C. PUBLIC COMMUNICATIONS Members of the City Council also sit as the Fire Board, Housing Successor Agency, Successor Agency, and Public Finance Authority. This is the time and place for the general public to address the Fire Protection District, Housing Successor Agency, Successor Agency, Public Financing Authority Board, and City Council on any item listed or not listed on the agenda. State law prohibits the Fire Protection District, Housing Successor Agency, Successor Agency, Public Financing Authority Board, and City Council from addressing any issue not previously included on the Agenda. The Fire Protection District, Housing Successor Agency, Successor Agency, Public Financing Authority Board, and City Council may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Mayor, depending upon the number of individuals desiring to speak. All communications are to be addressed directly to the Fire Board, Agencies, Successor Agency, Authority Board, or City Council not to the members of the audience. This is a professional business meeting and courtesy and decorum are expected. BACKGROUND: The attached investment schedules as of September 30, 2022 reflect cash and investments managed by the Finance Department/Revenue Management Division and are in conformity with the requirements of California Government Code Section 53601 and the City of Rancho Cucamonga’s and the Rancho Cucamonga Fire Protection District’s adopted Investment Policies as approved on June 16, 2022. ANALYSIS: The City’s and District’s Treasurers are each required to submit a quarterly investment report to the City Council and the Fire Board, respectively, in accordance with California Government Code Section 53646. The quarterly investment report is required to be submitted within 30 days following the end of the quarter covered by the report. BACKGROUND: On May 10, 2017, the Planning Commission approved Case No. SUBTT20054 for the development of 214 residential condominium units on 12.1 acres, located on the south side of Church Street and east of Haven Avenue. An improvement agreement and securities were approved by the City Council on February 21, 2018, to ensure the construction of the required public improvements. ANALYSIS: All public improvements required for this development have been completed to the satisfaction of the City Engineer. Prior to the construction of the public improvements the developer, LVD Terra Vista, LLC, submitted the following securities to ensure satisfactory completion of the improvements: Faithful Performance Bond $110,200 Bond #1001085546 Labor and Material Bond $110,200 Bond #1001085546 With the completion of the improvements, the Faithful Performance and Labor and Material bonds are no longer required. The improvements will be re-inspected in 10 months and the Maintenance Page 92 Page 2 1 4 9 0 Bond will be released upon approval of the City Engineer if no defects in materials or workmanship are observed. (CITY) RECOMMENDATION: Staff recommends the City Council award and execute a one (1) year contract with The SpyGlass Group, LLC, (SpyGlass) to audit the City’s primary telecommunications service accounts (voice, data, internet, cloud services, and mobility/cellular) for cost recovery, service elimination, and cost reduction opportunities. BACKGROUND: Over time, the quantity and complexity of the City’s various telecommunications service accounts for voice, data, internet, cloud services, and mobility/cellular have grown significantly. Periodic rate increases have been implemented by all of the telecommunications services providers during this time. While staff have performed general oversight of these changes, detailed audits of the various accounts have not been performed increasing the risk that the City may be paying an incorrect rate or paying for services that are no longer needed. Other cities/agencies have engaged SpyGlass for similar projects. Those agencies include, but are not limited to: City of Indio, City of Redding, City of South Gate, and City of Indio. ANALYSIS: Staff became aware of the consultant, The SpyGlass Group, LLC, that performs audits of the various telecommunications service accounts to identify potential cost savings with minimal City staff time required. If approved, the audit will be conducted in four primary phases: 1. Getting Started: City staff will submit technology billings from the most recent two months to SpyGlass. The City will execute one Letter of Agency (LOA) to allow SpyGlass to pull information from the carriers required to perform the audit. 2. Analysis: The SpyGlass Audit Team creates inventories by dissecting all fixed and variable costs and analyzing data from inventories, bills, contracts, tariffs, and usage information. 3. Summary of Findings: The SpyGlass Implementation Team provides recommendations to the City, which could include: Page 95 Page 2 1 5 0 8 a. Recovery: Findings related to improper tax or tariff applications, improper discount applications, old services, or incomplete order entry. b. Service Elimination: Findings related to dormant services, services associated with old locations, or excessive services. c. Cost Reduction: Findings related to identifying the latest discounts and promotions, plan optimization, or benchmark analysis. 