Recitals. (i) Nourse Developaent has filed an application for the approval of Development Review No. 87-33 as described in the title of this Resolution. Hereinafter in this Resolution. the subject Development Review request is referred to as "the applicationw. (ii) On the 23rd of March, 1988. the Planning Commission of the City of Rancho Cuca~onga conducted a meeting on the application and tbs related General Plan and Developaent District Amendments to change the land use designation from Low-Medium Residential to High Residential with a Senior Overlay District. (iii) Based on evidence presented during tbs meeting of March 23. 1988 tbs Planning Commission recommended denial of tbs General Plan and Development District Amendments to the City Council and. in so doing, denied tbs application due to inconsistencies with the General Plan and Development Code. (iv) On tbs 18th of May. 1988, the City Council of the City of Rancho Cucamonga. on appeal by the applicant, conducted a meeting on tbs application and concluded said meeting on that date. (v) Ail legal prerequisites to tbs adoption of this Resolution have occurred. B. Re so lu t ion. NO~. THEREFORE. it is hereby found, determined and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A. of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the aBove-referenced meetin$ on May 18, 1988, including written and oral staff reports, this Council hereby specifically finds as followsz Resolution No. 88-365 Page 2 (a) The application applies to property located on the west side of Base Line Road, west of Archibald Avenue with a street frontage of 328 feet and lot depth of 643 feet and is presently improved with single family residences I and (b) The property to the north of the site is designated for ?commercial uses and is developed vith a shopping center. The properties to the south and east are designated for residential uses and are developed vith single family homes. The property to the east is designated for connercial and residential uses. The commerces! piece is developed vith a shopping center and the residential piece is developed vith single fam~y residences: and (c) The City Council recommended approval of the General Fl_an and Developuent District Amendments to change the land use designation from Lov-Hedlum Residential to High Residential vith a Senior Overlay District. With approval of the General Plan and Developeent District Amendments, the project rill be consistent vith the General Plan and'meet the intent and requirements of the Developuent Code. 3. Based upon the substantial evidence presented to this Council during the above-referenced meeting and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Council hereby finds and concludes as follo~s: (a) That the proposed project is consistent with the objectives of the Genera~ Plan; and (b) That the proposed use is in accord with the objective of the Develol~ent Code and the purposes of the district in which the site is located~ and (c) That the proposed use is lu compliance with each of the applicable provisions of the Development Code ~ and (d) That the proposed use. together with the conditions applicable thereto, will uot be detrimental to the publlc health, safety, or welfare, or materially injurious to properties or inprovements in the vicinity. 4. This Council hereby finds and certifies that the project has been reviewed and considered in compliance vith the California Enviror~ental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph l, 2 and 3 above, this Council hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Resolution No. 88-365 Page 3 Plannin~ Division 1. The following items shall be incorporated into the flnal landscape plans which are subject to revie~ and approval by the Gity Planner prior to the issuance of building permits: a) Extensive landscaping shall be provided around the per~meter of the site. b) The driveway median shall be planted with materials satisfactory to the Foothill Fire District. c) The driveway connection at the southeast corner of the site shall be turf block for e~erEency access only. 2. Trellis structures shall be provided over the trash enclosures. The plans shall be reviewed and approved b~ the City Planner prior to the issuance of building permits. 3. A decorative block wall shall be required around the perimeter of the site, excluding the southern portion of the east boundary. The wall shall be installed to avoid an~ double wall situations. The plans shall be reviewed and approved b~ the City Planner prior to the issuance of ~rading permits. 4. Approval of the project is contingent upon approval of General Plan Amendment 87-O4G, Develo~ent District Amendment 87-05, and Development Agreement 87-02. 5. The removal of the 28 mature trees shall require replacement with the largest nurser~ grown trees available, as determined by the City Planner. The applicant shall submit a plan and list of the tree species, height and trunk circumference as measured twenty-four inches from ground level, for the 28 existinE trees. 6. A final acoustical analysis shall be submitted to address potential impacts from Base Line Road for interior and exterior noise levels. The report shall be reviewed and approved by the City Planner prior to the issuance of building permits. 7. Fifty percent of the parkinE spaces provided shall be covered. The design of the structures shall be reviewed and approved by the Design Review Committee prior to the issuance of buildinE permits. 8. The final landscaping alonE the west site ~oundary shall be reviewed and approved by the Design Review Committee prior to the issuance of building permits. Resolution No. 88-365 Page 4 Engineering Division 1. Storm drain facilities and private drainage easements shall be obtained through the property to the east to drain the project site to Archibald Avenue. 2. An emergency access easement across the property to the east to ensure emergency ingress and egress to Archibald Avenue and the construction of a mountable curb shall be obtained prior to issuance of a building permit. 3. An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunication and electrical) on the opposite side of Base Line Road shall be paid to the City prior to the issuance of building permits. The fee shall be one-half the City adopted unit amount times the lenEth of the project frontage. 4. Drainage from the site shall be outletted onto Archibald Avenue in such a manner to not cause damage to the property to the south as approved by the City Engineer. The outlet facility could consist of a parkway drain or pipe and catch basin system outletting south of the existing driveway adjacent to the south property line and the rolling of said driveway if permission can be obtained from the property o~ner. 5. For the Base Line Road driveway, sisht lines shall be plotted on the landscape plans to assure adequate safe, unobstructed, stopping sisht distance as approved by the City Engineer.
