A RE~pLUTION OF THE CITY COUNCIL. OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, TO SUMMARILY VACATE A LANDSCAPE
MAINTENANCE ACCESS EASEMENT BETWEEN WHEATON COURT AND THE
SOUTHERN PACIFIC RAILROAD'S RIGHT-OF-WAY
WHEREAS, by Section 8333, of the Streets and Highway Code, the City
Council of the City of Rancho Cucamonga is authorized to summarily vacate a
landscape maintenance access easement herein more particularly described; and
WHEREAS,' the City Council found all the evidence submitted that said
landscape maintenance access easement, dedicated less than five years ago and
more than one year has not been used for its intended purpose.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resovlve as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga
hereby makes its order vacating said landscape maintenance access easement as
shown on Map V-083 on file in the office of the City Clerk of the City of
Rancho Cucamonga, which is attached hereto, marked Exhibits "A", and "B" and
by reference made a part thereof.
SECTION 2: That from and after the date the resolution is recorded,
said landscape maintenance access easement no longer constitutes a public
service easement.
SECTION 3: That the City Clerk shall cause a certified copy of this
resolution to be recorded in the office of the County Recorder of San
Bernardino County, California.
PASSED, APPROVED, and ADOPTED this 3rd day of May, 1989.