4. Benchmark: SpyGlass will finalize the process with their proprietary Benchmark Analysis. This Benchmark Analysis will show the City how it fared in our audit compared to other cities/counties within our geographic area, within the state of California, and, lastly, with all city/county SpyGlass clients nationwide. Compensation for SpyGlass is success-based, so the City will only pay if they identify savings. There are no up-front costs, and the City will always control what is implemented. If/after recommendations are implemented, the City will pay SpyGlass a portion of the savings with a guarantee to recoup the fee in one year or less. A snapshot of the project timeline (October 24th through February 2nd) is as follows: The proposed Professional Services Agreement is on file with the City Clerk’s Office. FISCAL IMPACT: The costs associated with this agreement, if the City chooses to proceed with SpyGlass’s recommendations, will be covered by the savings achieved by the implementation of the specified utility account modifications. The exact amount of savings is indeterminable at this point in time. However, this item is being brought to the City Council for approval in the instance the fees for service surpass the City Manager’s signing authority of $100,000. Budget transfers will be utilized to move cost savings from the various utility accounts to the contract services accounts that PA will be paid from in accordance with the City’s established policies. (CO#2022-007), to Expand the Scope of Services to Include Economic Development Marketing, Branding, and Communications Services. (CITY) RECOMMENDATION: Staff recommends that the City Council approve an amendment to an existing Professional Services Agreement with Westbound Communications Inc. The subject proposal would amend and expand the agreement’s scope of services to include economic development marketing, branding, and communications services. BACKGROUND: With the recent completion of the General Plan Update, the forthcoming update of the Economic Development Strategic Plan, and the impending development of the Cucamonga Station and HART District, there is an opportunity and a need for the development of a comprehensive marketing and communications strategy to support the City’s aggressive economic development efforts. This will include any necessary refinements to the City’s brand to address the goals of this effort. Earlier this year, the City, in partnership with various stakeholders, conducted an RFP process for Cucamonga Station/Hart District Marketing Outreach and Engagement Services. Cucamonga Station, a multi-modal transportation center located in the HART District of Rancho Cucamonga, will provide commuters and visitors with multiple rail lines, a future high-speed interstate rail, an evolutionary bus rapid transit system, and a sleek futuristic underground tunnel that connects rail and bus with the Ontario International Airport. The process resulted in eleven RFP responses received and four vendor interviews conducted. The City Council, at its February 16, 2022, meeting, awarded a Professional Services Agreement to Westbound Communications, Inc., which offered the best fit and value for the City and its partners. The services subject to that agreement were to be provided for a cost not to exceed $485,000. The recent completion of the General Plan Update, along with the planned update of the City’s Economic Development Strategic Plan in the coming year prioritizes a distinct need for an integrated and comprehensive marketing and strategic communications plan to support the economic development efforts and goals for maintaining a world-class community. Page 98 Page 2 1 5 0 5 ANALYSIS: Since the agreement was approved, City staff has begun working with Westbound Communications on developing marketing strategies for the Cucamonga Station and HART District. Staff has also recognized the need for a more comprehensive, integrated marketing and communications plan to assist the City’s overall economic development efforts. Developing and implementing the plan is essential for the City to realize its economic development goals. The subject item would amend the scope of services in Westbound’s existing agreement to include marketing, branding, and communications services for the City. As stated earlier in this report, the City’s current agreement with Westbound is for a not to exceed amount of $485,000 over a two- and one-half-year period. While work on the Cucamonga Station and HART District marketing strategies will continue, the amount of work completed thus far and in the near future is anticipated to be less than initially expected. Therefore, funds currently allocated for Westbound’s work on the Cucamonga Station and HART District will be reallocated as needed for economic development marketing, branding, and communications tasks. Any future budget augmentation needed will be addressed in the mid-year or annual budget process. The use of Westbound for the additional services provides critical connectivity for two interconnected projects that provide great benefit to the City for the following reasons: •Avoids duplication of services and provides cost savings as many of the research and analysis tasks that Westbound Communications is already doing for the HART District would also be utilized for the citywide Integrated Marketing and Communications Plan. •Greater continuity and integration with having a single vendor developing marketing strategies and key messages. Allows for a cohesive voice, style and feel in the City’s marketing and communications efforts. •Allows for more effective project management and increased accountability. Westbound’s amended scope of work will now include, but not be limited to the following: 1. Development of an Integrated Marketing, Branding, and Communications Plan. Identify goals/objectives, timelines, strategic priorities, measurement metrics and marketing tactics. 