HomeMy WebLinkAbout89-540 - Resolutions RESOLUTION NO. 89-540 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 89-02D AMENDING THE GENERAL PLAN LAND USE MAP FROM FLOOD CONTROL TO CIVIC/COMMUNITY FOR APPROXIMATELY 3.15 ACRES OF LAND LOCATED ON THE NORTH SIDE OF BANYAN STREET, EAST OF THE DEER CREEK CHANNEL, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 201-191-24 A. Recital s. (i) E.G.M. Development has filed an application for General Plan Amendment No. 89-02D as described in the title of this Resolution. Herein- after in this Resolution, the subject General Plan Amendment is referred to as the "application". (ii) On September 27, 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and, following the conclusion of said public hearing, adopted Resolution No. 89-121 thereby recommending to this City Council that said application be a ppro ved. (iii) On November 1, 1989, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iv) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resol uti on. NOW, THEREFORE, the City Council of the City of Rancho Cucamon§a does hereby find, determine and resolve as follows: 1. This Council hereby specifically find that all of the facts set forth in the Recitals, Part "A", of this Resolution are true and correct. 2. This Council hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970, and further, this Council hereby issues a Negative Declaration. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing, including written and oral staff reports, this Council hereby finds and concludes as follows: (a) The property is suitable for the use proposed, as it has been designated surplus by the Flood Control District and will be adequately protected from flows from the north, as determined by the Engineering Division as a result of hydrologic analysis and proposed flood protection measures; and Resolution No. 89-540 Pa ge 2 (b) The site is of adequate size and shape to meet all development standard requirements, as evidenced by the design of the related development proposal, CUP 89-24; and (c) The site will have adequate access to accommodate the proposed use, based on compatibility with the adjacent residential collector street and proposed future roadway improvements; and (d) The proposed use is compatible wi th existing and future land uses in the area, as land to the north and east will be used for flood control purposes and the residential properties to the west and south have been designed in a manner which minimizes possible use conflicts; and (e) The proposed amendments will not have significant impacts on the environment nor the surrounding properties, as evidenced by the conclusions and findings of the Initial Study Part II; and (f) The proposed amendments are in conformance with the General Plan, as evidenced by the ability of the proposed land use designation to satisfy the stated goals, objectives, and policies contained in the documents; and (g) The proposed amendments are in conformance with the policies and objectives contained within the Development Code, as evidenced by the ability of the proposed site to meet development standards. 4. The City Council of the City of Rancho Cucamonga hereby approves the application. 5. The City Clerk shall certify to the adoption of this Resolution.
