HomeMy WebLinkAbout79-53 - Resolutions RESOLUTION NO. 79-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF ARROYO VISTA AVENUE AS SHOWN ON MAP NO. V-001 FILE IN THE OFFICE OF THE CITY CLERK. BE IT RESOLVED by the Council of the City of Rancho Cucamonga as follows: SECTION 1: That the City Council hereby elects to proceed under Section 8300, et seq. of the Streets and Highways Code, also known as the Street Vacation Act of 1941. SECTION 2: That the City Council hereby declares its intention to vacate a portion of Arroyo Vista Avenue a City street, as shown on Map No. V-001 on file in the Office of the City Clerk, a legal description of which is attached hereto marked Exhibit "A" and by reference made a part hereof. SECTION 3: That the City Council hereby fixes Wednesday, the 1st day of August, 1979, at 7:00 p.m., in the Carnelian Elementary School Multi-Purpose room, located at 7105 Carnelian, Rancho Cucamonga, California, as the time and place for hearing all persons objecting to the proposed vacation for the purpose of its determining whether said City street is necessary for present or prospective street purposes. SECTION 4: That the City Engineer shall cause notices to be posted conspicuously along the line of the street or part thereof proposed to be vacated at least 10 days before the hearing, not more than 300 feet apart and not less than ~bree signs shall be posted, each of which shall have a copy of this resolution on them and shall have the ~ol]owin~ title in lettering not less than one inch in height: "NOTICE OF HEARING TO VACATE STREET." SECTION 5: The subject vacation shall be subject to the reservations and exceptions, if any, for existing utilities or record. SECTION 6: The City Clerk shall cause this resolution to be published once not less than ten days before the date set for the hearing, in The Daily Report., a newspaper of genera] circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California. SECTION 7: The City Clerk Shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in full force. PASSED, APPROVED, and ADOPTED this 5th day of July, 1979. AYES: Mikels, Palombo, Schlosser, Frost NOES: None ABSENT: Bridge ATTEST: LEGAL DESCRIPTION FOR THE VACATION OF A PORTION OF ARROYO VISTA AVENUE AT CALUMA COURT That portion of land shown as Arroyo Vista Avenue (60 feet wide) including Lot "A", on the map of Tract No. 9157, in the City of Rancho Cucamonga, County of San Bernardino, State of California, as per plat filed in Map Book 132, Pages 78, 79 and 80 in the Office of the San Bernardino County Recorder, lying northerly of the following described line: Commencing at the Southeasterly corner of Lot 79 of said Tract No. 9157; thence westerly along the southerly line of said Lot 79 a distance of 49.89 feet to the True Point of Beginning; thence westerly, along the westerly projection of said southerly line, 79.64 feet, more or less, to the easterly line of Lot 112 of said Tract and the terminus of said line description. EXCEPT THEREFROM that certain portion thereof lying southerly of the following described line: Commencing at said Southeasterly corner; thence westerly along said southerly line, 49.89 feet; thence northerly, at right angles to said southerly line, 5.00 feet to the True Point of Beginning; thence, parallel to said southerly line, south 89° 56' 20" west 31.14 feet, to the beginning of a tangent curve concave southeasterly having a radius of 48.00 feet, said curve being tangent at its southerly terminus to a line parallel with and 5.00 feet, measured at right angles, easterly of said easterly Iine of said Lot 112; thence southwesterly along said curve to its intersection with the above described prolongation of the southerly line of Lot 79.
