HomeMy WebLinkAbout85-142 - ResolutionsRESOLUTION NO. 85-142 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, OF PRELIMINARY APPROVAL OF CITY ENGINEER'S REPORT FOR ANNEXATION NO. 1 TO LANDSCAPE MAINTENANCE DISTRICT NO. 4 (TERRA VISTA PLANNED COMMUNITY) WHEREAS, on May 15, 1985, the City Council of the City of Rancho Cueamonga directed the City Engineer to make and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972; and WHEREAS, the City Engineer has made and filed with the City Clerk of said City a report in writing as called for pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said City Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cueamonga as follows: SECTION 1: That the Engineer's Estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby, preliminarily approved and confirmed. SECTION 2: That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. SECTION 3: That the proposed assessment upon the subdivisions of land in said Assessment District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. SECTION 4: That said report shall stand as the City Engineer's Report for the purposes of all subsequent proceedings, and pursuant to the proposed district. Authority for ~eport This report is prepared in compliance with the requirements of article 4. Chapter 1, Division 15 of the Streets and Hiqhwavs Code, State of California (Landscaping and Lighting Act of 1982). ' SECTION 2. General DeScription Landscape Maintenance District No. 4 (the "District") maintains street p!antings. parks, trails, and similar areas throughout the Tetra Vista Planned Community. All residential developments in Tern Vista are to be annexed to the District pursuant to Ordinance No. 190; areas to be maintained which lie outside residential developments are also to be annexed for maintenance purposes. This Annexation No. 1 annexes to the District the ~ollowing areas: · Tract No. 12365 (270 multifamily dwellings) · Tract Nos. 12590-1, 12590-2, 12590-3, 12590-~, 12590-5 and 12590-6 (total 180 single family dwellings) ' · Northwest neighborhood park (Lot 1, Parcel Map !In. 8842) and trail Gateway planting at southeast corner of Base Line Road and Haven Avenue · Median planting in Base Line Road from Haven Avenue to a point 2,077 feet west of future Milliken Avenue · Median planting in Haven Avenue from Base Line Road to Church Street All landscaped areas to be maintained in the annexed tracts are shown nn the tract maps (or b.y separate instrument) as roadway riqht-of-way, dedica- tions. or easements to be granted to the City of Ranch6 Cucamnnga. SECTION 3. Plans and Specifications The plans and specifications for the landscaping within residential tracts have been prepared by the developer and have been aDDrnved as part of the improvement plans for those tracts. Plans and specifications for landscaped areas outside residential tracts have b~en separately prepared by the developer. ' _ Resolution No. 85-142 Page 4 Reference is hereby made to the subject tract maps and the assessment diagrams for the exact location of the landscaped areas. The plans and specifications by reference are hereby made a Dart of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Costs No costs will be incurred for construction. All improvements will be constructed by developers. Based on historical data, contract analysis, and developed work standards, it is estimated that maintenance costs for assess- ment purposes will be as set forth below. These costs are estimated only; actual assessments will be based on actual cost data. SECTION 5. Assessment Diagram A copy of the proposed assessment diagram is attached to this report. By this reference the diagram is hereby incorporated within the text of this report. SECTION 6. Assessment Maintenance costs for the entire District are found to be of specific benefit to all developed residential property within the District in accor- dance with the following relationship: Land Use Assessment Units Sinrile family residential dwelling 1 unit Multifamily residential dwelling .5 unit The City Council will hold a public hearing in june 1985, to determine the actual assessments based upon the actual costs incurred by the City during the 1984/85 fiscal year. SECTION 7. Order of Events 1. City Council adopts resolution instituting proceedinos. 2. City Council adopts Resolution nf Preliminary Approval of City Engineer's Report. ' 3. City Council adopts Resolution of Intention to Annex to District and sets public hearing dates. 4.