2. Research and discovery such as data analysis, and SWOT assessment drive greater market insights and segmentation. 3. Creation of an overall message house to include key messages, taglines, elevator speeches, etc. 4. Assisting with marketing tactics such as content creation, media relations, social media, web presence and events. FISCAL IMPACT: The City’s fiscal year 22/23 budget allocates funding for Westbound’s existing agreement in 10011001-5300 (General Fund, Contract Services). While their current work on the Cucamonga Station and HART District marketing strategies will continue, the amount of work completed thus far and in the near future is anticipated to be less than initially expected. THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA DOES ORDAIN AS FOLLOWS: Section 1.A new Chapter 10.60.060 entitled “Application for accessible parking designation” is hereby added to Chapter 10.60 (Parking for Persons with Disabilities) of Title 10 (Vehicles and Traffic) of the Rancho Cucamonga Municipal Code to read as follows: 10.60.060 Application for accessible parking designation. A. Any person who has been issued a special identification license plate pursuant to Vehicle Code Section 5007 or a distinguishing placard pursuant to Vehicle Code Sections 22511.55 or 22511.59 may apply to the City Traffic Engineer via an application form furnished by the City Traffic Engineer for the designation of an on- street accessible parking zone as a parking space reserved for disabled persons. Such application shall contain: 1. Evidence that the applicant is a full-time resident of the residential property in front of which the on-street accessible parking zone is requested; 2. Evidence from the California Department of Motor Vehicles of authorization to use disabled parking; 3. Evidence showing a need for accessible parking at the requested location; 4. When any of the circumstances in the application change or cease to exist, the applicant shall notify the City Traffic Engineer. C. The City Traffic Engineer is authorized to remove accessible parking zones at any time if determined to be a safety hazard or it impedes necessary improvements or development with 30-day notice to the applicant. E. The City Traffic Engineer is authorized to mark the curb with blue paint on the curb or edge of the paved portion of street adjacent to the space. In addition, the City Traffic Engineer shall install a sign posted immediately adjacent to and visible from the space. The sign shall consist of a profile view of a wheelchair with occupant in white on a blue background and shall clearly state the following: “Minimum Fine $250.” Section 2. CEQA. This Ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) which is the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment, and CEQA does not apply where it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. This Ordinance merely establishes a process by which City residents may request an accessible parking space and will not result in any physical changes to the environment. Severability. If any section, clause or phrase of this Ordinance is for any reason held to be unconstitutional, or otherwise invalid, such decision shall not affect the validity of the remaining sections of this Ordinance. (RESOLUTION NO. FD 2022-032) (FIRE) RECOMMENDATION: Staff recommends that the Fire Protection District Board adopt a resolution making determinations and authorizing the submittal of the levy of special taxes to the qualified electors of territory proposed to be annexed (APN 0229-291-54 and 0229-291-46, Annexation No. 22-3) to existing Community Facilities District No. 85-1 (“CFD No. 85-1”) and calling a special election for such purpose. BACKGROUND: Speedway Commerce Center Development, LLC, property owner, has submitted a proposal to develop property located at 13120 and 13160 Napa Street (APN 0229-291-54 and 0229-291-46, the “Annexation Area”) and is conditioned by the City and Fire Protection District to annex such property into the existing CFD No. 85-1 to satisfy fire protection service mitigation impacts. On September 6, 2022, the Board initiated formal annexation proceedings pursuant to the provisions of the Mello-Roos Community Facilities Act of 1982 (the “Mello-Roos Act”) by adopting Resolution No. FD 2022-026 approving the annexation map of the territory proposed to be annexed into existing CFD 85-1 and Resolution No. FD 2022-027 approving the intention to annex the Territory in the existing CFD 85-1. This Resolution, among other things, declared the intention of the Board of Directors to levy a special tax within the Annexation Area to finance fire protection and suppression services and setting a public hearing regarding the proposed annexation to be held on October 19, 2022. Through adoption of this resolution before the Board this evening, the Board will accomplish the following: •Make certain determinations as set forth in the Resolution; •Call for a special election to be conducted on October 19, 2022; •Authorize submittal of the levy of the special tax to qualified electors of the Annexation Area at such Special election. Page 105 Page 2 1 4 7 6 ANALYSIS: The annexation of the Annexation Area into CFD No. 