HomeMy WebLinkAbout88-451 - Resolutions RESOLUTION NO. 88-451 A RESOLUTION OF THE CIT~ COUNCIL 0F THE CITY OF RANCHO CUCAMD~A, CALIFORNIA, ORDERING THE WORK IN OONNECTION WI~ ANNEXATION NO. 48 TO LANDSCAPE MAINTENANCE DISTRICT NO. 1 AND ACCEPTING THE FINAL ENGINEER'S REPORT FOR TRACT NOS. 12650, 12650-4, 13715, 13697 AND 13742 WHEREAS, the City Council of the City of Rancho Oucamonga did on the 1st day of June, 1988, adopt its Resolution of Intention No. 88-360 to order the therein described work in connection with Annexation No. 48 to Landscape Maintenance District No. 1, which Resolution of Intention No. 88-360 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in tbs office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in tbs time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 88-360, according to the names and addresses of sdch owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form. and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary, concerning the .jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and tbs ordering of tbs work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 88-360, be done and made; and SECTION 2: Be it further resolved that the report filed by the Engineer is hereby finally approved; and Resolution No. 88-451 Page 2 SECTION 3: Be it further resolved that the asses~aents and method of asseseaent in the Engineer's Report are hereby approved. SECTION 4; Be it flnally resolved that said asses~ents shall not begin until after 60 percent of said tracts have been occupied. PASSED, APPROVED, and ADOPTED this 6th day of July, 1988. B~verly A./Authelet, City Clerk Resolution No. 88-451 Pass 3 CITY OF RAN(~I0 GDCAMDNGA Engineer' s Report for Landscape Maintenance District No. 1' Annexation No. 48 for Tract Nos. 12650, 12650-4[ 13715, 13697 and 13742 SECTION 1. Authority for Report This report is in compliance with tbs requirements of Article 4. Chapter 1. Division 15 of the Streets and Highways Code. State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council bas elected to annex all new subdivisions into Landscape Maintenance District No. 1. The City Council has determined that the areas to be maintained will have an effect upon all lots within Tract Nos. 12650. 12650-4, 13715, 13697 and 13742 as well as on the lots directly abutting the landscaped areas. All landscaped areas to be maintained in the annexed tracts are shown on the recorded Map as roadway right-of-way or easements to be granted to the City of Rancho Cucsmonga. SECTION 3. Plans and Specifications The plans and landscaping are as stipulated in the conditions of approval for tbs development and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the landscaped areas. The plans and specifications for landscaped improvement on tbs individual development is hereby made a part of this report to tbs same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Coats No costs will be incurred for parkway improvement construction. All improvements will be constructed by developers. Based on historical data, contract analysis and developed work standards, it is estimated that maintenance costs for assessment purposes will equal thirty ($.30) cents per square foot per year. These costs are estimated only, actual assessment will be based on actual cost data. I~here the development covered by this annexation involves frontage along arterlal or collector streets, which are designated for inclusion in the maintenance district but will be maintained by an active homeowners association, these assessments shall be reduced. SECTION 5. Assessment Diasra~ A copy of the proposed assessment diagram is attached to this report and labeled "Exhibit A", by this reference the diagram is hereby incorporated within the text of this report. SECTION 6. Assessment Improvements for the District are found to be of genera/ benefit to all lots within the District and that assessment shall be equal for each unit. ~ere there is more than one dwelling unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the number of dwe11ing units per lot or parcel. The City Council will hold a public hearing in June, to determine the actual assessments based upon the actual costs incurred by the City during the previous fiscal year which are to be recovered through assessments as required by the Landscape and Lighting Act of 1972. SECTION 7. Order of Events 1. City Council adopts Resolution of Prellminary Approval of City Englneer's Report. 2. City Council adopts Resolution of Intention to Annex to District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to Annex to the District or abandon the proceedings. 4. Every year in Hay, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
