HomeMy WebLinkAbout88-403 - Resolutions RESOLUTION NO. 88-403 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCMO OJCA~DNGA, CALIFORNIA, ORDERING~ THE WORE IN CONNECTION WITH ANNEXATION NO. 16 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 6 AND ACCEPTING TME FINAL ENGINEER'S REPORT FOR CUP 87-04 AND DR 86-32 (LOT 5, TRACT 12176) WHEREAS, the City Council of the City of Rancho Cucamonga did on the 18th day of May, 1988, adopt its Resolution of Intention No. 88-320 to order the therein described work in connection with Annexation No. 16 to Street Lighting Maintenance District No. 6. which Resolution of Intention No. 88-320 was duly and legally published in the time. form and manner as required by law. shown by tbs Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk: and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 88-320, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law. as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS. said City Council having duly received considered evidence. oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and tbs benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Oucamonia that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work. as set forth and described in said Resolution of Intention No. 88-320. be done and made; and SECTION 2: The Report filed by the Engineer is hereby finally approved; and SECTION 3: The assessments and method of assessment in the Engineer's Report are hereby approved. Authelet. ~ity-Cle~k~ Resolution No. 88-403 Page 3 CITY OF RANCitO CUCAMDNGA Engineer's Report for Street Lighting Maintenance District No. 6 Annexation No. 16 for CUP 87-04 and DR 86-32 (lot 5, TR 12176) SECTION 1. Authorit~ for Report This report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code. State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex all new develo~ents into Street Lighting Maintenance District No. 6. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said developments as well as on the lots directly abutting the street lights. Work to be provided for with the assessments established by the district are: The furnishing of services and materials for the ordinary and usual maintenance, operating and servicing of street light improvements on local streets as shown on the Lighting District Atlas Map which is on file with the City Engineer. Improvement maintenance is considered of general benefit to all areas in the District and cost shall be assessed on a per unit basis. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the develo~ent and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or develof~ent plan and the assessment diagram ~or the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual develo~ent is hereby made a part of this report to the same extent as if said plans and specltics were attached hereto. Detailed maintenance activities on the street lighting district include: the repair, removal or replacement of all or any part of any improvement, providing for the illumination of the subject area. SECTION 4. Estimated Costs No costs will be incurred for street lighting improvement construction. All improvements will be constructed by developers. Based on available data. it is estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. Resolution No. 88-403 Page 4 Street Lighting Maintenance Distr~ct No. 6 is comprised of all industrial, comaercial and institutional pro~ects throughout the City. It has been datelined that one acre off land in industrial, commercial and institutional areas derives the same benefit as two assessment units in res/dent/al zones. Assessment Diagram Copies of the proposed Assessment Diagrams are attached to this report and labeled -Street Lighting Maintenance District No. 6e, Annexation No. 16. These diagrams are hereby incorporated vithin the text of this report. SECTION 6. Assessment Improvamenta for the District are found to be of general benefit to all units vithin the District and that assessment shall be equal ~or each unit. ~nen units are based on acreage, assessment viii be 2 units per net acre. Resolution No. 88-403 Page 5 SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to annex a District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to foz~ a District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
