It Is the Intent to conclude the meeting by 10:00 p.m. unless extended by the concurrence of the City Council. In response to the Governor's Executive Orders, the San Bernardino County Department of Public Health requirements, and to ensure the health and safety of our residents by limiting contact that could spread the COVID-19 virus, there will be no members of the public in attendance at the City Council/Fire District Meetings. Mayor L. Dennis Michael called the meeting to order at 3:02 p.m. Present were Council Members Hutchison, Scott, Spagnolo, Mayor Pro Tern Kennedy and Mayor Michael. Responding to the spread of the Coronavirus (COVID-19), and social distancing requirements, City Manager Gillison announced that due to the Governor's Executive Orders, the San Bernardino County Department of Public Health requirements, and to ensure the health and safety of Rancho Cucamonga residents by limiting contact that could spread the COVID-19 virus, there will be no members of the public in attendance at the Special City Council meeting and in place of in person attendance, members of the public are encouraged to watch from the safety of their homes live from online webinar access via Zoom or by phone. Mayor Michael announced that members of the public can speak during public communications by calling in to (909) 774-2751. The meeting was made available to the public via Zoom web application. B. PUBLIC COMMUNICATIONS There were no public comments. C. ITEMS OF DISCUSSION C1. Discussion: General Plan Update: Recommended Land Use and Community Design Strategy. City Manager Gillison introduced Deputy City Manager Burris, who presented a PowerPoint presentation overview of citywide preferred land use scenarios for the City's General Plan update. Deputy City Manager Burris shared the City's vision and priorities,community strengths and shared vision for the future. He spoke about Community Engagement through "PIanRC" and noted that the General Plan Update has been a tremendous opportunity to bring the community together and create"community" by working through areas of agreement and disagreement about the future. Deputy City Manager Burris quantified PIanRC Community Engagement efforts and noted that to date, PIanRC has received input from over 2,000 community members through online surveys and virtual meetings and generated over 675,000 digital impressions through various social media platforms. Lastly, Deputy City Manager Burris provided an overview of the community's preferred land use scenarios which were crafted to meet the City's core values of Health, Equity and Stewardship. Deputy City Manager Burris concluded by noting the next steps of the multi-year General Plan Update process are as follows: • Winter-Spring 2021 — Policy and Plan Development: Develop policy solutions to address a range of topics covered in the General Plan. • Summer-Winter 2022 — Review and Adopted: Public and decision makers to review and consider adoption of the updated General Plan. Discussion ensued on Land Use Economics; property tax productivity; land use per acre; fiscal resiliency; future projections for the City of Rancho Cucamonga; benefits on increased property values; developing a matrix and standards as a tool that can assist with the General Plan update; the importance and added value in having access to data to make informed decisions; and the importance on having a sustainable community and informing the community. City Council consensus that the approach presented aligns with the City's economic development strategy of facilitating high quality development and includes an analysis of the fiscal productivity and efficiency of the City's land use development patterns; and to include the analysis incorporated as part of the data that informs the update of the City's General Plan. Mayor Pro Tern Kennedy thanked City staff for their initiative,specially during the COVID-19 Pandemic. She noted that the City's commitment to equitable and inclusive community engagement is reflective in Rancho Cucamonga being an "All America City." Motion carried unanimously, 5-0 12. CONFIRE Emergency Communication Nurse System (ECNS). City Manager Gillison introduced item 12 and Fire Chief Ivan Rojer, who provided a PowerPoint presentation and reported on the new CONFIRE Emergency Communication Nurse System (ECNS). Fire Chief Rojer outlined the efficiency and effectiveness of the innovative ECNS solution that will improve all the segments in the patient continuity of care and patient experience. He reported that with ECNS Low acuity (Alpha & Omega), callers may speak to a Registered Nurse(RN)to receive an assessment and guide the patient to the appropriate level of care, avoiding unnecessary responses and ambulance transports. Fire Chief Rojer noted that emergency resources would be dispatched if: An emergency response is required or the patient requests an ambulance, despite the provided recommended level of care. Lastly, Fire Chief Rojer shared the CONFIRE Emergency Communication Nurse System (ECNS) project timeline: Trial study from December 2020 through June 2021 with a goal to move towards a fully functioning system at CONFIRE by July 1, 2021. Fire Chief Rojer concluded by stating that he is proud to be an "early adopter" of the program, first in Southern California and that it is a huge step forward during the COVID-19 Pandemic. City Manager Gillison mentioned that the CONFIRE Emergency Communication Nurse System (ECNS) would help how emergency 911 phone calls are answered. Council Member Spagnolo noted that this was excellent progress for the Rancho Cucamonga Fire Department. Mayor Pro Tern Kennedy stated that the CONFIRE Emergency Communication Nurse System (ECNS) is a truly vetted process and is looking