Recitals (i) On April 27, 1988, the Flanntn$ Commission of the-Cit~ of Rancho Cucamonga conducted a duly noticed public hearing on a Conditional Use Pe~t. ~P 88-12. for a c~merc~ develo~ent at the northeast corner of Foothill Boul~ar4 and H~en Avenue, and foll~ng the conclusion of said hearing. adopted their Resolution ~. 88-75 there~ appr~ng the Conditional Use (ti) ~e applican~ has focally requested a reslismen~ of the sou~h driv~ay on H~en Aven~ which was spoored for ~P 88-12 in said Resolu~ion ~. 88-75 and described as fo11~s~ a. Resolu~ion ~ N~, ~ERE~RE, IF IS ~, DE~~D A~ R~OLV~ ~ the City ~uncil of the City of Rancho Cu~onga as foll~s: 1. ~ts ~uncil here~ s~cifically finds that all of the facts set forth in the Reclt~s, Part A, of this Resolution are tr~ and correct. 2. Based U~n the substantial ~idence presented to this ~uncil durlnS the a~v~referenced June 15, 1988, r~i~ hearins, this ~cil s~cifically finds as foll~s: a. ~e drtv~ay relocation to the north would create a condition which would res~t in a ~tential o~nins tn the median island on Haven AwenueI b. ~e Gener~ ~an restricts median island o~ninss to approx~ately one-q~rter mile s~cin~s (1300 feet) on the major divided arterial si Resolution No. 88-410 Page 2 c. A median island opening within this area would result in congestion extending south through the intersection of Foothill Boulevard and would be a source of increased traffic hazards and accidents: d. A median opening in this area would reduce the median to a 4-foot wide rock strip with one mall pecker of landscaping vegetation near Town Center Drive, thus destroying the extensive median island beautification project along H~ven Avennel and e. The requirement of the Planning Commission Resolution No. 88-75 provides for the approved driveway location as shown on the approved Site Plan for CUP 88-12. 3. Based upon the substantial evidence presented to this Council durin$ the above-referenced revlev hearing and upon the specific findings of facts set forth in pe~asraphs I and 2 above, this Council hereby finds and concludes aa follows; a. The most southerly driveway onto Haven Avenue .fro~ the subject commercial develo~uent shall rsuain at the present location as approved by the Planning Commission Resolution No. 88-75 for CUP 88-121 or b. The southerly driveway onto Haven Avenue may be relocated, at the discretion of the Planning Ccmmlssion, further south not to exceed a maximum distance as determined by the City Engineer; and c. No additional median island: openings shall be permitted on Haven Avenue other than those provided by the median island construction and landscaping project approved consistent with the 6eneral Plan requirement of one-quarter mile spacings (1300 feet) on the major divided arterials. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2 and 3 above, this Council hereby denies the request to relocate the southerly driveway onto Haven Avenue for Conditional Use Permit 88-12, approved in Plannin$ Commission Resolution No. 88-75, in a northerly direction.
