HomeMy WebLinkAbout81-129 - ResolutionsRESOLUTION NO. 81-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DECLARING ITS INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE RANCHO CUCAMONGA CITY COUNCIL. WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in the Public Employees' Retirement System by the execution of a contract, and sets forth the procedures by which said public agencies may elect to subject themselves and their employees to amendments to said Law; and WHEREAS, one of the steps in the procedure to amend this contract is the adoption by the legislative body of the public agency of a resolution giving notice of its intention to approve an amendment to said contract, which resolution shall contain a summary of the change proposed in said contract; and WHEREAS, the following is a statement of the proposed change: To provide Section 20614, Statutes of 1980 (to prospectively revoke Section 20614, Statutes of 1978) for local miscellaneous members. NOW, THEREFORE, BE IT RESOLVED, that L.~e City Council of the. City of Rancho Cucamonga gives notice of intention to approve an amendment to the contract between the Rancho Cucamonga City Council and the Board of Administration of the Public Employees' Retirement System, a copy of said amendment being attached hereto, as "Exhibit A" and by this reference made a part hereof. All words and zerms used herein which are defined in the Prblic Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. '~ormal retirement age" mean age 60 for local miscellaneous members. 2. Public Agency shall participate in the Public Employees' Re~iremen~ System from and after January 28, 1978 making its employees as hereinafter provided, members of said System subject to all provis~r.s of the Public Employees' Retirement Law except such as apply only on election of a contrac=ing agency and are no% provided for herein to all amendments to said Law hereafter enacted excep~ such as by express provisions thereof apply only on the election of con%rac-i~ agencies. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class are excluded by law or this agreement: a. Employees other than local safety members <herein referred local miscellaneous members). In addition to the classes of employees excluded from membership oy said Retirement Law, the following classes of employees shall not become members of said Retirement System: NO ADDITIONAL EXCLUSIONS The fraction of final compensation to be provided for each year credited prior and current service as a local miscellaneous memo~ shall be determined in accordance with Section 21251.1~ of said Retirement Law (2~ at age 60 Full). 5. The following additional provisions of the Public Employees' Retire- ment Law which apply only upon election of a contracting agency shall apply %o the Public Agency and its employees: s. Section 2Op24.2 (One-year fina~ompensation). b. Section 20930.~ (Military s~ce credit) as defined in Chaptar 8%O, Statutes of 19~6. c. Section 21022.1 (Indu ~rlal diesability retirement for al miscellaneous membe~.~nly. · · ~eased non-industrial disability allowance~. d Section 21298 ( e. Sections 21~2.~1~8v, (1959 Survivors Program), excluding Section 21382.2 (I_~e'ase~ 195~ Survivors benefits). f. Section<~Z/61a (Statutes of 19.8; reduction of normal me er contribution rate). From and after September 22, 1980, the normal member contribution rate shall be -0-~. g. Section 206~d (Statutes of 1980; to prospectively revoke Section 20614, Statutes of 1978). 6. Public Agency, in accordance with Section 20759.1 Government Code, shall not be considered an "employer" for purposes of Chapter 6 of the Public Employees' Retirement Law. Contributions of the Public Agency shall be fixed and determined as provided in Section 20759, Government Code, and such contributions hereafter made shall be held by the Board as provided in Section 20v59, Government Code. 7- Public Agency shall contribute to said Retirement System as follows: a- With respect to miscellaneous members, the agency shall con- tribute the following percentages of monthly salaries earned as miscellaneous members of said Retirement System: (1) 9.22~ percent on account of the liability for current service benefits. ~2~ 0.~6 percent on account of the liability for the 195° Survivor Program. b. A reasonable amount per annum, as fixed by the Board ~ cover ~n~ costs of administering said System as i~ affects the =ployees of Public Agency, not including the costs of special valuations of the periodic investigation and valuations required by law. c. A reasonable amount as fixed by the Board, payable in one install- ment as the occasions arise, to cover the costs of special valua- tions on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law. Contributions required of Public Agency and its employees shmll be subject to adjustment by Board on account of amendments to th~ Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by %he periodic investigation ~nd valuation requited ~y said Retirement Law. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within thirty days after the end of the period to which said contributions refer or as my be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances, or adjustments on account of errors in contributions required of any employee m~y be made by direct cash payments bezween the employee and the Board. Payments by Public Agency to Board may be made in the form of warrants, bank checks, bank drafts,. certified checks, money orders or cash. B.
