC2016-00006 for the development of a Mixed Use project with 182 apartment units on this site. The project was conditioned to complete street improvements along Foothill Boulevard and Hermosa Avenue street frontages. • On January 10, 2017, the owners submitted a letter requesting rescission of CUP 97-23 to allow the City to release the Improvement Agreement and Bonds. • The City holding the bonds prevented escrow from closing for development of the mixed use site. • On January 18, 2017, the City Council authorized the City Engineer to release the Improvement Agreement and Bonds for CUP 97-23. Environmental Review • The project is exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. A project is exempt from CEQA under Section 15061(b)(3) where the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Additionally, the project is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies under Section 15270(a) of the State CEQA Guidelines for projects which are disapproved. Conclusion • Staff recommends the Planning Commission adopt the attached Resolution revoking approval of Conditional Use Permit 97-23. GI Design Review DRC2016=00522 • Proposes the development of a warehouse building totaling 102,530 square feet on 4.78 acres. • Site provides 2 points of driveway access — off of Hermosa Avenue and Sixth Street. • Provides 2 — 5,000 square foot office areas in the extreme northeast and southeast corners of the building. • A total of 84 parking spaces are provided for employees and customers. • A total of 10 dock high doors are provided along with 10 truck trailer spaces. The project involves development within city limits on no more than 5 acres substantially surrounded by urban uses. Additionally, approval of the project will would not result in any significant effect relating to traffic, noise, air quality, and water quality. Recommendation • Staff recommends that the Planning Commission approve Design Review DRC2016-00522 and Tree Removal Permit DRC2016-00524 through adoption of the attached Resolutions of Approval with Conditions.