85-1 will satisfy the conditions of development relating to mitigating impacts upon fire protection services. The property owner is in full support of the annexation of the property being annexed. Pursuant to the Mello-Roos Act, whenever there have been less than 12 persons registered to vote within the Annexation Area for each of the 90 days preceding the public hearing pertaining to such annexation, the vote shall be by the landowners within the Annexation Area. Therefore, in the current circumstances, the election will be a landowner’s vote, the landowner having one vote per acre or portion thereof of land within the Annexation Area. The property owner has executed a “Consent and Waiver” of time frames relating to the election. Exhibit “C” of the Resolution sets forth the rate and method of apportionment of the special tax proposed to be levied within the Annexation Area which is consistent with the special tax levied upon all territory currently within CFD No. 85-1. At the special election to be held on October 19, 2022, the landowner(s) will be entitled to cast its ballot. The Board Secretary will then canvas the ballot, if received. At the next Fire Board meeting, the Board will consider adopting the resolution declaring the election results and the annexation of the Annexation Area to CFD 85-1. If 2/3 of the votes are cast in favor of the levy of the special tax, the Board may declare the property to be annexed. The Public Notice regarding the Public Hearing has been advertised in the Inland Valley Daily Bulletin. FISCAL IMPACT: The special tax revenues that are collected of the CFD No. 85-1 are used to pay for public facilities and services in the District area. Costs related to the administering of the District are the responsibility of the property owners within the District. Annexation of the property located at 13120 and 13160 Napa Street will ensure the property owner covers the cost of increased demand for fire services resulting from new development within the Territory. The existing Community Facilities District has been designated as Community Facilities District No. 85-1 (the “District”); and, WHEREAS, notice of a public hearing relating to the annexation of territory to the District, the extent of the territory to be annexed (the “Annexation Area”), the furnishing of certain public services and all other related matters has been given; and, WHEREAS, it has now been determined that written protests have not been received by 50% or more of the registered voters residing either within the Annexation Area or the District and/or property owners representing more than one-half (1/2) or more of the area of land within the Annexed Area or within District; and, WHEREAS, inasmuch as there have been less than twelve (12) persons registered to vote within the Annexation Area for each of the 90 preceding days, this legislative body desires to submit the levy of the required special tax to the landowners of the Annexation Area, said landowners being the qualified electors as authorized by law. NOW, THEREFORE, the Board of Directors of the Rancho Cucamonga Fire Protection District does hereby resolve as follows: 1. Recitals. The above recitals are all true and correct. 2. Determinations. Boundaries of Annexed Area. The boundaries and parcels of land in the Annexation Area and on which special taxes are proposed to be levied in order to pay the costs and expenses for the public services described in Section 4 below are generally described as follows: All that property and territory proposed to be annexed to the District, as said property is shown on a map as previously approved by this legislative body, said map entitled “Annexation Map No. 22-3 of Community Facilities District No. 85-1 of the Rancho Cucamonga Fire Protection District, County of San Bernardino, State of California” reference is made to the attached and incorporated Exhibit “A” (the “Annexation Map”), and a copy of which is on file in the Office of the Secretary and shall remain open for public inspection. 4. Services and Facilities Authorized to be Financed by the District. The services that are authorized to be financed by the District from the proceeds of special taxes levied within the existing District are generally described in Exhibit “B” (the “Services and Facilities”) attached hereto and incorporated herein by this reference and all costs associated the District, administration of the District, the determination of the amount of special taxes to be levied, the costs of collection any special taxes, and costs otherwise incurred in order to carry out the authorized purposes of the District. If and to the extent feasible the Services and Facilities shall be provided in common within the existing District and the Territory. 5. Special Tax. Except where funds are otherwise available and subject to the approval of the qualified electors of the Annexation Area, a special tax sufficient to pay for the services described in Section 4 that are required for the Annexation Area, secured by recordation of a continuing lien against all non-exempt real property in the Annexation Area will be levied annually within the boundaries of the Annexation Area. For particulars as to the rate and method of apportionment of the proposed special tax, reference is made to the attached and incorporated Exhibit “C” which sets forth in sufficient detail the method of apportionment to allow each landowner or resident within the Annexation Area to clearly estimate the maximum amount of the special tax that such person will have to pay. The special taxes shall be collected in the same manner as ad valorem property taxes and shall be subject to the same penalties, procedure, sale and lien priority in any case of delinquency, as applicable for ad valorem taxes; however, as applicable, this Board of Directors may, by resolution, establish and adopt an alternate or supplemental procedure as necessary. Any special taxes that may not be collected on the County tax roll shall be collected through a direct billing procedure by the Treasurer of the Rancho Cucamonga Fire Protection District, acting for and on behalf of the District. 