I AND ACCEPTING THE FINAL ENGINEER'S REPORT FOR TRACT NO. 9649, 11793. 11932. 12801, 12726, 12727, 13117. 13203, 11606, 11606-2. 11606-3. 11606-4. 10827, 10287-1, 10827-2. 10827-3, 11626, 10076. 11915 AND 13066 WHEREAS, the City Council of the City of Rancho Cucamon8a did on the 17th day of September, 1986, adopt its Resolution of Intention No. 86-267 to order the therein described work in connection with Annexation No. 17 to Street Lighting Maintenance District No. 1, which Resolution of Intention No. 86-267 was duly and legally published in the time, form and manner as required by law. shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerks and W~EREAS, after the adoption thereof, notice of the Passage of said Resolution of Intention, headed "Notice of Improvement-, was duly and legally posted in the time, form, manner. location, and umber as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; end W~REAS, after the adoption thereof, notices of the adoption of the Resolution of .Intention were duly mailed to all persons owuin8 real property proposed to be assessed for the improvements described in said Resolution of Intention No. 86-267, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council hayin8 duly received considered evidence, oral and documentarT, concerning the jurisdiction facts in this proceeding and concernin8 the necessity for the contemplated work and the benefits to he derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereb~ resolved by the City Council of the City of Rancho Cucamonaa that the public interest and convenience requires the annexation to the District and the ordering of the work. and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 86-267, be done end made; and SECTION 2: The Report filed by the Engineer is hereby finally approved] and SECTION 3: The assessments and method of assessment in the Engineer's Report are hereby epproved. Page 3 CITY OF RANCHO CUCANONGA Enginner's Report for Street Lighting Maintenance District rio. 1 Annexation No. 17 For Tracts 9649, 11793, 11932, 12801, 12726, 12727 13117, 13203, 11606-2, 10827-3, 11626, 10076, llglS-2, and 13066 SECTION 1. Authority for Report This report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 19721. SECTION 2. General Description This City Council has elected to annex the tracts enumerated in Exhibit "A' into Street Lighting Maintenance District rio. 1. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said tracts as well as on the lots directly abutting the street lights. Work to be provided for with the assessments established by the district are: The furnishing of services and materials for the ordinary and usual maintenance, operating and servicing of street light improvements on arterial and certain collector streets. Improvement maintenance is considered of general benefit to all areas in the District and cost shall be divided on a per lot basis. In the case of condomintums with airspace ownership only, and apartments, a dwelling unit shall be considered to benefit the sm as a lot. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the development and as approved by the City Engineering Division. Reference is hereby made to the sub3ect tract map or development plan and the assessment diagram for the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifics were attached hereto. Detailed maintenance activities on the street lighting district include: the repair, removal or replacement of all or any part of any improvmnt, providing for the illumination of the subject area. SECTION 4. Estimated Costs No costs will be incurred for street lighting improvement construction. All improve,ents will be constructed by developers. Based on available data, it ts estimated that maintenance costs for assessment purposes will be as Indicated below. These costs are estimated only, actual assessments will be based on actual cost data. These diagrams are hereby Incorporated wtthtn the text of this report. SECTZON 6. Assessment Zmprovement for the Otstrtct are found to be of general beneftt to all dwelltng units within the District and that assessment shall be equal for each unit. 14here there is more than one dwelltng unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the number of dwelling units per lot or parcel. It is proposed that all future developments shall be annexed to the DIstrict. SECTZON 7. Order of Events z. Ctty Counct1 adopts resolution Instituting proceedings. 2. Ctty Counctl adopts Resolution of Preliminary Approval of City Engtneer's Report. 3. City Counct1 adopts Resolution of zntentton to annex to District and sets public hearing date. 4. Ctty Counctl conducts publlc heartrig, considers all testimony and datemines to form a 0tstrtct or abandon .the proceedings. S. Every year in May, the Ctty Engineer ftles a report with the Ctty Counctl. 6. Every year tn June, the Ctty Counct1 conducts a public hearing and approves, or modtfles and approves the tndhtdual assessments.
