HomeMy WebLinkAbout79-05 - Resolutions RESOLUTION NO. 79-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY DF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING THE INTERIM LAND USE, CIRCULATION ~D PUBLIC FACILITIES ELEMENT OF THE GENERAL PL~J~ AND INTERIM DEVELOPMENT REVIEW POLICIES FOR THE CITY RANCHO CUC~MONGA. WHEREAS, it is the goal of the City of Rancho Cucamonga to prepare and adopt a long range comprehensive ~eneral plan setting forth the manner in which the land within the City may be developed so as to provide the best possible living situation for all concerned and to achieve a social, economic and environmental balance within the city; WHEREAS, Government Code Section 653~2.5b requires that newIv incorporated communities develop all mandatory elements of the ~eneral plan within 3Q months after the date of incorporation; and WHEREAS, the City of Rancbo Cucamonga at the time of incorporation had fiscal resources to only do a portion of the work necessary for development of a complete master plan; and WHEREAS, prior to the adoption of the complete general plan; petitioners have or will attempt to subdivide and develop land in a manner that would De inconsistent with and would frustrate the general plan by circumventin~ the intent of the plan by requesting subdivision and project approval during the plans formulation stage; an~ WHEREAS, it is the objective of the City of ~ancho Cucamonga to protect the general plan from indescrim~nate lot splitting and development during its incubation period but not prohibit all lot splitting or development pending adoption of the complete general plan; and WHEREAS, it is the objectives of the Citv of Rancho Eucamonga to adopt measures to prevent this type of indiscriminate lot splitting and~or development; and WHEREAS, the Clty of Rancho Cucamon~a immediately needs a basic framework for planning within the communitv; and %,~E~EAS, John Blayney and Associates has prepared interim Land [' i, Circ~lation and Public Facilities Element~ ~f the Eeneral Plan for the City of Rancho Cucamonga; and !~HEREAS, the City Council has held a dulv advertised public hearing pursuant to Section 65854 of the California Government Code: and WHEREAS, the City Council has cons~derec~ revisions to the interim elements by the Ptannin~ Commission, the public and other interested parties; WHEREAS, the City Council has reviewed and considered the Draft Environmental Impact Report on the Interim Land Use, Circulation and Public Facilities Elements and all testimonv snd comments pertaining to it and finds the Draft Environmental Impact Pepoft to be adequate and has certified the Draft Environmental Impact ~eport. SECTION 1: The Rancho Cucamonga City Council has made the following findings: ]. That the interim Land Use, Circulation and Public Facilities Elements includes interim statements of development policies including maps and text setting f~rth objective, principles, standards and plan proposals. 2. That the interim Land Use, Circulation and Public Facilities Element of the General Plan designates proposed general distribution, general location and extent of the uses of the land. 3. That the interim Land Use, Circulation and Public Facilities Elements of the General Plan designates the general location and extent of existing and proposed major thoroughfares, transportation routes and local public facilities. NOW, THEREFORE, BE IT RESOLVED: 1. That pursuant to Sections 65351 and 65352 of the California Government Code, that the City Council of the City of Rancho Cucamonga hereby approves the interim Land Use, Circulation and Public Facilities Elements of the General Plan for Rancho Cucamonga on the 7th day of February, 1979. BE IT FURTHER RESOLVED, that the Rancho Cucamonga City Council will review these interim elements after preparation of the other mandatory elements for possible modification to reflect consistency in element policies. NOW, THEREFORE, BE IT RESOLVED, that it shall be the policy of the City Council of the City of Rancho Cucamonga to: 1. Anticipate and accommodate population growth in ways that are not damaging to the social, economic and environmental systems in the community by insuring compatibility with the existing and projected surroundin~ land use, preserving the identities of present communities; discouraging leapfrog development to reduce the cost of providing urban level services within these communities; and protecting areas sensitive to development from urbanization. 2. To improve the quality of life for the community by developing an ongoing open space program to provide visual relief from urban densities. 3. To encourage preservation of significant archeological historical sites representing all the ethnic, cultural and economic groups that have lived in Rancho Cucamonga. 4. To insure that its biological diversity be preserved for their scenic and education value by assuring that all proposed developments will be adequately reviewed with regard to possible adverse or beneficial effects on plant and animal life. 5. To safeguard and maintain areas of outstanding geologic features for their scenic, historical and cultural value. 6. To avoid land uses which threaten public safety and property value by: a. Assuring that population densities and development are kept to a minimum in areas of geologic hazards such as active fault zones and landslide areas. b. Requiring geologic reports where conditions warrant them identifying unstable slopes and seismic hazards relating to building sites prior to the approval of development projects; and c. Considering the limiting effects of geologic hazards on potential land uses and zoned dwelling unit densities; and Resolution No. 79-5 Page No. 3 d. Requiring new residential developments be designed to minimize volume and velocity of surface runoff and soil erosion including the application of revegetation programs, the proper design of surface and subsurface drainage and appropriate grading; and e. Consultation with the Foothill Fire District in critical fire areas for particular regulations prior to subdivision or project approval. 7. To encourage quality of design of all land uses within the City -=~rough a rigorous design critique of project design; a.~ 8. To preserve residential neighborhoods by protecting residential areas from incompatible land uses and dis- couraging the conversion of existing residential uses to non-residential uses.