6. Special Tax Accountability Measures. Pursuant to and in compliance with the provisions of Government Code Section 50075.1, this Board of Directors hereby establishes the following Page 108 Resolution No. FD 2022-XXX - Page 3 of 11 ATTACHMENT 1 accountability measures pertaining to the levy by the District of the special taxes within the Annexation Area as described in Section 5 above: A. Each such special tax shall be levied for the specific purposes section in Section 5. above. B. The proceeds of the levy of each such special tax shall be applied only to the specific applicable purposes set forth in Section 5. above. C. The District shall establish a separate account into which the proceeds of the special taxes levied within the District shall be deposited. D. The Fire Chief or his or her designee, acting for and on behalf of the District, shall annually file a report with the Board of Directors as required pursuant to Government Code Section 50075.3. 7. Election. The proposition related to the levy of the special tax shall be submitted to the qualified electors of the Annexation Area, said electors being the landowners, with each landowner having one (1) vote for each acre or portion thereof of land which he or she owns within said annexed territory. The special election shall be held on the 19th of October, 2022, and said election shall be a special election to be conducted by the Secretary (hereinafter “Election Official”). If the proposition for the levy of the special tax receives the approval of more than two-thirds (2/3) of the votes cast on the proposition, the special tax may be levied as provided for in this Resolution and the Board of Directors may determine that the Annexation Area is added to and part of the District. 8. Ballot. The ballot proposal to be submitted to the qualified voters at the election shall generally be as follows: PROPOSITION A RANCHO CUCAMONGA FIRE PROTECTION DISTRICT COMMUNITY FACILITIES DISTRICT NO. 85-1, AUTHORIZATION FOR SPECIAL TAX LEVY Shall Community Facilities District No. 85-1 of the Rancho Cucamonga Fire Protection District be authorized to levy special taxes within the territory shown on “Annexation Map No. 22-3 of Community Facilities District No. 85-1 of the Rancho Cucamonga Fire Protection District, County Of San Bernardino, State Of California” (the “Annexation Map”) pursuant to the rate and method of apportionment of special taxes (the “Special Tax Formula”) set forth in Resolution No. FD 2022-024 to finance fire suppression and protection services and administrative expenses? 9. Vote. The appropriate mark placed in the voting square after the word “YES” shall be counted in favor of the adoption of the proposition, and the appropriate mark placed in the voting square after the word “NO” in the manner as authorized, shall be counted against the adoption of said proposition. 10. Election Procedure. The Election Official is hereby authorized to take any and all steps necessary for the holding of said election. Said Election Official shall perform and render all services and proceedings incidental to and connected with the conduct of said election, and said services shall include, but not be limited to the following: A. It is the intention of the Board of Directors to finance certain types of fire services (the “Services”) that are in addition to those currently provided in or required for the Territory and are necessary to meet the increased demand for such fire services resulting from new development within the Territory and will not be replacing services already available to the Territory. A general description of the Services to be financed is as follows: The performance of functions, operations, maintenance, and repair activities in order to provide fire protection and suppression services to the Territory. The Facilities. It is the intention of this Board of Directors to finance the purchase, construction, expansion, improvement, or rehabilitation of certain types of fire facilities (the “Facilities”) that are in addition to those currently provided to serve the Territory and are necessary to meet the increased demand for such fire services resulting from new development within the Territory and will not be replacing facilities already available to serve the Territory. A general description of the types of the Facilities to be financed is as follows: Fire protection and suppression facilities and equipment, rescue equipment, with a useful life of five (5) years or more, including collection and accumulation of funds to pay for anticipated facilities cost shortfalls and reserves for repair and replacement to the extent that such facilities are necessary to meet the increased demand for such facilities resulting from new development within the Territory. REDUCTION IN SPECIAL TAX