HomeMy WebLinkAbout00-257 - Resolutions RESOLUTION NO. 00-257 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, UPHOLDING THE ACTION OF THE PLANNING COMMISSION AND APPROVING CONDITIONAL USE PERMIT NO.00-09 FOR THE DEVELOPMENT OF A NEW 10,944 SQUARE FOOT CHURCH ON 2.86 ACRES OF LAND IN THE LOW RESIDENTIAL DISTRICT, LOCATED AT 9212 BASE LINE ROAD AND MAKING FINDINGS IN SUPPORT THEREOF -APN: 202-242-09. A. RECITALS. 1. The Islamic Center of the Inland Empire has filed an application for the issuance of Conditional Use Permit No. 00-09, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On July 12, 2000, the applicant conducted a neighborhood meeting, which was attended by 14 residents. 3. On the 11th day of October 2000, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing and approved the application. 4. The decision represented by said Planning Commission Resolution was appealed in a timely manner to this Council. 5. On December 6, 2000, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application. 6. All legal prerequisites prior to the adoption of this Resolution have occurred. B. RESOLUTION. NOW,THEREFORE,it is hereby found,determined,and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Council during the above- referenced public hearing on December 6, 2000, including written and oral staff reports,the minutes of the above-referenced Planning Commission meeting,and the contents of Planning Commission Resolution No. 00-113, and together with public testimony, this Council hereby specifically finds as follows: Resolution No. 00-0257 Page 2 of 3 a. The application applies to the construction of a 10,944 square foot church on 2.86 acres of land in the Low Residential District, IocatE!d at 9212 Base Line Road; and b. The property to the north,east and west of the subject site is zoned Low Residential (2-4 dwelling units per acre), and the property to the soy th is zoned Neighborhood Commercial, and c. The application contemplates the construction of a new Islamic Worship Center on property owned by the applicant; and d. The application contemplates the use of the new building from 5:30 a.m. to 9:30 p.m. Monday through Friday for group worship and prayer services, and for children school purposes from 8:00 a.m. to 10:00 a.m. Saturday and Sunday. 3. Based upon the substantial evidence presented to this Council during the above- referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Council hereby finds and concludes as follows: a. The proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. b. The proposed development, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. c. The proposed use complies with each of the applicable provisions o the Development Code. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3, above,this Council herebydenies the appeal, upholds the action of the Planning Commission, and approves the application subject to all conditions of approval contained in the Planning Commission Resolution No. 00-113,attached hereto. 5. This Council hereby provides notice to Dr. Shoaib Pateil that the tima within which judicial review of the decision represented by this Resolution roust be sought is governed by the provisions of California Code of Civil Procedure Section 1094.6. 6. The City Clerk of the City of Rancho Cucamonga is hereby directed to: (a) certify to the adoption of this Resolution, and (b) forthwith transmit a certified copy of this Resolution, by certified mail, return-receipt requested,to Dr. Shoaib Pateil at the address identified in City records.