forward to implementation. BACKGROUND: The attached investment schedules as of December 31, 2020 reflect cash and investments managed by the Finance Department/Revenue Management Division and are in conformity with the requirements of California Government Code Section 53601 and the City of Rancho Cucamonga's and the Rancho Cucamonga Fire Protection District's adopted Investment Policies as approved on November 18, 2020. ANALYSIS: The City's and District's Treasurers are each required to submit a quarterly investment report to the City Council and the Fire Board, respectively, in accordance with California Government Code Section 53646. The quarterly investment report is required to be submitted within 30 days following the end of the quarter covered by the report. However, the City and District Treasurers have each elected to provide this report on a monthly basis. FISCAL IMPACT: None. (RESOLUTION NO. FD2021-001). (FIRE) RECOMMENDATION: Staff recommends that the Fire Board of the Rancho Cucamonga Fire Protection District adopt the attached resolution modifying how the District pays and reports the value of employer paid member contributions (EPMC) to CalPERS for those bargaining groups employed by the Fire Protection District. BACKGROUND: The Rancho Cucamonga Fire Protection District (the District) has had existing written labor agreements which specifically provide for the normal CalPERS member pension contributions to be paid by the employer (the District) and, in accordance with PELRA, reported as additional compensation. This benefit has applied to all District bargaining groups. More recently, the City Council previously approved a Memorandum of Understanding (MOU) between the District and each of the Fire District bargaining units including Fire Management Employee Group (Fire MEG), Fire Union Local 2274 (Fire Union), and Fire Support Services Association (FSSA). These MOUs specifically modify how the District will pay and report the value of EMPC. In summary, these more recent agreements have required employees to contribute toward their pension costs by reducing the District's payment and reporting of EPMC in phases. Although modifications have been incorporated in the respective MOUs, they must also be adopted by Resolution in accordance with CalPERS regulations. ANALYSIS: Existing MOUs provide for modifying how the District pays and reports the value of EPMC to increase employee contributions toward pension costs and reduce EPMC over time. The remaining benefit consists of paying the following percent of normal member contributions as EPMC, and reporting the same value of compensation earnable as additional compensation as set forth below. Effective July 11, 2020, the District will pay: • 1% of the CalPERS member contribution for all Classic Miscellaneous Employees, Tier 1, FSSA bargaining unit members. Page 57 • FSSA bargaining unit employees hired on or after July 9, 2011 and through December 31, 2012 (Tier 2) as well as Classic PERS members hired on or after January 1, 2013 will pay 7% of their PERSable compensation towards the CalPERS member contribution, eliminating EPMC for these employees. Effective February 6, 2021, this benefit will be modified for each of the bargaining units as set forth below: The District will pay towards the Fire Management Employee Group: • 7% of the CalPERS member contribution for all Classic Safety Employees, Tier 1 and Tier 2, including Fire Chief. • 6% of the CalPERS member contribution for all Classic Miscellaneous, Tier 1 employees. • 5% of the CalPERS member contribution for all Classic Miscellaneous, Tier 2 employees. The District will pay towards the Fire Union bargaining group: • 7% of the CalPERS member contribution for all Classic Safety Employees, Tier 1 and Tier 2 as well as Classic PERS members who are hired on or after January 1, 2013. Fire Support Services Association bargaining unit: • Tier 1 employees will pay 8% of their PERSable compensation towards the CalPERS member contribution, eliminating EPMC for these employees. Adoption of this resolution will reduce EPMC for Fire MEG and Fire Union employees and eliminate EPMC for FSSA employees. This is part of the District's effort, working with employees, to effectively manage pension costs over time. Staff recommends the City Council approve the attached resolution modifying paying and reporting the value of EPMC to CalPERS for bargaining groups employed by the Fire District. FISCAL IMPACT: As the District reduces EPMC, the change will result in long-term cost savings for the District by ultimately reducing both PERS contributions and PERS rates. BACKGROUND: Tract 20073 was approved by the Planning Commission on August 23, 2017, for the subdivision of approximately 84 acres into ten (10) parcels and one (1) lettered lot within the Empire Lakes Specific Plan, Planning Area 1, located north of 4th Street, south of 6th Street, west of Milliken Avenue, and east of Utica/Cleveland Avenues. Improvement agreements and securities were approved by the City Council on August 1, 2018 for ROW2018-00135 and ROW2018-00137 in order to ensure construction of the required public improvements. ANALYSIS: All public improvements required of this development have been completed to the satisfaction of the City Engineer. The public improvements will be re-inspected in approximately nine months to ensure they remain in good order prior to release of the maintenance bond. Prior to construction of the public improvements the developer, SC Rancho Development Corp., submitted the Faithful Performance Bonds in the amounts listed below to ensure satisfactory completion of the improvements. With the completion of the improvements these bonds are no longer required, and the developer has submitted the