Commercial and industrial structures shall be granted a reduction in the Special Tax for the installation of complete sprinkler systems. In addition, multi-floor commercial and industrial structures shall be granted a reduction in Special Tax for each separate floor above or below the main ground floor of the structure. LIMITATIONS ON TAX LEVY The Special Tax shall only be levied on developed property; provided that the Special Tax shall not be levied until a “Certification of Occupancy” or “Utility Release” has been issued by the appropriate governmental agencies. Developed property is defined to be property: •Which is not owned by a public or governmental agency •Which is not vacant •Where a certificate of occupancy or utility release from the City of Rancho Cucamonga or the County of San Bernardino has been issued •Which has an existing building or structure onsite •Which does not have as its sole use power transmission towers, railroad tracks, and flood control facilities – these properties are exempt. Areas granted as easements to power transmission towers, railroad tracks, and flood control facilities shall be subtracted from the total acreage of the underlying lot and shall be exempt. The annual levy of the Special Tax shall be based upon an annual determination by the Board of Directors of the Rancho Cucamonga Fire Protection District of the amount of other revenues available to meet budget requirements. As used in this formula, "available revenue" shall include ad valorem taxes, State of California augmentation, tax increment revenues received from the Redevelopment Agency of the City of Rancho Cucamonga and any other source of revenue except the Special Tax. The Board of Directors shall take all responsible steps to retain maximum Redevelopment Agency funding to which, by agreement, they may lawfully receive. At the special election to be held on October 19, 2022, the landowner(s) will be entitled to cast its ballot. The Board Secretary will then canvas the ballot, if received. At the next Fire Board meeting, the Board will consider adopting the resolution declaring the election results and the annexation of the Annexation Area to CFD 88-1. If 2/3 of the votes are cast in favor of the levy of the special tax, the Board may declare the property to be annexed. The Public Notice regarding the Public Hearing has been advertised in the Inland Valley Daily Bulletin. FISCAL IMPACT: The special tax revenues that are collected of the CFD No. 88-1 are used to pay for public facilities and services in the District area. Costs related to the administering of the District are the responsibility of the property owners within the District. Annexation of the property located at 4552 Haven Avenue will ensure the property owner covers the cost of increased demand for fire services resulting from new development within the Territory. The existing Community Facilities District has been designated as Community Facilities District No. 88-1 (the “District”); and, WHEREAS, notice of a public hearing relating to the annexation of territory to the District, the extent of the territory to be annexed (the “Annexation Area”), the furnishing of certain public services and all other related matters has been given; and, WHEREAS, it has now been determined that written protests have not been received by 50% or more of the registered voters residing either within the Annexation Area or the District and/or property owners representing more than one-half (1/2) or more of the area of land within the Annexed Area or within District; and, WHEREAS, inasmuch as there have been less than twelve (12) persons registered to vote within the Annexation Area for each of the 90 preceding days, this legislative body desires to submit the levy of the required special tax to the landowners of the Annexation Area, said landowners being the qualified electors as authorized by law. NOW, THEREFORE, the Board of Directors of the Rancho Cucamonga Fire Protection District does hereby resolve as follows: 1. Recitals. The above recitals are all true and correct. 2. Determinations. Boundaries of Annexed Area. The boundaries and parcels of land in the Annexation Area and on which special taxes are proposed to be levied in order to pay the costs and expenses for the public services described in Section 4 below are generally described as follows: All that property and territory proposed to be annexed to the District, as said property is shown on a map as previously approved by this legislative body, said map entitled “Annexation Map No. 88-22-1 of Community Facilities District No. 88-1 of the Rancho Cucamonga Fire Protection District, County Of San Bernardino, State Of California” reference is made to the attached and incorporated Exhibit “A” (the “Annexation Map”), and a copy of which is on file in the Office of the Secretary and shall remain open for public inspection. 4. Services and Facilities Authorized to be Financed by the District. The services that are authorized to be financed by the District from the proceeds of special taxes levied within the existing District are generally described in Exhibit “B” (the “Services and Facilities”) attached hereto and incorporated herein by this reference and all costs associated the District, administration of the District, the determination of the amount of special taxes to be levied, the costs of collection any special taxes, and costs otherwise incurred in order to carry out the authorized purposes of the District. If and to the extent feasible the Services and Facilities shall be provided in common within the existing District and the Territory. 