HomeMy WebLinkAbout81-94 - ResolutionsRESOLUTION NO. 81-94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, ORDERING TO BE VACATED, A PORTION OF CLEVELAND AVENUE, BETWEEN 7TH AND 8TH STREETS. WHEREAS, by Resolution No. 81-68, passed on May 20, 1981, the Council of the City of Rancho Cucamonga declared its intention to vacate a portion of a City street hereinafter more particularly described, and set the hour of 7:00 p.m. on June 17, 1981, in the Lion's Park Community Center Building, located at 9161 Baseline, Rancho Cucamonga, California, as the time and place for hearing all persons objecting to the proposed vacation; and WHEREAS, such public hearing has been held at said time and place, and there were no protests, oral or written, to such vacation; BE IT RESOLVED by the Council of the City of Rancho Cucamonga as follows: SECTION 1: The Council hereby finds all the evidence submitted that a portion of Cleveland Avenue is unnecessary for present or prospective public street purposes, and the City Council hereby makes its order vacating that portion of said City street as shown on Map No. V-012 on file in the office of the Clerk of the City of Rancho Cucamonga, which has been further described in a legal description which is attached hereto, marked Exhibit "A", and by reference made a part thereof. SECTION 2: The subject vacation shall be subject to the reservations and exceptions, if any, set forth in Exhibit "B", which is attached hereto and by reference made a part hereof. SECTION 3: The Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino County, California. SECTION 4: The Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force. PASSED, APPROVED, and ADOPTED this 17th day of June, 1981. AYES: Frost, Bridge, Schlosser NOES: None ABSENT: None ABSTAIN: Mikels, Palombo ATTEST: EXHIBIT A LEGAL DESCRIPTION FOR THE VACATION OF CLEVELAND AVENUE FROM 7TH STREET TO 8TH STREET V-012 THAT certain portion of the unnamed street, 60 feet wide, (known as Cleveland Avenue) as shown on the Map of Cucamonga Lands in the City of Rancho Cucamonga, County of San Bernardino, State of California, as per map recorded in Book 4 Page 9 of Maps in the Office of the County Recorder of said County bounded as follows. ON THE NORTH by the north line of Parcel No. 27 of Parcel Map No. 6194 as per map recorded in Parcel Map Book 62, pages 62 through 66 inclusive per records of said Recorder and the easterly projection thereof. ON THE SOUTH by the south line of Parcel No. 11 of said Parcel Map no. 6194, and the easterly projection thereof. ON THE WEST by a line parallel with and distant 30 feet westerly of the east lines of said Parcel Nos. 11 and 27, distance measured at right angles. ON THE EAST by a line parallel with and distant 30 feet easterly of the east lines of said Parcel Nos. 11 and 27 distance measured at right angles. EXHIBIT B RESERVATIONS AND EXCEPTIONS TO THE VACATION OF CLEVELAND AVENUE FROM 7TH STREET TO 8TH STREET. V-O12 THE vacation of street described in Exhibit A pertains only to the use of said land for street purposes. All utility uses are retained and excepted that exist by deed on the date of recording hereof.