Maintenance Bonds in the following amounts to secure maintenance of the improvements through the one-year warranty period. BACKGROUND: On October 7, 2020, the City Council awarded a construction contract to Norstar Plumbing & Engineering, Inc. in the amount of $62,700 plus a 10% contingency, to address unforeseen construction related incidentals, in the amount of $6,270. A copy of the October 7, 2020, City Council Staff Report is on file with the City Clerk. A vicinity map is included as Attachment 1. The scope of work consisted of regrading, slope reconstruction, and installation of a drainage inlet to restore the slope and trail that had been closed to the public since early 2019 following erosion of the slope due to significant rainfall in the Winter of 2018/2019. ANALYSIS: The subject project has been completed in accordance with the approved plans and specifications and to the satisfaction of the City Engineer. The net increase in the total cost of the project is a result of one (1) Change Order, which is summarized below: Change Order No.1: This change order covers two changes during the construction of the project that resulted in an increase to the contract price of $12,750. The first change was to cover rerouting of the imported soil and equipment to the project site. The plans and specifications called Page 67 for the Contractor to take access to the site via the adjacent Davis Ranch property. However, concerns were raised in discussions with the owners of the Davis Ranch regarding the potential for damage to the existing onsite asphalt with the weight of the trucks and equipment. Therefore, it was decided that only minor access would be taken for lighter weight equipment and activities through the Davis Ranch and the transport of heavy materials and equipment would occur via the connection to the Almond Trail at Beryl Street. This change expanded the time and effort needed to move the soil and equipment onsite and required a minor change to the contract. The second change was for the installation of equestrian fencing supplied by the City to complete the trail improvements. City staff had originally planned on performing this work in-house. However, due to staff availability and workload related to addressing wind damage at the time, this would have delayed the reopening of the trail. Norstar was able to perform the work in a timely fashion and reopen the trail to the public within the anticipated construction timeline. At the end of the one-year maintenance period, if the improvements remain free from defects in materials and workmanship, the City Clerk will release the Maintenance Bond upon approval by the City Engineer. FISCAL IMPACT: A total of$80,000 was appropriated by the City Council on October 7, 2020 from the Landscape Maintenance District No. 1 Fund Balance (LMD No. 1; Fund 130) for the Project. An additional transfer in the amount of$6,480 from Account No. 11303035300 (LMD No. 1 Contract Services) was administratively processed to cover the additional funding required to proceed with Change Order No. 1. David, Associate Engineer SUBJECT: Consideration to Accept as Complete, File the Notice of Completion and Authorize Release of Retention and Bonds for the Fiscal Year 2019/20 Major Arterial Pavement Rehabilitation at Highland Avenue and Hermosa Avenue Project. (CITY) RECOMMENDATION: Staff recommends that the City Council: 1. Accept the Fiscal Year 2019/20 Major Arterial Pavement Rehabilitation at Highland Avenue and Hermosa Avenue Project, Contract No. 2020-048 (Project), as complete; 2. Approve the final contract amount of$879,481; 3. Authorize the release of the Faithful Performance Bond 35 days after recordation of Notice of Completion and accept a Maintenance Guarantee Bond; 4. Authorize the release of the Labor and Materials Bond, six months after the recordation of said notice if no claims have been received; 5. Authorize the City Engineer to file a Notice of Completion and release of the project retention, 35 days after recordation of Notice of Completion; and 6. Authorize the City Engineer to approve the release of the Maintenance Bond one year following the filing of the Notice of Completion if the improvements remain free from defects in material and workmanship. BACKGROUND: On June 3, 2020, the City Council awarded a construction contract to Gentry Brother's, Inc. in the amount of $856,368 plus a 5% contingency in the amount of $42,818 to address unforeseen construction related incidentals. A copy of the June 3, 2020, City Council Staff Report is on file with the City Clerk. A vicinity map is included as Attachment 1. The scope of work consisted of cold milling, routing and crack sealing, asphalt rubber hot mix overlay, handicap ramp upgrades, adjusting existing manholes and valves to the new grade, installation of pavement markers and striping, green thermoplastic bike lane markings, and related items of work per plans. ANALYSIS: The subject project has been completed in accordance with the approved plans and specifications and to the satisfaction of the City Engineer. Page 70 The net increase in the total cost of the project is a result of six (6) Change Orders, including the final balancing statement, which is summarized below: Change Order No.1: Trim existing overgrown trees canopy along the parkway to provide the necessary clearance for the cold milling machine and dump trucks. The change in contract cost due to this change order is an increase of$1,500. Change Order No.2: One additional new pedestrian pole and foundation with 2 push buttons attached to one pole at the northwest corner of Haven Avenue and Alta Loma Drive to comply with ADA regulations. The change in contract cost due to this change order is an increase of $4,500. Change Order