5. Special Tax. Except where funds are otherwise available and subject to the approval of the qualified electors of the Annexation Area, a special tax sufficient to pay for the services described in Section 4 that are required for the Annexation Area, secured by recordation of a continuing lien against all non-exempt real property in the Annexation Area will be levied annually within the boundaries of the Annexation Area. For particulars as to the rate and method of apportionment of the proposed special tax, reference is made to the attached and incorporated Exhibit “C” which sets forth in sufficient detail the method of apportionment to allow each landowner or resident within the Annexation Area to clearly estimate the maximum amount of the special tax that such person will have to pay. The special taxes shall be collected in the same manner as ad valorem property taxes and shall be subject to the same penalties, procedure, sale and lien priority in any case of delinquency, as applicable for ad valorem taxes; however, as applicable, this Board of Directors may, by resolution, establish and adopt an alternate or supplemental procedure as necessary. Any special taxes that may not be collected on the County tax roll shall be collected through a direct billing procedure by the Treasurer of the Rancho Cucamonga Fire Protection District, acting for and on behalf of the District. 6. Special Tax Accountability Measures. Pursuant to and in compliance with the provisions of Government Code Section 50075.1, this Board of Directors hereby establishes the following Page 121 Resolution No. FD 2022-XXX - Page 3 of 13 ATTACHMENT 1 accountability measures pertaining to the levy by the District of the special taxes within the Annexation Area as described in Section 5 above: A. Each such special tax shall be levied for the specific purposes section in Section 5. above. B. The proceeds of the levy of each such special tax shall be applied only to the specific applicable purposes set forth in Section 5. above. C. The District shall establish a separate account into which the proceeds of the special taxes levied within the District shall be deposited. D. The Fire Chief or his or her designee, acting for and on behalf of the District, shall annually file a report with the Board of Directors as required pursuant to Government Code Section 50075.3. 7. Election. The proposition related to the levy of the special tax shall be submitted to the qualified electors of the Annexation Area, said electors being the landowners, with each landowner having one (1) vote for each acre or portion thereof of land which he or she owns within said annexed territory. The special election shall be held on the 19th of October 2022, and said election shall be a special election to be conducted by the Secretary (hereinafter “Election Official”). If the proposition for the levy of the special tax receives the approval of more than two-thirds (2/3) of the votes cast on the proposition, the special tax may be levied as provided for in this Resolution and the Board of Directors may determine that the Annexation Area is added to and part of the District. 8. Ballot. It is the intention of the Board of Directors to finance certain types of fire services (the “Services”) that are in addition to those currently provided in or required for the Territory and are necessary to meet the increased demand for such fire services resulting from new development within the Territory and will not be replacing services already available to the Territory. A general description of the Services to be financed is as follows: The performance of functions, operations, maintenance, and repair activities in order to provide fire protection and suppression services to the Territory. The Facilities. It is the intention of this Board of Directors to finance the purchase, construction, expansion, improvement, or rehabilitation of certain types of fire facilities (the “Facilities”) that are in addition to those currently provided to serve the Territory and are necessary to meet the increased demand for such fire services resulting from new development within the Territory and will not be replacing facilities already available to serve the Territory. A general description of the types of the Facilities to be financed is as follows: Fire protection and suppression facilities and equipment, rescue equipment, with a useful life of five (5) years or more, including collection and accumulation of funds to pay for anticipated facilities cost shortfalls and reserves for repair and replacement to the extent that such facilities are necessary to meet the increased demand for such facilities resulting from new development within the Territory. Page 126 Resolution No. FD 2022-XXX - Page 8 of 13 ATTACHMENT 1 EXHIBIT “C” FOOTHILL FIRE PROTECTION DISTRICT COMMUNITY FACILITIES DISTRICT NO. 88-1 RATE AND METHOD OF APPORTIONMENT OF SPECIAL TAX The rate and method of apportionment of the special tax authorized to be levied within Community Facilities District No. 88-1 (the “CFD No. 88-1 Rate and Method”) as originally established for and as applied to the taxable properties within such community facilities district is as follows: “The Resolution of Intention refers to this Exhibit for an explanation of the rate and method of apportionment of the Special Tax so