A RESOLUTION OF'THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ACCEPTING A REAL PROPERTY
IMPROVEMENT CONTRACT AND LIEN AGREEMENT FROM ROMAR
PROPERTIES, FOR DEVELOPMENT REVIEW AND AUTHORIZING THE
MAYOR AND CITY CLERK TO SIGN THE SAME
WHEREAS, as a condition of the approval of DR 87-06, the City
requires that an in-lieu fee be paid to the City as contribution to the future
undergrounding of the existing overhead utilities (communication) along the
Atchison Topeka and Santa Fe Railroad right-of-way in conjunction with
building permit issuance; and
WHEREAS, the Developer desires to postpone said payment until a later
date, as determined by the City; and
WHEREAS, as prerequisite to issuance of Building Permit for DR 87-06,
has been met by entry into a Real Property Improvement Contract and Lien
Agreement by Romar Properties.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga,
California, does hereby accept said Real Property Improvement Contract and
Lien Agreement, authorizes the Mayor and the City Clerk to sign same, and
directs the City Clerk to record same in the Office of the County Recorder of
San Bernardino County, California.
PASSED, APPROVED, and ADOPTED this 15th day of March, 1989.