No.3: During construction of the sidewalk along the south parkway of Highland Avenue, the Public Works Department recommended the removal of existing shrubs, modification of existing irrigation to drip line irrigation to avoid over spray onto new sidewalk, installation of crossing sleeves for future irrigation modification, installation of a new stainless steel cage enclosure at an existing back flow device for pedestrian protection, and placing of new 4" wood chip mulch between the curb and new sidewalk. The change in contract cost due to this change order is an increase of$10,500. Change Order NoA: Additional concrete curb and gutter and sidewalk and AC Berm on the southbound lane of Hermosa Avenue approaching Highland Avenue to extend the south end of the existing bike line and enhanced thermoplastic green markings. The change in contract cost due to this change order is an increase of$3,895. Change Order No.5: Staff added thermoplastic green bike lane markings on Hermosa Avenue using savings from the asphalt rubber hot mix overlay line item. The change in contract cost due to this change order is an increase of$25,000. Change Order No.6: The balancing statement for the project. The balancing statement conforms the final contract quantities to the actual quantities placed or constructed during the contract. The notable change is a decrease in the amount $22,282 resulting from a decrease in the final quantities placed under the contract. At the end of the one-year maintenance period, if the improvements remain free from defects in materials and workmanship, the City Clerk will release the Maintenance Bond upon approval by the City Engineer. BACKGROUND: The Public Works Services Department (PWSD) annually conducts a vehicle replacement analysis of its fleet inventory. A replacement ranking methodology is used to justify and recommend vehicles to be replaced. Factors considered in the replacement ranking include depreciation, mileage, age, condition, maintenance history, application, and depreciation. City Council approved the purchase of one standard cab stake bed dump truck for Public Works in the FY 2020/21 budget as part of the Equipment/Vehicle Replacement Fund. This unit will replace a Park's stake bed dump truck, which has reached the end of its service life. The Public Works Services Department provided specifications to the Procurement Department for the purchase of one (1)standard cab stake bed dump truck. Procurement prepared and posted a formal Request for Bid (RFB) #20/21-117 to the City's automated procurement system. There were one hundred eighty-five (185) vendors notified; seventeen (17) prospective bidders downloaded the solicitation documentation, and three (3) bid responses were received. ANALYSIS: After analysis of the bid response by the Public Works and Procurement staff, it has been determined to be in the City's best interest to recommend an award to Fairview Ford Sales, of San Bernardino, California, for one (1) standard cab stake bed dump truck. All applicable solicitation documentation is on file in Planet Bids and can be accessed through the City's website at www.cityofrc.us. (CITY) RECOMMENDATION: Staff recommends that the City Council approve the In-Use Off-Road diesel fueled fleet management plan. BACKGROUND: The City has fourteen (14) in-use off-road diesel fueled vehicles in the fleet. The California Air Resources Board (CARB) requires the City to submit an annual Diesel Off-Road Online Registration System (DOORS) report. The goal of the program is to reduce particulate matter (PM) and oxides of nitrogen (NOx) emissions from in-use existing off-road heavy-duty diesel vehicles with a 25-horsepower (hp) rating or greater in California. The DOORS report provides a Fleet Compliance Snapshot, which contains the number of vehicles in fleet; fleet engine horsepower total; fleet target and average emissions rates; compliance date; beginning credits; credits used and ending credits each year. Once staff enters the information into the DOORS program it automatically calculates the fleet average target rates and displays them in the Compliance Snapshot. The City is considered a Small Fleet (< 2,500 horsepower) with a horsepower fleet average of 939 horsepower. The fleet horsepower average is determined by totaling the horsepower of each City vehicle engine in the fleet. ANALYSIS: The 2020 Fleet Compliance Snapshot states, the City has met the off-road regulation performance requirements through January 1, 2028 compliance because the City earned Best Available Control Technology (BACT) credits that will be applied toward the required BACT amount through the January 1, 2028 compliance date. After the final compliance date of January 1, 2028, the City's previously earned BACT carryover credits cannot be used to meet compliance requirements. Instead, the City must act on 10% of the fleet horsepower each year until the final fleet average target is met, i.e. 939 horsepower fleet would constitute replacing and/or retiring vehicles with a total of 94 horsepower. Staff is recommending in FY 2026/27 the City retire one (1) Tier 0 vehicle and two (2) Tier 1 vehicles. Then in FY 2027/28 retire another three (3) Tier 2 vehicles. (CITY) RECOMMENDATION: Staff recommends that the City Council adopt the attached 2021 Legislative Platform. BACKGROUND: Each year, there are a multitude of bills introduced in the State Legislature and U.S Congress that directly impact the operations of municipal government. Often, the City needs to take a position on a particular piece of legislation that will have an impact on the City or local government in general. City staff carefully monitors pending state and federal legislation and once a position is adopted, staff works closely with