as to allow each landowner or resident within the proposed Community Facilities District to estimate the maximum annual amount that would be required for payment for such landowner’s or resident’s property. PROPERTY CATEGORIES There are three categories of property subject to special taxation, which are identified as follows: 1. DEVELOPED PROPERTY All property identified as a single Tax Assessor’s parcel for which property a building permit has been issued as of May 31 of any year. 2. VACANT PROPERTY All other property, excluding property which, as of the date of the election to authorize the levy of the Special Tax, is: (i) owned by public entity; (ii) owned by a regulated public utility and being utilized for transmission or distribution purposes; or (iii) zoned as open space. VACANT PROPERTY $10 per acre *** Page 128 Resolution No. FD 2022-XXX - Page 10 of 13 ATTACHMENT 1 * The square footage of dwelling unit living area shall mean the square footage of internal living space, exclusive of garages and other structures not used as living space, as shown on the building permit(s) issued for the dwelling unit. ** The square footage of a commercial or industrial building area shall mean the gross square footage for the building as reflected in the building plans upon which any building permits for the building were issued. *** The acreage of a Vacant Property shall be the gross acreage exclusive of any acreage dedicated or offered for dedication to a public agency. ESCALATION OF MAXIMUM SPECIAL TAX RATES The maximum annual Special Tax rates applicable to all Developed Property shall be subject to escalation each July 1 commencing July 1, 1989, by the change factor calculated annually by the State of California Department of Finance for the purpose of increasing appropriations limits of State and local governments. In the event that the Department of Finance or its successor ceases to calculate the annual change factor, such Special Tax rates shall be subject to annual escalation not to exceed the increase in the Consumer Price Index as published by the Bureau of Labor Statistics for the Los Angeles Primary Metropolitan Statistical Area for the preceding twelve (12) month reporting period. The maximum Special Tax rates applicable to all Approved Property and Vacant Property shall not be subject to escalation. METHOD OF APPROTIONMENT OF SPECIAL TAX The Special Tax shall be levied annually on all taxable property within one of the above identified Property Categories so long as Special Tax revenues are necessary to pay authorized expenses of the Community Facilities District, which may include, without limitation, payment of debt service on any bonded indebtedness of the Community Facilities District; replenishment of any required reserve fund for any such future public improvements, services or debt service; direct payment for public improvements; or payment of the operational and maintenance expenses of providing fire suppression and protection services to properties within the Community Facilities District. The annual levy of the Special Taxes shall be apportioned as follows: STEP 1: Fifty percent (50%) of the estimated ad valorem property tax revenue to be collected from properties within the Community Facilities District in the subject fiscal year which are allocable to the Foothill Fire Protection District shall be allocated to pay the estimated expenses of the Community Facilities District for the subject fiscal year. The remainder of the estimated expenses shall be referred to as the Net CFD Expenses. STEP 2: That equal percentage of the maximum authorized Special Tax rate applicable to all Developed Property Taxing Classifications necessary to generate Special Tax revenues equal to the Net CFD Expenses shall be levied on all Developed Property. STEP 3: If additional Special Tax revenues are still necessary to generate the Net CFD Expenses, that percentage of the maximum authorized Special Tax rate applicable to all Approved Property necessary to generate the additional Special Tax revenues to equal Net CFD Expenses shall be levied on Approved Property. Page 129 Resolution No. FD 2022-XXX - Page 11 of 13 ATTACHMENT 1 STEP 4: If additional Special Tax revenues are still necessary to generate the Net CFD Expenses, that percentage of all the maximum authorized Special Tax rate applicable to all Vacant Property necessary to generate the additional Special Tax revenues to equal Net CFD Expenses shall be levied on all Vacant Property. STEP 5: If additional Special Tax revenues are still necessary to generate the Net CFD Expenses, the Community Facilities District shall: A. Compare (i) the Special Tax rate which would be levied on each Developed Property pursuant to STEP 2 above with (ii) the product resulting from multiplying the square footage of the Developed Property times the Base Maximum Special Tax. The Base Maximum Special Tax means an amount equal to $0.0025 per square foot subject to escalation at the same rate and at the same time applicable to the maximum Special Tax rates for Developer Property. B. If the product described in (ii) above exceeds the Special Tax rate described in (i) above for any Developed Property, the Community Facilities District shall increase the Special Tax rate levied on each such Developed Property in equal percentages up to the rate not to exceed the product described in (ii) above necessary to generate the additional Special Tax revenues to equal Net CFD Expenses.
