HomeMy WebLinkAbout86-296 - Resolutions RESOLUTION NO. 86-296 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 13 TO STREET LIGHTING MA/NTENANCE DISTRICT NO. 2 AND ACCEPTING T~E FINAL ENGINMER'S REPORT FOR TRACT NOS. 9649, 11793, 11932, 12726, 12727, 12801, 13117, 11606, 11606-2, 11606-3, 11606-4, 10827, 10827-1, 10827-2, 10827-3, 11626, 10076 AND 13066 W~EREAS, the City Council of the City of Rancho Cucamonga did on the 17th day of September, 1986, adopt its Resolution of Intention No. 86-269 to order the therein described work in connection with Annexation No. 13 to Street Lighting Maintenance District No. 2, which Resolution of Intention No. 86-269 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the Cit7 Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears frem the A~fidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 86-269, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears fro~ the A~fidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary. concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District end the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 86-269, be done and made~ and SECTION 2: The Report filed by the Engineer is hereby finally approved; and SECTION 3: The assessments and method of assessment in the Engineer's Report are hereby approved. Authority for Report Thts report is tn compliance with the requirements of Arttcle 4, Chapter Z, Oivtston Z5 of the Streets and Highways Code, State of California (Landscaping and Ltghttng Act of 1972). SECTION 2. General DescrIption This City Council has elected to annex the tracts enumerated in Exhibit "A" tnto Street Ltghttng Natntenance Distric~ rio. 2. The Ctty Counct1 has determined that the street lights to be maintained ,tll have an effect upon all lots wlthtn satd tracts as well as on the lots dtrectly abutttng the street ltghts. Work to be provided for with the assessments established by the district are: The furnishing of servtces and materials for the ordtnary and usual maintenance, operating and servicing of street 11ght improvements on aftertel and certain collector streets. Improvement maintenance is considered of general benefit to all areas' tn the Oistrtct and cost shall be dtvtded on a per lot basts. In the case of condomtntums with atrspace ownership only, and apartments, a dwelling unit shall be considered to benefit the same as a lot. SECTION 3. Plans and Specifications The plans and specifications for street 11ghttng have been prepared by the developers. The plans and street 11ghts are as stipulated in the conditions of approve1 for the development and as approved by the Ctty Englneering Division. Reference ts hereby made to the subject tract map or development plan and the assessment dtagram for the exact locatton of the street 11ghtlng areas. The plans and specifications for street 11ghttng Improvement on the Individual development is hereby made a part of this report to the same extent as tf said plans and specifics were attached hereto. Detailed maintenance activities on the street llghttng district tnclude: the repatr, removal or replacement of all or any part of any improvement, providing for the Illumination of the subject area. SECTION 4. Estimated Costs No costs wtll be incurred for street ltghttng improvement construction. All Improvements will be constructed by developers. Based on available data. tt is estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. SECTION 5, Assessment Diagram Copies of the proposed Assessment Otagrams are attached to this report and labeled "StrNt Lighting Natntenance Oistrict No, 2", Annexation No, 13. These diagrm are hereby tnco~orated within the text of this report. SECTION 6. Assessment I~rovement for the District are found to be of general benefit to all dwelling units within the District and that assessment shall be equal for each unit, Where there is more than one dwelling unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the nuff~er of ~11tng units per lot or parcel. It is proposed that all future developments shall be annexed to the District. SECTION 7. Order of Events 1. City Council adopts resolution instituting proceedings, 2. City Council adopts Resolution of Preliminary Approval of City Engineer's Report, 3, City Council adopts Resolution of Intention to annex to District and sets public hearing date. 4. City Council conducts public hearing, considers all testimony and determines to form a District or abandon the proceedings, 5, Every year in May, the City Engineer files a report with the City Council. 6. Every year in June, the.