the City Council to advocate on behalf of the City to members of the State Legislature, the Governor's office, members of Congress or various states and federal agencies. The 2021 Legislative Platform serves as an outline and reference guide for legislative positions and objectives that shape the actions of both City Council and staff. It is the foundation of a focused advocacy strategy with the primary objective of adopting official City positions on clearly stated legislative issues at the start of the legislative session. It encourages collaboration with the League of California Cities and other local agencies in supporting the City's diverse legislative interests.The City of Rancho Cucamonga does not typically address matters that are not pertinent to local government services or duties, such as socially divisive, partisan, or international affairs. The Legislative Platform is adopted on an annual basis and directs the City's Legislative Program through the incorporation of key strategic actions that include the communication of legislative positions on proposed Federal, State, and County legislation, measures, initiatives, and governmental regulations, as well as the pursuit of Federal, State, and County funding for City projects, services, and programs. The attached 2021 Legislative Platform builds upon this foundation and has been updated to reflect issues that are anticipated to continue or emerge throughout the upcoming legislative session. Issues that have been resolved or are no longer relevant are typically removed. The Legislative Platform is continually reviewed using the goals and objectives of the City Council, a review of legislative priorities from the League of California Cities and other regional agencies, research of current law and pending legislation, as well as input from City departments, local legislative staff, and the City's legislative advocates. Page 78 ANALYSIS: For the 2021 Legislative Platform, staff has taken a comprehensive approach to updating the document. First, the COVID-19 Legislative Platform was adopted by the City Council in May 2020 in response to the state and federal response to the pandemic. It was combined with the attached 2021 Legislative Platform to streamline the two platforms into one concise and comprehensive document. Staff then carefully analyzed and identified positions for redundancy and relevancy with several of these modified to mirror the existing positions in the Platform. New positions have also been added to the platform to reflect the City's current interests, such as the high-speed rail project that would connect Rancho Cucamonga to Las Vegas, and the advocacy for the advancement of social, health, and racial equity within our community. Page 79 CITY OF RANCHO CUCAMONGA 2021 LEGISLATIVE PLATFORM The 2021 Legislative Platform provides a framework for the City of Rancho Cucamonga's Legislative Program and serves as the foundation of a focused advocacy strategy and reference guide for legislative positions and objectives that provide direction for the City Council and staff throughout the year. The Legislative Platform allows the City Council to adopt official City positions on clearly stated legislative issues at the start of the legislative session. STATE PRIORITIES GOOD GOVERNANCE Support Efforts To: • Restore sustainability of Public Pension benefit plans by implementing reform measures such as modifying retirees' COLA increases, permitting cities to modify benefits prospectively for active employees, and limiting the practice of divestment. • Support sales tax reform which modernizes the tax structure to reflect the increasing use of e-commerce, and considers consumption of personal or retail services so that sales tax is equitably distributed to those communities where the purchase is made and those communities which are part of the supply chain or have a physical presence or impact. • Streamline environmental processing for regulatory permits issued by Caltrans and various other state and federal agencies for the purpose of expediting public infrastructure developments. • Restore fiscal incentives that support the annexation of adjacent inhabited territory to ensure it is fiscally viable to improve service delivery to residents in these areas. • Allow for Caltrans to relinquish control of Caltrans-operated traffic signal intersections during emergency evacuations as well as for daily operations. • Update outdated state requirements in order to allow public safety agencies to consider alternative technologies, such as microgrids, when providing emergency back-up power for critical public safety facilities. Oppose Efforts To: • Require local agencies to unreasonably provide additional paid leaves of absence to specified employee groups for workplace injuries. • Create a duplicative, single-objective government agency in San Bernardino County for the purpose of delivering the Gold Line rail service to Ontario International Airport. Page 1 of 10 Page 80 • Impose burdensome and unnecessary scrutiny on Successor Agencies submitting reimbursements to their respective oversight boards for administrative costs as part of their ROPS and as allowed by state law. • Place additional requirements pertaining to mandatory employee orientations. • Put cities at a disadvantage in the collective bargaining process, impose binding arbitration or circumvent the collective bargaining process between cities and employee groups. • Make changes that would unreasonably increase employer liability and costs for workers' compensation or employer liability for unemployment compensation. • Limit local authority by making it more onerous for cities to contract for various services. • Impose state-mandated costs for which there is no