HomeMy WebLinkAbout84-266 - ResolutionsRESOLUTION NO. 84-266 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA DETERMINING THAT THE CONSTRUCTION OF A STORM DRAIN FACILITY AND ASSOCIATED PUBLIC IMPROVEMENTS IN ARCHIBALD AVENUE IS OF BENEFIT TO THE RANCHO REDEVELOPMENT PROJECT AREA AND THE SURROUNDING NEIGHBOP. HOOD IN WHICH THE PROJECT IS LOCATED; DETERMINING THAT THERE ARE NO OTHER REASONABLE MEANS OF FINANCING SAID IMPROVEMENTS OTHER THAN TAX INCREMENT FINANCING WHEREAS, the Redevelopmerit Agency of the City of Rancho Cucamonga (hereinafter the '~gency") is Redevelopmerit Project Area (hereinafter the '~roject Area") pursuant to the Redevelopmerit Plan for the Project Area approved and adopted by this City Council by Ordinance No. 166 on December 23, 1981, (hereinafter the "Redevelopment Plan"); and WHEREAS, the Redevelopmerit Plan authorizes and directs the Agency to pay for and construct certain public improvements; and WHEREAS, California Health & Safety Code Section 33334.2 authorizes the Agency to improve land or building sites with offsite improvements for the purposes of increasing and improving the community's supply of low- and moderate-income housing available at affordable cost; and WHEREAS, California Health & Safety Code Section 33445 provides, in pertinent part, that an Agency may, with the consent of the legislative body, pay all or part of the cost of the installation and construction of any building, facility, structure or other improvement which is publicly owned, either within or without the Project Area, upon a determination by the legislative body that such buildings, facilities, structures or other improvements are of benefit to the Project Area or the immediate neighborhood in which the Project Area is located, and that no other reasonable means of financing such buildings, facilities, structures or other improvements are available to the community. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the City Council of the City of Rancho Cucamonga as follows: SECTION i: The City Council hereby determines that the construction of a storm drain facility and associated public improvements in Archibald Avenue is of benefit to the Project Area, the surrounding neighborhood in which the Project Area is located and the entire community of the City of Rancho Cucamonga. SECTION 2: The City Council further determines that no other reasonable means of financing the construction of said storm drain facility and associated public improvements is available. SECTION 3: The City Council hereby approves and authorizes the Redevelopment Agency of the City of Rancho Cucamonga to assist in the Financing of such public improvements and finds and declares that expenditures and obligations incurred by the Agency pursuant to this resolution shall constitute an indebtedness of the Project Area.
