HomeMy WebLinkAbout88-367 - Resolutions RESOLUTION NO. 88-367 A RESOLUTION OF THE CIT~ COUNCIL OF THE CIT~ OF RANfMO O3CAMDNGA, CALIFORNIA, APPROVING GENERAL PLAN A~NDMENT (GPA) 88-01A, R~UESTING TO A~ND THE GENERAL PLAN LAND USE MAP FROM OFFICE PROFESSIONAL (OP) TO NEIGHBORHOOD COMmeRCIAL (NC) FOR 3.45 ACRES OF LAND LOCATED ON THE SOUTHWEST CORNER OF BASE LINE ROAD AND HELLMAN AVENUE, RANfMO O3CAMDNGA, CALIFORNIA, APN: 208-202-13 AND 14 AND MAKE FINDINGS IN SUPPORT THEREOF A. Recitals. (i) James E. Carter has filed an application for General Plan Amendment No. 88-01A as described in the title of this Resolution. Hereinafter in this Resolution the subject General Plan Amendment is referred to as "the application". (ii) On January 27, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and issued Resolution No. 88-24 recommending to this City Council that said application be denied. (iii) On May 18, 1988, the City Council of the City of Rancho Cucamonsa conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iv) Ail legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part "A" of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing June !, 1988, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to approximately 3.45 acres of land, basically rectangular in configuration, located on the southwest corner of Base Line Road and Hellman Avenue and is presently undeveloped. Said property is currently designated as Office Professional land use; and Resolution No. 88-367 Page 2 (b) The properW to the north of the subject site is designated Low Residential and consists of a church site and surrounding single family residential. The property to the west is designated Civic/Community and Park and consists of the public library and Lions Park. The property to the east is designated Office Professional and consists of a service station and office buildings. The property to the south is designated Hediu~ Residential and consists of multiple family apartment complexl and (c) This amendment does not confllct with the Land Use Policies of the General Flan and will provide for develotment, within the district, in a manner consistent with the Develo~nent District and with related developaentl and (d) This amendment promotes the goals and objectives of the Land Use Ele~entl and (e) This amendment would not be materially injurious or detrimental to the adjacent properties. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph I and 2 above, this Council hereby finds and concludes as follows: (a) That the subject property is sultable for the uses permitted in the proposed district in terms of access, size, and compatibility with existing land uae in the surrounding areal and (b) That the proposed amendment would not have significant impacts on the enviromnent nor the surrounding properties; and (c) That the proposed amendment is in conformance with the General Plan. 4. This Council hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental quallty Act of 1970 and, further, this Councll hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Council hereby resolves that pursuant to Section 65850 to 65855 of the California Government Code. that the City Council of the City of Rancho Cucamonsa hereby approves on the 1st day of June. 1988, General Plan Amendment No. 88-01A. 6. The City Clerk to this Council shall certify to the adoption of this Re solution. Resolution No. 88-367 Page 3 PASSED, APPROVED, and ADOPTED this 1st day of June, 1988.
