HomeMy WebLinkAbout82-5 - ResolutionsRESOLUTION NO. 82-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECLARING ITS INTENTION TO VACATE THE EAST/WEST ALLEY LOCATED 149'~ SOUTH OF NINTH STREET, BETWEEN THE SANTA FE RIGHT-OF-WAY AND CALAVERAS AVENUE AS SHOWN ON MAP NO. V-014 ON FILE IN THE OFFICE OF THE CITY CLERK BE IT RESOLVED by the Council of the City of Rancho Cucamonga as follows: SECTION 1: That the City Council hereby elects to proceed under Section 8300, et. seq., of the Streets and Highways Code, also known as the Street Vacation Act of 1941. SECTION 2: That the City Council hereby declares its intention to vacate the east/west alley located 149'± south of Ninth Street, between the Santa Fe right-of-way and Calaveras Avenue a City alley, as shown on Map No. V-014 on file in the Office of the City Clerk, a legal description of which is attached hereto marked Exhibit "A" and by reference made a part hereof. SECTION 3: That the City Council hereby fixes Wednesday, the 3rd day of February, 1982, at 7:00 p.m., in the Lion's Park Community Service Building, located at 9161 Baseline, Rancho Cucamonga, California, as the time and place for hearing all persons objecting to the proposed vacation for the purpose of its determining whether said City street is necessary for present or prospective street purposes. SECTION 4: That the City Street Superintendent shall cause notices to be posted conspicuously along the line of the street or part thereof proposed to be vacated at least 10 days before the hearing, not more than 300 feet apart and not less than three signs shall be posted, each of which shall have a copy of this resolution on them and shall have the following title in lettering not less than one inch in height: "NOTICE OF HEARING TO VACATE STREET". SECTION 5: The subject vacation shall be subject to the reservations and exceptions, if any, for existing utilities of record. SECTION 6: The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause same to be published 10 days before the date set for the hearing, at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California. Wasserman, City Cler~ Resolution No. 82-5 Page 2 EXHIBIT "A" (LEGAL FOR V-O14) That portion of the alley (20' wide) as shown on Eureka Gardens Tract No. 182~, as recorded in Map Book 28, Page 20 in official records of San Bernardino County, State of California, bounded by the following: On the east, by the west right-of-way line of Monte Vista Avenue (presently known as Calaveras Avenue); on the west, by the west tract boundary; on the south, by the north property line of Lot 19; on the north, by the south property lines of Lots i, 2, and 3, all of the said tract map. EXHIBIT "B" RESERVATIONS AND EXCEPTIONS The vacation described in Exhibit "A" pertains only to the use of said land for alley purposes. All utilities uses are retained and excepted.