guarantee of local reimbursement or offsetting benefits. • Amend the California Public Records Act requiring public agencies to retain and preserve every public record that is transmitted by electronic email. • Pre-empt or reduce local discretion over locally imposed taxes. • Require local governments to directly pay retirees and/or their beneficiaries disallowed retirement benefits using general fund dollars. QUALITY OF LIFE Support Efforts To: • Provide cities with additional tools and resources to help facilitate local efforts, such as programs and services to address and prevent homelessness, including new and enhancing funding mechanisms to support the development of affordable housing. • Equitably distribute Cap and Trade revenues in all areas of the state more commensurate with each community's burden in meeting the State's overall GHG reduction goals and allow for greater portions of Cap-and-Trade revenues for projects located outside of, but still benefit, Disadvantaged Communities as defined by CalEnviroScreen. • Assist municipal utilities in meeting the State's climate goals where resource choice and utility planning flexibility are needed to achieve the State's carbon reduction goals while maintaining affordable electric rates and reliability. • Incentivize energy storage and micro-grid technologies that makes the transition to renewable energy more financially attractive and help meet the State's 2030 GHG emission targets. • Provide financial incentives including increasing rebates and expanding tax credits for the purchase of electric vehicles and EV charging infrastructure. • Restore reliability and predictability in the State's electrical supply by finding solutions to the issue of utility wildfire liability and ending the practice of public safety power shutoffs. Page 2 of 10 Page 81 • Address criminal justice concerns created by the passage of AB 109, Proposition 47 and Proposition 57, which reduced jail time served, reclassified certain crimes from felonies to misdemeanors, and took away the ability to take into account an individual's criminal history. • Allow cities to limit the number and location of sex offender and parolee group homes within the City limits. • Improve interoperability of regional voice and data communications equipment. • Preserve local authority to adequately enforce state and local vehicle violations. • Support the enforcement of local codes through the collection of administrative fines or penalties through property tax lien and assessment. • Support efforts that reduce waste and encourage the use of environmentally sustainable strategies and products in order to advance State and local environmental goals. • Provide cities with funding and resources to build capacity for improving health and wellness in the community. • Promote the advancement of health, equity and inclusiveness including reversing the effects of inequitable policies, processes, and practices, and affirmatively advance equity and social justice in the community. Oppose Efforts To: • Erode the local control provisions provided to cities and counties through the Medical Marijuana Safety Act and the Adult Use of Marijuana Act. • Require allowing a minimum number of licenses authorizing retail cannabis activity within a jurisdiction based on arbitrary indicators such as population and existing liquor licenses. • Limit local government's ability to regulate encampments on sidewalks, and public parks and other public spaces. • Promote the use and sale of flavored tobacco products to youth. • Require a "one-size-fits-all" approach for achieving building decarbonization and reducing greenhouse gas emissions. HOUSING AND LAND USE Support Efforts To: • Revise the California Environmental Quality Act (CEQA) to streamline the environmental review process in order to improve timelines for project approvals and avoid costly duplicative steps while maintaining critical environmental protections, and to limit the abuse of CEQA, such as requiring the disclosure of and limiting who can participate in CEQA related lawsuits, all to improve housing production and affordability. Page 3 of 10 Page 82 • Restore a viable form of tax increment financing to advance transit-oriented development, build affordable and workforce housing, improve jobs/housing balances, and revitalize and invest in local communities. • Preserve local authority when addressing housing production and affordability and ensure housing development is consistent with local housing elements, design and parking standards, height limitations, housing density, health and safety standards and community interests. • Provide opportunities for cities to receive sufficient revenue, without impact fee restrictions, in order to help ensure that any new residential development generates enough revenue to cover the provision of municipal services that it would require. • Establish a real, substantial and ongoing source of funding for affordable housing options and related infrastructure. • Preserve municipal authority over the public right-of-way and ensuring fair and reasonable compensation for use of the right-of-way. • Re-evaluate laws and policies that are rooted in the current sentiment that implies that local governments are an impediment to increasing housing supply and affordability and instead explore innovative strategies and tangible steps to develop and attain affordable housing goals. • Increase collaboration between the State and developers in order to increase affordable housing production, such as offering incentives. • Reinstate Development Impact Fees (DIF)for Accessory Dwelling Units (ADU)that would help to address the impacts of increased traffic and service demands that additional ADU's generate. Oppose Efforts To: • Implement a mandate holding cities and counties legally accountable for providing adequate housing shelters for the homeless and emergency shelters. • Impose a one-size-fits-all approach to housing and land use policies that fail to recognize the unique housing challenges each city faces. • Limit cities' ability to implement and efficiently maintain shared mobility programs in their communities. • Punish cities that did not meet their RHNA housing goals by threatening to take away their allocation of SB 1 transportation funds. • Regulate large freight facilities without providing a balanced approach between reducing air pollution and ensuring the economic vitality of the logistics industry. • Require local governments to lease out public property to the telecommunications industry, limit how much cities can charge for a lease, eliminate the ability for cities to negotiate public benefits and prevent the public's input and full discretionary review for the installation of"small cell" wireless equipment. COMMUNITY INVESTMENTS Support Efforts To: • Obtain Prop 68 funding for the continued build-out of Central Park and other park improvements. • Allow park bond projects that are not located within a disadvantaged community, but still benefit a disadvantaged community, to be eligible and competitive for park bond funding. • Provide an ongoing, permanent funding source for the Public Library system's LINK+ program, which facilitates the lending of materials between California libraries. • Provide cities and municipal utilities with funding and resources in order to build capacity for increasing climate resiliency. • Build the Foothill Gold Line Extension to the Ontario International Airport along alignments that utilize the existing Metrolink infrastructure north of and parallel to 811 Street as well as the existing San Bernardino County Flood Control right-of-way for the Cucamonga or Deer Creek Channels and include a station in Rancho Cucamonga. • Build a high-speed rail project to Rancho Cucamonga, connecting Southern California to Las Vegas. • Recognize the importance of San Bernardino County to the overall goods movement systems as part of any statewide investment plan in transportation. • Provide a long-term, sustainable funding source for critically needed technological upgrades and the continued operation of the emergency 9-1-1 system. • Provide funding for the reimbursement of costs associated with pre-positioning first responders, fire apparatus and equipment in advance of identifiable risks. • Provide funding support for disaster preparedness, Homeland Security, wildfire response, costs related to public safety power shutoffs, disaster response operation costs and other local emergency management and law enforcement activities. • Adopt funding guidelines that allow projects not located within a disadvantaged community, but still benefit a disadvantaged community, to be eligible and competitive for funding. Oppose Efforts To: • Allow for the deferment or suspension of collecting property tax from property owners, unless cities are made whole by backfilling the lost revenue. • Infringe on decision-making authority of cities and local jurisdictions regarding employee safety rules, regulations and protocol in the workplace. Page 7 of 10 Page 86 FEDERAL PRIORITIES GOOD GOVERNANCE Support Efforts To: • Increase federal investment in goods movement infrastructure that recognizes Southern California and San Bernardino County's position as the nation's gateway for containerized freight. • Streamline federal reporting/monitoring requirements in order to reduce project delivery times without comprising critical oversight mechanisms. • Increase FHA home loan limits in order to accurately reflect the region's skyrocketing home values and make home ownership more attainable. • Streamline environmental processing for federal regulatory permits issued by the US Army Corp of Engineers, US Fish & Wildlife Service, Federal Highway Administration and various other state and federal agencies for the purpose of expediting public infrastructure projects. • Take into account the economic impacts of proposed endangered species listings, as well as provide for a streamlined process for the delisting of species no longer threatened or endangered. • Modernize the Fair Labor Standards Act to ensure its relevancy to today's modern workforce, working from home, and flexible scheduling for knowledge workers. Oppose Efforts To: • Eliminate the tax-exempt status of municipal bonds and proposals to cap the investor tax deduction on municipal securities investments. • Allow online travel companies to circumvent remittance of transient occupancy taxes to local governments from hotel reservations purchased using the internet. • Limit or prohibit the creation, development, or expansion of municipally owned broadband internet service provision and/or infrastructure. QUALITY OF LIFE Support Efforts To: • Promote the advancement of health, equity and inclusiveness within our community including reversing the effects of inequitable policies, processes, and practices, and affirmatively advance equity and social justice in the community. • Support the creation of new funding opportunities at the federal, state and local level to assist cities in providing creative and sustainable solutions to address homelessness. • Provide local governments with the authority and resources to restrict illegal birthing houses. Oppose Efforts To: • Eliminate and/or defund the Institute of Museum and Library Services (IMLS) and the National Endowment of Arts (NEA). • Cut funding for critical law enforcement programs such as the Byrne/JAG and COPS programs. • Adjust flight patterns into Los Angeles International Airport (LAX) that will