HomeMy WebLinkAbout88-251 - Resolutions RESOLUTION NO. 88-251 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PAN(HO (1JCAI~)I~A, CALIFORNIA, ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 13 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 6 AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR DR 87-26 (PM 10782) WHEREAS, the City Council of the City of Rancho Cucamonga did on the 16th day of March, 1988, adopt its Resolution of Intention No. 88-150 to order the therein described work in connection with Annexation No. 13 to Street Lighting Maintenance District No. 6, which Resolution of Intention No. 88-150 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City. Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and n~ber as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements describe4 in said Resolution of Intention No. 88-150, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documenzary, concern{ng the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work. and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work,, as ~et forth and described in said Resolution of Intention No. 88-150, be done and made; and SECTION 2.' The Report filed by the Engineer is hereby finally approved; and Resolution No. 88-251 Page 2 SECTION 3: The assessments and method of assessment in the Engineer's Report are hereby approved. SECTION 4: The assessments shall not begin until after 60 percent of said tracts have been occupied. City Clerk Resolution No. 88-251 Page 3 CITY OF RANCHO C~CAMONGA Engineer' s Report for Street Lighting Maintenance District No. 6 Annexation No. 13 for DR 87-26 (PM 10782) SECTION 1. Authority for Report This report is in compliance with the requirements of Article Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex all new developments into Street Lighting Maintenance District No. 6. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said developments as well as on the lots directly abutting the street lights. Work to be provided for with the assessments established by the district are: The furnishing of services and materials for the ordinary and usual maintenance, operating and servicing of street light improvements on local streets as shown on the Lighting District Atlas Map which is on file with the City Engineer. Improvement maintenance is considered of general benefit to all areas in the District and cost shall be assessed on a per unit basis. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the development and. aa. approved by the City Engineering Division. Reference ia hereby made to the subject tract map or development plan and the assessment diagrem for the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual development is hereby made a part of this report · to the same extent as if said plans and specifics were attached hereto. Detailed maintenance activities on the street lighting district include{ the repair, removal or replacement of all or any part of any improvement, providing for the illumination of the subject area. Resolution No. 88-251 Page 4 SECTION 4. Estimated Costs No costs will be incurred for street lighting improvement construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. Street Lighting Maintenance District No. 6 is comprised of street light improvements on local streets for all industrial, commercial and institutional projects throughout the City. It has been determined that one acre of land in industrial, commercial and institutional areas derives the same benefit as two assessment units in residential zones. The estimated total cost for Lighting Maintenance District No. 6 is shown below: 1. S.C.E. Resolution No. 88-251 Page 5 SECTION 5. Assessment Diagram Copies of the proposed Assessment Diagrams are attached to this report and labeled "Street Lighting Maintenance District No. 6", Annexation No. 13. These diagrams are hereby incorporated within the text of this report. SECTION 6. Assessment Improvements for the District are found to be of general benefit to all units within the District and that assessment shall be equal for each unit. When units are based on acreage, assessment will be 2 units per net acre. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to annex a District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to form a District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
