A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, AUTHORIZING THE
PURCHASE OF REAL PROPERTY LOCATED AT THE SOUTHWEST
CORNER OF BERYL AND HILLSIDE.
The City Council of the City of Rancho Cucamonga, California,
hereby resolves as follows:
SECTION 1: The City Council of the City of Rancho Cucamonga,
California, hereby authorizes the purchase by the City of Rancho Cucamonga,
California, from the owner thereof, HERBERT F. BAUMGARTEKER, the real
property located at the southwest corner of Beryl and Hillside, City of
Rancho Cucamonga, County of San Bernardino, State of California, more
particularly described as follows:
Parcels 3 and 4 of Lots 7 and 8, Block 14, accord-
ing to the Map of the tract of land of the Cucamonga
Homestead Association, as per map recorded in Book 6
of Maps, Page 46, records of said County.
SUBJECT TO: All reservations, restrictions, rights
and rights-of-way of record.
SECTION 2: With respect to Parcel 3 referred to hereinabove, the
City Council hereby authorizes the City of Rancho Cucamonga, California,
to pay the amount of $83,853.00, in cash, upon close of escrow, to
HERBERT F. BAUMGARTEKER.
SECTION 3: With respect to Parcel 4 referred to hereinabove, the
City Council hereby authorizes the City of Rancho Cucamonga, California,
to pay the amount of $83,853.00, in cash, to HERBERT F. BAUMGARTEKER,
said sum to be payable on January 15, 1981, and not before. The pur-
chase price shall be secured by a deed of trust on said Parcel 4. Said
deed of trust shall provide, however, that the beneficiary and trustee,
upon the request of the City of Rancho Cucamonga, California, will
release and reconvey such portions of Parcel 4 to the City of Rancho
Cucamonga, California, as may be necessary for completion of the pro-
posed flood control project.
SECTION 4: The City Clerk is authorized and directed to prepare
all conveyances and other instruments necessary to effectuate the exchange
of land, and the same shall be signed by the City Clerk as to acceptance
on behalf of the City. The City Clerk is authorized and instructed to
accept and record in the Office of the County Recorder of San Bernardino
County, California, a deed of trust with respect to said real property
hereinabove described.
PASSED, APPROVED and ADOPTED this 6th day of February, 1980.
