HomeMy WebLinkAbout997 - Ordinance ORDINANCE NO. 997 AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ADJUSTING THE BOUNDARIES OF THE FOUR CITY COUNCIL DISTRICTS AND ADOPTING A NEW OFFICIAL COUNCIL DISTRICT MAP FOR THE CITY OF RANCHO CUCAMONGA BASED ON THE RESULTS OF THE 2020 DECENNIAL CENSUS A. Recitals. 1. On November 8, 2016 the City Council adopted Ordinance No. 887 pursuant to Government Code Sections 34871 and 34872 to add Chapter 2.11 to the Rancho Cucamonga Municipal Code to provide for the by-district election of members of the City Council and at-large election of the Mayor, adopt the official Council District Map for the City of Rancho Cucamonga, establish the boundaries and identification number of each electoral district, and establish a sequencing of elections for each Council District. 2. Pursuant to Elections Code Section 21601 and Section 2.11.050 of the Rancho Cucamonga Municipal Code, the City Council is required to adjust the boundaries of any or all of the Council Districts following each decennial federal census. Using the census as a basis, the City Council must adjust the boundaries so that the Council Districts are as nearly equal in population as practicable and in compliance with all applicable provisions of law, including the United States and Federal Constitutions and the Federal Voting Rights Act of 1965 (52 U.S.C. Section 10301 et seq.). 3. In accordance with Elections Code Section 21607 and 21607.1, the City Council held public hearings on the drawing of district boundaries on September 15, 2021, November 3, 2021, January 19, 2022, February 2, 2022, and March 2, 2022. At each of the foregoing hearings, the public was invited to provide input on the composition of the new Council District boundaries. 4. After closing the public hearing held on March 2, 2022, the City Council directed staff to publish the revised map depicted in Exhibit"A"of this Ordinance based on the public input received during the public hearings and return with the revised map and this Ordinance for first reading at the March 16, 2022 City Council meeting. At the March 16, 2022 City Council meeting, the City Council selected the map depicted in Exhibit"A"of this Ordinance and incorporated herein by this reference as the official Council District Map for the City of Rancho Cucamonga and introduced this Ordinance for first reading. Demographic data supporting the map based on the 2020 Census is attached hereto as Exhibit "B" of this Ordinance and incorporated herein by this reference. B. Ordinance. The City Council of the City of Rancho Cucamonga does ordain as follows: SECTION 1. The map attached hereto as Exhibit "A" to this Ordinance is hereby approved and adopted as the Official Council District Map for the City of Rancho Cucamonga and shall be used in the 2022 general municipal election and all such elections for City Council thereafter, until further amended. Ordinance No. 997 - Page 1 of 3 • SECTION 2. Section 2.11.020 of Chapter 2.11 of the Municipal Code is hereby amended to read as follows: "2.11.020 City Council Districts Established. The boundaries for the four(4) City Council districts and the identification number of each district shall be as described on the Official Council District Map for the City of Rancho Cucamonga, attached as Exhibit "A" to Ordinance No. 997 and incorporated herein by this reference. A copy of the Council District Map is on file in the Office of the City Clerk." SECTION 3. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unenforceable by a court of competent jurisdiction, the remaining portions of this Ordinance shall nonetheless remain in full force and effect. The City Council of the City of Rancho Cucamonga hereby declares that it would have adopted each section, subsection, sentence, clause, phrase, or portion of this Ordinance, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions of this Ordinance be declared invalid or unenforceable. SECTION 4.