negatively impact properties in the community. COMMUNITY INVESTMENT Support Efforts To: • Build a high-speed rail project to Rancho Cucamonga, connecting Southern California to Las Vegas. • Increase the national limit on private activity bonds in order to allow for the development of large-scale privately funded projects such as high-speed rail. • Incentivize solar PV generation, energy storage and micro-grid technologies in order to make the transition to renewable energy more financially attractive. • Provide financial incentives including increasing rebates and expanding tax credits for the purchase of electric vehicles and EV charging infrastructure. • Provide funding opportunities for proven crime-fighting technology such as Automated Vehicle License Plate Readers. • Attract funding to provide for museum-quality exhibits at the second floor of the Rancho Cucamonga Library. • Provide funding for the development of the City's Advanced Traffic Management System. • Provide funding for the development of municipally owned broadband internet service and/or infrastructure to provide more equitable internet access throughout our entire community. • Invest and support regional rail connectivity to Ontario International Airport. • Finalize and implement the Cucamonga Canyon Management Plan and attract federal resources for the preservation and proper management of Cucamonga Canyon. Oppose Efforts To: • Eliminate or reduce funding for Community Development Block Grant (CDBG) and HOME programs. Allow for a more streamlined application process and for greater flexibility of local appropriation and use of funding. COVID 19 PANDEMIC Support Efforts To: • Provide sufficient funding for small theaters and entertainment venues, including those publicly owned and operated, to overcome the devastating impacts the COVID-19 pandemic has had on the live entertainment industry. • Provide cities with greater flexibility to directly access and spend COVID-19 Relief funds. Flexibility on eligible expenses should allow for a wide variety of incurring costs related to COVID-19 such as staffing. • Provide relief funding to states and local governments, including cities under 200,000 population, for cost related to preparing for, responding to, mitigating and recovering from future COVID-19 outbreaks. • Provide widespread testing and vaccinations for COVID-19 to ensure the safety of our communities and allow the economy to reopen at a faster rate. Oppose Efforts To: • Impose new sick leave and family medical leave requirements on local governments. • Impose population thresholds that limit the eligibility of cities to directly access Coronavirus Relief Funds. Gillison, City Manager INITIATED BY: Jennifer Hunt Gracia, Community Services Director SUBJECT: Receive and File an Update on Rancho Cucamonga's Sports Field Utilization. (CITY) RECOMMENDATION: Staff recommends the City Council receive and file the update on Sports Field Utilization. BACKGROUND: Parks are historically used by the community for passive recreation, organized sports, rentals, and contract classes providing overall support for the health and wellness of city residents. The City has over 30 parks and 53 multi-use sports fields. For over 20 years, the City and the Rancho Cucamonga Sports Advisory Committee (SAC) have worked to provide youth athletes with fundamentals, teamwork, physical fitness, education and sportsmanship. Currently, SAC is comprised of 11 non-profit youth groups who serve the Rancho Cucamonga community. In accordance with the Field Allocation Policy last revised in 2018, staff is responsible for allocating all City fields and 4 of the 5 School District fields as available per the Districts each year. Sports fields identified for use are currently allocated at 90% capacity. In October 2020, staff received a field use and SAC Membership inquiry from a Rancho Cucamonga based youth rugby league. Based on the current lighted field inventory during the winter/spring season and membership/allocation policy and process, staff has determined that there is no field space available to accommodate the request. ANALYSIS: Over the last 10 months, due to the Coronavirus, there has been a significant increase in the use of open space. The use of parks and fields provides a safe way for community members, youth groups and organized sports to exercise and connect during the pandemic. Increased use and request of parks through the pandemic added to the previously identified challenges in scheduling fields space, which has resulted in staff identifying a need to re-evaluate City resources to ensure equity amongst users. The impacts of the Coronavirus on parks and open spaces and an increased use of fields, has highlighted the need for an analysis on how park and field resources are allocated. In the analysis, staff will identify if the current park allocation process, including use for youth sports, rentals, contract classes, and passive recreation, meet the current and anticipated future needs of the community. The analysis will assess use of current park and sport fields as well as explore Page 90 potential opportunities for the use of non-traditional (space not currently allocated) spaces. Staff will also identify if the City can diversify youth sports opportunities and determine if an update is needed to the Field Allocation Policy. Finally, staff will survey similar municipalities to assess best practices and methods in addressing the increase to and impacts of park use. Once the analysis is complete, staff intends to report the findings and any recommendations for the Council's consideration in July 2021. If Council makes any policy changes, those changes are would not be implemented until Spring 2022. FISCAL IMPACT: Not applicable.
