HomeMy WebLinkAbout80-44 - Resolutions RESOLUTION NO. 80-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECLARING ITS INTENTION TO VACATE 19TH STREET AT RAMONA AVENUE AS SHOWN ON MAP NO. V-O07 ON FILE IN THE OFFICE OF THE CITY CLERK BE IT RESOLVED by the Council of the City of Rancho Cucamonga as follows: SECTION 1: That the City Council hereby elects to proceed under Section 8300, et seq., of the Streets and Highways Code, also known as the Street Vacation Act of 1941. SECTION 2: That the City Council hereby declares its intention to vacate a City street, as shown on Map No. V-007 on file in the Office of the City Clerk, a legal description of which is attached hereto marked Exhibit "A" and by reference made a part hereof. SECTION 3: That the City Council hereby fixes Wednesday, the 4th day of June, 1980, at 7:00 p.m., in the Community Services Building, located at 9161 Baseline, Rancho Cucamonga, California, as the t~e and place for hearing all persons objecting to the proposed vacation for the purpose of its determining whether said City street is necessary for present or prospective street purposes. SECTION 4: That the City Street Superintendent shall cause notices to be posted conspicuously along the line of the street or part thereof proposed to be vacated at least 10 days before the hearing, not more than 300 feet apart and not less than three signs shall be posted, each of which shall have a copy of this resolution on them and shall have the following title in lettering not less than one inch in height: "NOTICE OF HEARING TO VACATE STREET." SECTION 5: The subject vacation shall be subject to the reser- vations and exceptions, if any, for existing utilities or record. SECTION 6: The City Clerk shall cause this resolution to be published once in a newspaper published in the City 10 days before the date set for the hearing. SECTION 7: The City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in full force. Wasserman, City Clerk LEGAL DESCRIPTION FOR THE VACATION OF A PORTION OF 19TH STREET AT RAMONA AVENUE That portion of Nineteenth Street formerly known as Olive Street, as dedicated for public street and being shown as lying adjoining the South line of Lot 27, of the Foothill Frostless Fruit Company's Tract No. 2, as per plat recorded in Book 20 of Maps, page 34, said Nineteenth Street is now delineated on and being shown as lying South of and adjoining the South line of Parcel No. 3 of Parcel Map No. 3713, as per plat recorded in Book 34 of Parcel Maps, pages 18 and 19, (said Parcel Map No. 3713 being a division of said Lots 25 and 27 of said Foothill Frostless Fruit Company's Tract No. 2), all in the City of Rancho Cucamonga, County of San Bernardino, State of California, and more particularly described as follows: BEGINNING at the Southeast corner of Parcel No. 3, of Parcel Map No. 3713, as per plat recorded in Book 34 of Parcel Maps, pages 18 and 19, records of said County, said Southeast corner of Lot 27, of the Foothill Frostless Fruit Company's Tract No. 2 and being the West 16 feet of Ramona Avenue as vacated and abandoned by the Board of Supervisors of said County, dated March 25, 1935, thence from said point of beginning South 89°, 44', 46" West along the North line of Nineteenth Street said North line also being the South line of said Parcel No. 3 and also being the South line of said Lot 27 a distance of 155.24 feet; thence South 81°, 23', 33" East to a point that is South 0°, 31', 17" East from the point of beginning; thence North 0©, 31', 17" West to the point of beginning.
