HomeMy WebLinkAbout2020-120 - Resolution RESOLUTION NO. 2020-120 A RESOLUTION OF THE CITY COUNCIL OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING AN UPDATED FEE SCHEDULE APPLICABLE TO THE ANIMAL SERVICES, BUILDING AND SAFETY SERVICES, CITY MANAGER, COMMUNITY IMPROVEMENT DIVISION, ENGINEERING SERVICES, AND PUBLIC WORKS SERVICES DEPARTMENTS A. Recitals. 1. The California Government Code allows the City to establish fees and charges for municipal services, provided such fees and charges do not exceed the estimated reasonable cost to the City in providing the service to which the fee or charge applies. 2. Data indicating the estimated or actual cost to provide each service, for which the fees and charges set forth herein apply, was made available to the public at least ten (10) days prior to the date of the public hearing. 3. On December 2, 2020, City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the amendment. 4. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. The City Council of the City of Rancho Cucamonga finds and resolves as follows: SECTION 1: The City Council hereby specifically finds that all the facts set forth in the Recitals, Part A, of this Resolution are true and correct. SECTION 2: The City Council hereby specifically finds that the fees and charges set forth do not exceed the estimated reasonable cost of providing the service for which the fee or charge be levied. Actual plants in costs for legal services shall be added. Additional costs to excess of 500 the City may be added when in excess of established fee by more than 10%. Abatement— Costs for the procurement, service and related processing $3,420.00 Cannabis, 500 of search, inspection and/or abatement warrants. Actual plants of less costs for legal services shall be added. Additional costs to the City may be added when in excess of established fee by more than 10%. Abatement- Emergency abatement of hazardous or nuisance conditions, $255.00 Emergency such as open &vacant properties, unsecure pools or stagnant water. Actual contractor and legal service costs will be added. Abatement— Inspection costs to be assessed on follow-up inspection $295.00 Re-inspection after issuance of Notice to Abate and re-inspection shows fee when non- correction has not been completed or attempted and staff compliant will assign a contractor to abate the hazard or nuisance. Actual contractor and legal services costs to be added. Abatement— Abatement of each shopping cart abandoned in the public $13.00 Shopping Cart right-of-way when a business has not made reasonable effort to comply with the provisions of RCMC 8.50 SHOPPING CARTS. Actual contractor costs will be added. Resolution No. 2020-120- Page 2 of 6 Abatement— Removal of inoperative vehicles from private property, with $375.00 Vehicle or without an abatement warrant. Fees for second and additional vehicles will be 50% of current administrative fee. Actual contractor and legal services costs to be added. Notice & Order Costs for the preparation of a Notice & Order. Fees to be $260.00 waived when compliance is achieved prior to the required correction date. Actual costs of property profile and mailing to all parties shall be added. Notice of Upon receiving satisfaction of a demand, this fee will be $160.00 Pendency charged for filing a Release of Abatement Lien or Release Withdrawal of Notice of Pendency with the County Recorder. Actual County fees will be added. Lien Upon completing all research and determining an $75.00 Administration assessment shall be necessary to recover costs, this fee shall be added to the previously determined costs. Lien Release Fees to be assessed when fees are paid to the City after $75.00 Council Resolution has been approved for assessment. Actual County fees will be added. Warrant- Costs for the procurement, service and related processing $575.00 Procure/Process of inspection and/or abatement warrants. Actual costs for legal services shall be added. Additional costs to the City may be added when in excess of established fee by more than 10%. SECTION 7: The City hereby amends Resolutions 12-196, 16-199 and 18-040, effective January 2, 2021, and amends and adopts the following fees for services performed by the Engineering Department including a 7% technology fee: D ,. ,n a Lien Demand Fee Lien demand process fees for providing pay off $135.00 information (new). This service and review is for a maximum of(3) parcel or lot(+) lots three plan check reviews. 7% Tech Fee Tract Maps and Non- This service entails the plan check review Tract Maps Residential Parcel and Non-Residential Parcel Maps of ten (10) lots or $4,634.00 (+) Maps of ten (10) lots less. This service and review is for a maximum of(3) 7% Tech Fee or less three plan check reviews. Interior Streets— 1 This service entails the plan check review of(1) one $4,083.00 (+) Sheet interior street sheet. This service and review is for a 7% Tech Fee maximum of(3)three plan check reviews. Interior Streets—2 This service entails the plan check review of(2) two $4,996.00 (+) Sheet interior street sheets. This service and review is for a 7% Tech Fee maximum of(3) three plan check reviews. This service entails the plan check review of sheet 3 Interior Streets—3 and sheet 4 interior street sheets and is charged per $1,325.00 (+) and 4 sheet. This service and review is for a maximum of(3) 7% Tech Fee three plan check reviews. Interior Streets —5 This service entails the plan check review of(5)five $g 718.00 (+) Sheet interior street sheets. This service and review is for a 7% Tech Fee maximum of(3) three plan check reviews. This service entails the plan check review of sheets six Interior Streets —6 through sheet 9 interior street sheets and is charged $1,325.00 (+) through 9 per sheet. This service and review is for a maximum 7% Tech Fee of(3)three plan check reviews. Interior Streets— 10 This service entails the plan check review of(10) ten $16,550.00(+) Sheets interior street sheets. This service and review is for a 7% Tech Fee maximum of(3)three plan check reviews. This service entails the plan check review of additional Interior Streets — 11 sheets above sheet ten and is charged per sheet. This $1,325.00 (+) and more service and review is for a maximum of(3) three plan 7% Tech Fee check reviews. This service entails the plan check review of storm Storm Drain Plans drain plans and is charged the same as interior street Same as for sheets. This service and review is for a maximum of interior streets (3)three plan check reviews. This service entails the plan check review of Landscaped and Landscaped and Irrigation Plans for City Maintained $1,379.00 (+) Irrigation Plans for Areas and is charged per sheet. This service and 7% Tech Fee City Maintained Areas review is for a maximum of(3)three plan check reviews. Hydrology Study This service entails the plan check review of Hydrology Drainage Areas up to Study Drainage Areas up to 150 Acres. This service $2,869.00 (+) 150 Acres and review is for a maximum of(3)three plan check 7% Tech Fee reviews. Resolution No. 2020-120- Page 4 of 6 Title Description Fee Hydrology Study This service entails the plan check review of Hydrology Drainage Areas Study Drainage Areas greater than 150 Acres. This $3,972.00 (+) greater than 150 service and review is for a maximum of(3) three plan 7% Tech Fee Acres check reviews. The fee set forth in this section shall be adjusted annually, commencing on July 1, 2021, and each year thereafter, without further action of the City Council, based on the Employee Cost Index for State and Local Government Employees, Total Compensation, during the 12 month period ending on December 31 st of the immediately preceding year, as released by the U.S. Department of Labor's Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the City Council, shall be utilized. SECTION 8: The City hereby amends Resolution 17-112, effective July 1, 2021, for the following fee for service performed by the Public Works Department for the Community Services Department: Title ,. De Fee Sports Organization Sports Field Lighting increase from $7.50 per hour/per $9.00 per Light Fee field hour/per field The fee set forth in this section shall be adjusted annually, commencing on July 1, 2021, and each year thereafter, without further action of the City Council, based on the CPI for San Bernardino County. Total compensation, during the 12-month period ending on December 31 st of the immediately preceding year, as released by the U.S. Department of Labor's Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the City Council, shall be utilized. SECTION 9: The City Clerk shall certify to the adoption of this Resolution.
