HomeMy WebLinkAbout84-53 - ResolutionsRESOLUTION NO. 84-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ORDERING CERTAIN CHANGES AND MODIFICATIONS TO THE RESOLUTION OF INTENTION AND PROCEEDINGS RELATING TO THE FORMATION OF A COMMUNITY FACILITIES DISTRICT. WHEREAS, the City Council of the City of Rancho Cucamonga, California, (hereinafter referred to as the "legislative body of the local Agency"), has previously declared its intention and ordered the preparation of a "Report" relating to the initiation of proceedings to create a Community Facilities District pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982," being Chapter 2.5, Part i, Division 2, Title 5 of the Government Code of the State of California. This Community Facilities District shall hereinafter be referred to as: COMMUNITY FACILITIES DISTRICT NO. 84-1 (DAY CREEK DRAINAGE SYSTEM) (hereinafter referred to as the "District"): and, WHEREAS, notice of a public hearing relating to the extent of the District, the furnishing of certain facilities and all other related matters has been given, and a "Report," as ordered by this Agency, has been considered, and at this time it is hereby determined that certain changes and modifications in the Resolution of Intention and proceedings should be ordered. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1: That the above recitals are all true and correct. SECTION 2: That it is in the best public interest and convenience to order certain changes and modifications to the proceedings and Resolution of Intention, as they relate to the formation of the District, and said changes and modifications are as set forth in the attached, incorporated and referenced Exhibit "A". SECTION 3: That the proceedings, Resolution of Intention and "Report" of the Engineer as now modified, shall stand for all future proceedings as the Resolution of Intention, proceedYngs and "Report" for the District. Wasserman, City Clerk J D Mikel's~<~yo~~'~ Resolution No. 84-53 Page 2 EXHIBIT "~' IT IS HEREBY ORDERED that the following changes and modifications be made to the proceedings and "Report" of the Engineer, and the following properties be expressly deleted from the boundaries of said Community Facilities District, and it is further ordered that the previously approved map be amended to reflect said deletions: I. Delete and exclude all properties lying northerly of Summit Avenue, inasmuch as said property and parcels will not be draining into the Day Creek Drainage area. II. Delete and exclude all operating and occupied transmission power lines owned in fee and occupied by transmission towers. III. Delete and exclude all operating railroad mainline rights-of-way. The above parcels and their usage will not result in the need for improvement of the proposed public capital improvement facilities. the The Engineer of Work is hereby ordered to modify the boundaries of the previously approved Community Facilities District, and a copy of said amended map shall immediately be placed on file in the Office of the City Clerk, with dates indicating this action by the City Council.
