HomeMy WebLinkAbout82-90 - ResolutionsRESOLUTION NO. 82-90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, COVERING PRELIMINARY DETERMINATION AND ORDERING THE PREPARATION OF A REPORT ON SAID IMPROVEMENT WHEREAS, the City Council of the City of Rancho Cucamonga, California (hereinafter referred to as "Agency"), is contemplating the construction of certain public works of improvement under proceedings conducted pursuant to the '~unicipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 82-1 (hereinafter referred to as the "Assessment District"). NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1: That the above recitals are all true and correct. SECTION 2: That certain public works of improvement, together with appurtenances and appurtenant work, including acquisition where necessary, are proposed to be done and made within the boundaries of the Assessment District. In connection therewith, this Agency finds and determines as follows: That the specific nature of the proposed works of improvement consists of all the work as shown on the proposed boundary map, as previously approved for this Assessment District. That the boundaries of the Assessment District and the lands and properties within the Assessment District proposed to be assessed to pay the costs and expenses of said proposed works of improvement are as shown upon a map of the Assessment District, which map has been heretofore approved by Agency and is on file in the Office of said Agency. Said map shall govern for all details as to the extent of the Assessment District. SECTION 3: That the statute under which it is proposed to conduct proceedings is the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, with bonds proposed to be issued as authorized by the "Improvement Bond Act of 1915", being Division 10 of said Code. SECTION 4: That this proposed improvement is referred to the appointed Superintendent of Streets, who is hereby appointed to procure all necessary information to prepare a report on the proposed improvement in the manner and form provided for in Division 4 of the Streets and Highways Code of the State of California, the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931". SECTION 5: That this Resolution and the Report as ordered herein are pursuant to the provisions of said Division 4. SECTION 6: That said Report, pursuant to Division 4, shall have attached to it a copy of this Resolution upon its adoption. Resolution No. 82-90 Page 2 SECTION 7: That the works of improvement as proposed to be constructed under these proceedings, generally consist of the following: The construction of certain street improvements, including grading, clearing and grubbing, paving, base and storm drain improvements, together with all appurtenances, in- cluding acquisition of rights-of-way where necessary, to serve and benefit properties within the boundaries of Assessment District No. 82-1. SECTION 8: That this legislative body does, at this time, intend to make a contribution towards certain of the costs and expenses of the works of improvement, as proposed under these proceedings. For particulars, reference is made to the "Report" as filed pursuant to Division 4 of the Streets and Highways Code, a copy of which will be on file with the transcript of these proceedings and open to public inspection.
